Take a moment and imagine that you are on a train — let’s say a train serving wine as you traverse through picturesque Napa Valley. You are with a group of your peers. You are adults and enjoying your time of fellowship. But because of a perceived notion that you are not fit for that environment you are unceremoniously removed from the train. Can you imagine the indignity of this encounter? Think about the anxiety this situation may cause. Think about the disrespect that you would feel.
Believe it or not, this is the reality for a large portion of the African American community. According to a 2015 Gallup poll, more African American adults feel discriminated against while shopping than doing anything. This sentiment includes encounters with the police.
A report released by the Center for Popular Democracy confirms these perceptions felt by African Americans. The report found that African American consumers are seven times more likely to be targeted as potential thieves as are white customers.
However, research on shoplifting trends in retail stores found no differences by race or ethnicity. Some research even suggests that African Americans are less likely to engage in shoplifting than are other groups. That means African Americans are being overly targeted by retailers while the real criminals get away.
This form of discrimination is not new. It is an adaptation of previous forms of discrimination transformed anew due to significant gains in civil rights protections. This form of discrimination has a name: consumer racial profiling.
Consumer racial profiling is particularly troublesome because it disproportionately affects African American women, a consumer group who engages in the retail sector at significantly higher rates than men.
The image that I asked you to conjure was not of my own making. It actually happened to a group of Black women. Notwithstanding the fact these train riders reached a final settlement just last month, California and other states can do a great deal more to end the consumer racial profiling that plagues retail environments.
Specifically in California, a piece of legislation I have authored (AB 2707—the Stop Consumer Racial Profiling Act of 2016) will amend our state’s civil rights statute to include the definition of this demeaning practice and require the state’s civil rights watchdog to investigate reported incidences of the practice. It is my hope that this legislation would pass a vote of my colleagues and be signed by the Governor. But more important than the passage of a bill is the transformation of behaviors by retailers that violate the civil and human rights of African American consumers.
Corporate loss prevention schemes must be reformed, executives, managers and rank-and-file employees must be awakened, and people of goodwill must demand that the targeting of consumers by racial characteristic is factually and morally wrong. It must end.
A new civil rights consciousness has gripped a great deal of the country. Maybe we can address some of the challenges that still occur on the basis of race by turning the tide against consumer racial profiling and letting it be a thing of the past.

Green-shirted Fed Up activists again have set up shop outside the central bank’s annual retreat in Grand Teton National Park. But this year, their critique of the Fed is paired with praise for Ms. Yellen and a demand that she remain the central bank’s chairwoman for another four-year term.

Las escuelas chárter son una forma más libre de educación pública o privada. Usualmente son fundadas por padres o maestros, manejadas por organizaciones con y sin fines de lucro; funcionan independientemente del sistema de educación pública y hacen hincapié en métodos y aéreas educativas más específicas. Normalmente atienden a un universo mucho más variado de alumnos y deben cubrir los requerimientos de educación especial de los mismos. El tamaño de las clases es más pequeño y en general se espera que tengan un nivel de rendimiento superior al promedio ya que, en teoría, al ser más libres de ensayar nuevas metodologías los alumnos encuentran más oportunidades para explotar sus capacidades. Estas instituciones conviven con las escuelas públicas que están sometidas a los estándares y regulaciones del Departamento de Educación y se mantienen con fondos públicos así como recolección de fondos privados. El crecimiento del número de escuelas chárter a nivel nacional se ha duplicado tres veces desde su implementación en el año 2000, según Donald Cohen, Director Ejecutivo de la organización no gubernamental In The Public Interest (ITPI). Cohen, junto a Kyle Serrette del Centro para la Democracia Popular (Center for Popular Democracy, CPD), revelaron los resultados de una reciente encuesta realizada entre un universo de 1000 votantes: la gran mayoría apoya la existencia de las escuelas chárter, pero asimismo exige una más exhaustiva supervisión del funcionamiento de estas instituciones, así como la realización de auditorías en sus finanzas, dados los pobres resultados académicos y la falta de transparencia en su administración. Report slams Louisiana charter school oversight

The Times-Picayune - 05-08-2015 - Louisiana understaffs its charter schools oversight offices and, instead of proactively investigating these schools, relies on charters' own reports and whistleblowers to uncover problems, according to a report released Tuesday (May 12) by the Center for Popular Democracy and the Coalition for Community Schools. That allows theft, cheating and mismanagement to happen, such as the $26,000 stolen from Lake Area New Tech High and the years of special education violations alleged at Lagniappe Academies.
The report also casts a skeptical eye on the veracity of the data that Louisiana uses to calculate the performance scores that keep charters open and determine their renewal terms. And it faults the state for closing struggling charters instead of intervening to improve them.
The Center for Popular Democracy's partners include the American Federation of Teachers, which has an uneasy relationship with charters, and the Annenberg Institute for School Reform, which studies charter school oversight. Kyle Serrette, the center's director of educational justice campaigns, said its parent members had children in charter and conventional public schools.
That said, one of the report's recommendations is to "impose a moratorium on new charter schools until the state oversight system is adequately reformed."
The Louisiana-based Coalition for Community Schools opposes charter schools outright and filed a civil rights complaint against the state Education Department in 2014. That complaint also included a demand to freeze chartering in New Orleans.
The two groups' report said Louisiana charters could suffer from "tens of millions of fraud in the 2013-14 school year alone," based on the methodology of the Association of Certified Fraud Examiners. In that time, employees of three New Orleans charter schools stole about $110,000, and two charter operators were accused of meddling with retirement payments.

"The state has invested heavily in increasing the number of charter schools while failing to create a solid regulatory framework that truly protects students, families and taxpayers," the authors write. Furthermore, "oversight agencies play almost no role in helping charter schools improve academic outcomes. ... The state has no system in place to provide a path to high-quality academics for all struggling charter schools."
Charter schools are publicly funded but run by independent non-profit boards. They control their own curriculum and hiring but must meet academic and operational standards to stay open. The state Education Department oversees most of Louisiana's 130-plus charters; local school systems oversee the rest.

However, as of December, the Education Department's charter audit team consisted of only three people, according to a critical December report from the Louisiana legislative auditor's office. Education Superintendent John White defended his team at the time, saying they reviewed charter schools' audits, among other activities.
Tuesday's paper says that isn't enough. Not only do charters hire their own accountants to conduct annual audits, but the audits are not designed to prevent or detect fraud. Indeed, reports typically contain a disclaimer saying they are not expressing an opinion on fraud controls. The legislative auditor's office might dig deeper but rarely does so, the report states.
"The only audits Louisiana charter schools routinely undergo are the ones they pay for themselves," the authors write.
The report faults the Education Department for not spending enough time on-site at charters. Charters receive regular visits and reviews from state inspectors, and Louisiana Recovery School District officials said their own findings of wrongdoing at Lagniappe Academies in New Orleans showed that their oversight procedures worked.
The authors of Tuesday's report disagreed. The state's 2013-14 review of Lagniappe Academies gave full points for special education, the two organizations said, and it was only later that state inspectors uncovered extensive reports of violations during that time period.
"The situation at Lagniappe shows exactly the problems with the state's oversight structure for charter schools," the report says. "The state relies on a largely self-reporting oversight structure that is easily manipulated by the schools themselves."
The authors doubt the accuracy of the test scores that are used to measure charters' academic performance, writing that the data "is vulnerable to manipulation."
Finally, the authors disagree with the state's readiness to close charters, including Lagniappe.
"Clearly there are times when problems are significant enough that a school must be closed. Yet, the current intervention (process) is designed to make school closure a normal and common part of the state's accountability system," the authors write. "The system needs to be updated to produce more stability for Louisiana children." In six years, more than 1,700 New Orleans students have seen their charter schools close, according to the report.
Louisiana's laws are "designed to set a high standard but not to help," Serrette said.
The state does at times intervene instead of closing schools, although this is not mentioned in the report. The Recovery School District has chosen successful charter operators to take over failing schools, for example, and White directed Lycée Français to find a new chief executive and assigned it a consultant team. Lycée has gone on to make a B grade, and its charter contract has been extended.
The report's recommendations include:
Require fraud audits every three years, to be conducted by the state legislative auditor's office
Train charter staff and boards on preventing fraud
Hire more staff for the legislative auditor's office and charter school oversight teams
Require "mandatory, hands-on, long-term, strategic support" for charters in trouble
Go beyond test scores when calculating school letter grades
Create local committees, including neighbors and parents, to design schools that serve the needs of a community
Coordinate social services at and around schools
Release raw testing data to the public.
Some of these issues are not unique to charters. Louisiana's conventional public schools also face pressure to keep test scores high: If they don't, they may be taken over by the state. There have been numerous examples of corruption and fraud in school boards and systems. Serrette said it was likely Louisiana's regular school systems needed stronger oversight as well.

In a decision that aligns with progressive demands, the Federal Reserve announced on Thursday that it would keep interest rates near zero in light of "recent global economic and financial developments" and in order to "support continued progress toward maximum employment and price stability."
Presidential candidate Bernie Sanders issued the following statement today after the Federal Reserve announced that it would hold off on raising interest rates:
“It is good news that the Federal Reserve did not raise interest rates today. At a time when real unemployment is over 10 percent, we need to do everything possible to create millions of good-paying jobs and raise the wages of the American people. It is now time for the Fed to act with the same sense of urgency to rebuild the disappearing middle class as it did to bail out Wall Street banks seven years ago.”
The New York Times reports that the Fed’s decision, "widely expected by investors, showed that officials still lacked confidence in the strength of the domestic economy even as the central bank has entered its eighth year of overwhelming efforts to stimulate growth."
Progressives cheered the news, with Josh Bivens of the Economic Policy Institute saying, "Today’s decision by the Federal Reserve to keep short-term rates unchanged is welcome. [...] We hope they continue their pragmatic, data-based approach and allow unemployment to keep moving lower, and only tighten after there is a significant and durable increase in inflation."
He continued: "Tightening before the economy has reached genuine full-employment is not just a mistake, it’s a regressive mistake that would hurt the most vulnerable workers—low-wage earners and workers from communities of color—the most."
However, Reuters reports that "the central bank maintained its bias toward a rate hike sometime this year, while lowering its long-term outlook for the economy."
Which means that pro-worker organizations, which have largely opposed a rate increase that they say would slow the economy and stifle wage growth, will have to keep up the fight.
"We applaud Chair Yellen and the Federal Reserve for resisting the pressure being put on them to intentionally slow down the economy," said Ady Barkan, campaign director for the Fed Up coalition, which rallied outside the Federal Reserve on Thursday.
"Weak wage growth proves that the labor market is still very far from full employment," Barkan continued. "And with inflation still below the Fed’s already low target, there is simply no reason to raise interest rates anytime soon. Across America, working families know that the economy still has not recovered. We hope that the Fed continues to look at the data and refrain from any rate hikes until we reach genuine full employment for all, particularly for the Black and Latino communities who are being left behind in this so-called recovery."

Progressives are cautioning the U.S. Federal Reserve against slowing the economy by raising interest rates "prematurely"—a decision the Fed will announce Thursday.
The U.S. central bank will issue its highly anticipated short-term interest rate decision following a two-day policy meeting, with a 2 pm news conference led by Fed Chair Janet Yellen.
As CBS Moneywatch notes, "[t]he decision affects everything from the returns people get on their bank deposits to how much consumers and employers pay for credit cards, mortgages, small business loans, and student debt." That's because a higher rate makes it more expensive for individuals and businesses to borrow, with rising bank lending rates shrinking the nation's money supply and pushing up rates for mortgages, credit cards, and other loans.
Just before the announcement, the advocates, economists, and workers of the Fed Up coalition will be joined by Rep. John Conyers (D-Mich.) at a rally outside the Fed, calling on the central bank to keep interest rates low to allow for more jobs and higher wages.
"The point of raising rates is to rein in an overheating economy that is threatening to push inflation outside the Fed’s comfort zone," explained Josh Bivens of the Economic Policy Institute in the Wall Street Journal on Wednesday. "But inflation has been running below the Fed’s target for years—and its recent moves have been down, not up."
Furthermore, wrote economist Joseph Stiglitz at the Guardian earlier this month: "If the Fed focuses excessively on inflation, it worsens inequality, which in turn worsens overall economic performance. Wages falter during recessions; if the Fed then raises interest rates every time there is a sign of wage growth, workers’ share will be ratcheted down—never recovering what was lost in the downturn."
Progressive activists opposed to an interest rate hike overwhelmed the Fed's public comment system on Monday in a last-minute effort to sway the central bank. Raising the rate, they said, would be catastrophic for working families, particularly in communities of color that are still struggling. The Fed Up campaign, which includes groups like the Center for Popular Democracy, Economic Policy Institute, and CREDO Action, say the central bank "privileges the voices and needs of corporate elites rather than those of America's working families."
"A higher interest rate means that fewer jobs will be created, and that the wages of workers at the bottom will remain too low to live on," wrote Rod Adams, a member of Neighborhoods Organizing for Change in Minneapolis, in an op-ed published Wednesdayat Common Dreams. "That’s because when the Fed raises rates, they are deliberately trying to slow down the economy. They’re saying that there are too many jobs and wages are too high. They’re saying that the economy is exactly where it should be, that people like me are exactly where we should be."
However, at this point, "many observers believe the Fed will not raise rates this week," analyst Richard Eskow wrote on Wednesday.
"The Fed is really the central bank of the world. If the Fed raise rates a little bit, it will have an impact all over the world, particularly in emerging markets," billionaire private equity professional David Rubenstein told CNBC's "Squawk Box" on Thursday.
"I think the Fed is sensitive to that," Rubenstein said, "and I think therefore the Fed is likely to wait for another month or two to get additional data and probably telegraph a little bit better than it has now that it's about ready to do it at a particular time."
Meanwhile, global markets are fluctuating wildly in anticipation of Yellen's announcement and subsequent news conference.
But as Eskow noted, Thursday's real surprise "is that there’s any question at all what [the Fed] will do. That suggests that our economic debate is not yet grounded in economic reality, at least as most Americans experience it."

The Wall Street Journal - November 14, 2014, by Pedro Nicolaci da Costa - Federal Reserve Chairwoman Janet Yellen met Friday with a coalition of community activists who are urging the central bank to resist pressures to raise interest rates before the labor market has fully recovered and calling for greater public input into the selection of regional Fed bank presidents.
At a press briefing outside the Fed before the meeting, organized by the Center for Popular Democracy and featuring workers, community organizers and liberal economists, the activists said the idea that the economy was close to full recovery was belied by the joblessness and underemployment of millions of Americans.
“We’re here to launch a national campaign for a stronger economy and for a reformed Federal Reserve,” said Ady Barkan, staff attorney at the center, a left-leaning national nonprofit organization. “The economy is not working for the vast majority of people,” he said, citing high unemployment, inequality and large racial disparities.
The Fed declined to comment on the meeting or the activists’ recommendations.
The Fed last month ended its bond-buying program aimed at supporting economic growth, citing “substantial improvement” in the outlook for the labor market. Those present at the briefing said the experience of many communities across the country suggests otherwise.
One of their biggest complaints was the inability of workers to find full-time work, a problem that has worried Fed officials and suggests the job market is still some way from full health.
“My job used to be steady, something you could count on,” said Jean Andre, 48, of New York, who works on logistics in the film industry. “I’m one of the names at the end of the movies that nobody reads. But I’m underemployed, I just can’t get full-time work anymore, not like I used to before the crash.”
With the unemployment rate 5.8% in October, Fed officials are debating when to begin raising interest rates from near zero. Many investors expect the central bank to start raising its benchmark short-term rate sometime in the summer of 2015.
Josh Bivens, an economist at the liberal Economic Policy Institute in Washington, noted that black unemployment is generally double the overall level. Black communities would be among those hit hardest by potentially premature Fed rate increases, he said.
The activist group also called for greater public input into the selection of the presidents of the Fed’s 12 regional banks. This comes ahead of the retirements next year of Dallas Fed President Richard Fisher and Philadelphia Fed President Charles Plosser. The two have been some of the most vocal opponents of aggressive Fed efforts to reduce unemployment—such as holding short-term rates near zero and buying bonds to lower long-term rates–arguing such policies risk fueling excessive inflation and asset bubbles while doing little good for the economy.
Fed presidents are selected by the boards of directors of the regional Feds, with the approval of the Washington-based Fed board of governors. The regional boards are composed of bankers, business executives and community representatives,
Kati Sipp, a director of the Pennsylvania Working Families Party who spoke at the briefing, said many of the regional bank board members designated as community representatives are not truly representative of the communities they are supposed to serve. “Right now in Philadelphia we have Comcast CMCSA +0.10% executives that are representing the public, and we think that it’s important for us that real people are also representing the public in Federal Reserve policy making.”
Michael Angelakis, vice chairman and CFO of Comcast Corp., is deputy director of the Philadelphia Fed’s Board.
“In Philadelphia we’ve had an 8% average unemployment rate for this year and it’s a 14.5% unemployment rate for the black community,” Ms. Sipp said. If Mr. Plosser believes the economy is back to full health, she said, then he hasn’t visited many of his own city’s troubled neighborhoods. “If he had, he would not believe that our economy has really recovered.”
Mr. Plosser has said he believes the job market is close to full employment and the economic recovery is genuine, if unremarkable.
The Philadelphia Fed announced Friday that Korn Ferry KFY -0.15%, the executive search firm hired to conduct the search for a new president, established an email address “to receive inquiries.” Asked if the move was in response to the protests, a spokesperson said it was “one part of our broad search process.”

But she plans to fly to Wyoming this week for one of the most elite economic conferences in the world. Her goal: schooling the central bankers gathered among the Grand Tetons in Jackson Hole about the hard realities of her own kitchen-table economics.
There’s $899 in monthly rent for the two-bedroom apartment she shares with her 5-year-old daughter, $83 to $90 for electricity, $40 for her cell phone. Meanwhile, Butler brings in less than $700 a month from her part-time job at McDonald’s. She doesn’t need a spreadsheet to know that the numbers don’t add up.
“I’m going to Wyoming to let these bankers in Jackson Hole know that we are not in recovery,” said Butler, 34. “I need them to understand. I need them to see where I’m coming from.”
The three-day meeting in Jackson Hole, sponsored by the Federal Reserve Bank of Kansas City, includes a keynote by Fed Chair Janet Yellen. In the past, notable speakers have included Columbia University economist Michael Woodford and Bank of India Gov. Raghuram Rajan. The atmosphere is decidedly academic, with strict rules governing the presentation and debate of research papers that can run 50 pages or longer -- not the typical setting for a populist uprising.
This year the conference is focused on the health of labor markets, a key consideration for the Fed as it weighs when to end its unprecedented support for the American economy. And activist groups have become increasingly worried that workers themselves are not included in the discussion.
The Center for Popular Democracy is slated to release a letter Tuesday signed by more than 60 left-leaning organizations, ranging from community groups to bigger players such as the Economic Policy Institute, Public Citizen and Demos. They are calling on the Fed to keep its easy-money policies in place until wages start to rise and what has been an exceptionally uneven recovery begins to broaden out. Butler, along with several other workers and activists, intend to trek through the mountains to deliver that message in person before the conference begins Thursday.
“We are writing to remind you that the American economy is not working,” the letter reads. “We hope that in the coming months and years, the Federal Reserve’s leaders will make a more concerted effort to listen to our voices.”
The Fed is an unusual target for this type of grassroots campaign, more typical in protests against big companies such as Wal-Mart or around issues like voting rights. Monetary policy can be an abstract concept, rife with jargon and inscrutable acronyms. Criticism of the Fed has typically come from economists debating its mathematical models, politicians bristling over the independent central bank’s powers or frustrated investors attempting to divine its intentions.
“Most people don’t really understand much about what the Fed does and certainly not why it does what it does,” said Allan Meltzer, a professor at Carnegie-Mellon University and Fed historian. “It’s rather remote from most people’s current experience and interests. It’s very hard to summon public outrage, whether it’s deserved or not.”
The Fed’s charge is to keep prices stable and encourage maximum employment. It operates by setting the interest rate at which banks lend to each other overnight. That rate, in turn, influences the cost of borrowing throughout the economy. Lower rates help stimulate consumer and business spending -- and with any luck, create jobs -- while higher rates help quell an overexuberent economy and rising prices.
The Fed slashed its target for interest rates to zero in 2008 to combat the financial crisis and has kept it there ever since. It has pumped trillions of dollars into the economy for an additional boost. But now, the unemployment rate is falling faster than many at the Fed expected. Job growth is reaching into higher-wage industries after years of being concentrated in low-paying sectors. For the first time since the recession, the central bank is seriously debating if the economy is ready to stand on its own.
That is enough to worry activist groups -- particularly since hope of federal legislation on issues such as the minimum wage, extending unemployment benefits and paid leave stand little chance of passing in a polarized Congress. The Fed is one of the only games left in town.
“Monetary policy is central to our economy and our society, and the discourse around monetary policy needs to be democraticized,” said Ady Barkan, senior attorney for the Center for Popular Democracy. “We can’t leave the debate about Fed policies up to academics and elite bankers and corporate executives.”
The unusually contentious battle last year over who would lead the Fed also help stoke interest in the institution, he said. President Obama had initially planned to nominate former Treasury Secretary and close adviser Lawrence H. Summers for the post. But Democrats balked at Summers’ role in deregulating the financial industry during the Clinton administration and his disparaging comments about women made when he was president of Harvard University.
The pressure from liberal groups helped ensure that Summers could not secure the votes to win confirmation in the Senate. He eventually withdrew his name, and Obama instead nominated Yellen, who was the second-in-command at the Fed.
Yellen may be particularly sympathetic to the activists’ arguments, at least relative to previous Fed chairmen. In a speech Chicago in March, she invoked individual stories of struggling workers to illustrate the human toll of high unemployment -- an unorthodox move in an institution more famousfor obfuscation. The next month, she met with representatives from the AFL-CIO, which did not sign the joint letter, and has repeatedly cited the high number of involuntary part-time workers and those who have given up looking for a job as reasons to be patient in withdrawing the Fed’s support. Yellen is slated to speak about the labor markets Friday in Jackson Hole.
"These and other indications that significant slack remains in labor markets are corroborated by the continued slow pace of growth in most measures of hourly compensation," she said in congressional testimony last month.
It is unclear how much grassroots opposition may influence Fed thinking -- particularly since it occurs so rarely. Meltzer said he could not recall activists ever gathering at Jackson Hole. The last public campaign mobilized against the Fed was in the 1980s, when then-Chairman Paul Volcker was hiking interest rates to stem double-digit inflation. Though he successfully brought prices under control, the economy went into recession as a result. Farmers and construction workers were particularly hard hit by the rate hikes, and they mailed blocks of wood to the Fed in protest and blocked its entrances with tractors.
The measures did little to sway Volcker, according to Stephen Axilrod, who worked at the Fed for three decades and was among Volcker’s key aides. His course had been set.
“None of that, in my head, had much to do with anything,” Axilrod said.
But he and other Fed watchers acknowledge that the central bank is in a new era. Public confidence in government and financial institutions is shaky at best. The Fed has made a concerted effort to increase transparency and connect with Main Street. At the same time, lawmakers have launched several efforts to curtail the Fed’s powers -- or even get rid of it altogether. Though such proposals stand little chance of passing, they can shift public perception of the central bank.
“Part of it is part of a reputational issue,” said Sarah Binder, a professor at George Washington University and senior fellow at the Brookings Institution. “The Fed’s credibility depends on people believing that they’re going to do what they say they’re going to do.”
And right now, the Fed’s next step is not all that clear. Prominent economists outside of the institution -- and several top officials within it -- are arguing that the Fed has goosed the economy to its limit. Some worry it could be even laying the groundwork for the next bubble: The major U.S. stock indexes have roughly doubled in value since the depths of the recession. The Dow Jones Industrial Average has hit 15 record highs this year alone.
But Butler still has a long way to go to before rebuilding her life after losing her job at the Golden Corral due to budget cuts a few years ago. At McDonald’s, she makes $9.50 an hour, and she pulls in extra money by baby-sitting or doing her friends’ hair. It’s still not enough to make ends meet.
“Things may be fine on Wall Street, but they are not fine on my street,” Butler said. “And if [central bankers] lived on my street, they would definitely change their mind.”
