Members of Congress involved in overseeing the country’s financial regulators agree that changes to the Federal Reserve’s governance model are overdue. But a Wednesday panel hearing revealed that lawmakers differ on what elements of the status quo need to be preserved.
Republicans on the House Financial Services Subcommittee on Monetary Policy and Trade argued that the Fed’s existing structure, which was enshrined in the 103-year-old Federal Reserve Act, is adequately representative when it comes to racial or gender makeup.
Wednesday’s hearing was the first chance Republican lawmakers had to discuss Fed reform proposals since both parties’ election platforms were adopted at their respective nominating conventions in July, when Democrats called for more diversity.
What the Fed needs instead, according to subcommittee chairman Bill Huizenga (R-Mich), is a new rules-based approach to monetary policymaking that’s outlined in the Financial CHOICE Act, the centerpiece of House GOP’s deregulatory agenda.
Those changes should not extend to major changes at the Fed that would, in effect, eliminate the representation of the banking industry on regional boards or take extraordinary measures to ensure greater diversity, as Democrats suggested in their 2016 election platform, Huizenga said.
He characterized Democratic proposals to overhaul the Fed’s governance structure as a “hostile takeover” of the central bank that’s only being undertaken to ensure high levels of inflation. “Democrats have constantly resisted reforms that would modernize the Federal Reserve, bringing much needed transparency to what most Americans consider an impossibly opaque institution,” Huizenga said.
He then referred to a bill he sponsors that would give Congress oversight responsibilities regarding monetary policy. “The Democrats on the other side of the aisle would like to double down on what Dodd-Frank started, co-opting the Federal Reserve district banks by subjecting them to the same politics that has kicked economic opportunity to the sidelines in the name of reinflating asset prices,” Huizenga said.
He had backup from Kansas City Fed President Esther George and Richmond Fed President Jeffrey Lacker, both of whom testified at today’s hearing and said the central bank’s current governance structure facilitates adequate regional, commercial, ethnic and gender diversity.
“I remain convinced this is a question of accountability, and not of structure, of the Federal Reserve,” George told the panel, referencing the Fed’s overall efforts to be a representative body.
Lacker said he agreed with George, and added that there are “multiple dimensions” officials look at when selecting a regional Fed board.
Regional Fed boards are divided into three alphabetically organized classes. Member banks of each regional Fed select Class A directors to represent the banking industry and Class B directors to serve the public or other commercial interests. The Fed’s Board of Governors selects Class C directors, who are appointed to represent the public interest.
Democrats had their position supported by William Spriggs, chief economist at the AFL-CIO, along with activists in the “Fed Up” coalition who attended the hearing wearing green t-shirts as a form of silent protest about the current Fed structure.
Spriggs and representatives from Fed Up argued that the lack of adequate racial representation on regional boards has prevented the bank from addressing higher rates of unemployment in African-American and Latino communities through monetary policy.
“We believe that when our voices our excluded from the conversation, then our interests are excluded,” said Ruben Lucio, a field organizer for the Fed Up Coalition, which is led by the left-leaning Center for Popular Democracy. Members of the coalition met with George during the Fed’s retreat in Jackson Hole, Wyo., last month.
Lucio indicated that the Fed’s method for determining full employment — part of its dual mandate, along with price stability — might be due for a reevaluation.
“Whose unemployment are they looking at? Are they looking at overall unemployment? Are they talking about black and brown unemployment?” Lucio asked. “When you raise those interest rates because certain communities have recovered, and it’s fine because you’re scared about some threat of inflation, who are you impacting when those interest rates go up?”
Some lawmakers questioned the lopsided nature of the Fed’s regional districts. Reps. Denny Heck of Washington and Bill Foster of Illinois, both members of the business-friendly New Democrat Coalition, were joined by Rep. Mia Love (R-Utah) in floating the possibility of taking a new look at the geographic makeup of the regional boards.
Despite members having stated such clear positions on the issue of Fed governance, the likelihood of movement on any statutory changes to Fed governance is slim at this point. Rep. Gwen Moore of Wisconsin, the ranking Democrat on the subcommittee, said she’s interested in taking an “objective” look at what changes might be needed, but she didn’t say what laws or regulations are needed to implement the changes sought by Democrats.
Huizenga, who reiterated to reporters afterward that he thinks the Fed’s regional directors should be selected as a “meritocracy,” struck a similar tone. “I don’t know that there’s any kind of consensus, as of yet, on that,” he said.

Homestretch: The fight to raise Colorado’s minimum wage
Voters at polling centers across Colorado will soon be deciding on Amendment 70, a measure that would alter the state constitution to increase the minimum wage from the current $8.31 per hour by yearly 90-cent increments to $12 in 2020. In 2020, it will be fixed at $12, except for yearly adjustments to account for inflation. Amendment 70 would further mandate that those inflation-tied adjustments only apply when they mean an increase in wages. In the past, when inflation was negative, minimum wage workers saw a pay cut.
Who’s behind it?
Supporters of the increase coalesced in mid-2016 into a group called Colorado Families for a Fair Wage, a coalition of unions, economic justice advocates and progressive policy analysts. Many of them had been part of an informal consortium of anti-poverty groups called The Everyone Economy that came together to strategize about raising the minimum wage back in February 2014. Partnering with Democratic legislators, they advocated for a pair of bills in the 2015 legislative session to help low-wage workers. One would have allowed municipalities to set their own minimums, and the other would have created a ballot measure to reach a $12.50 per hour minimum by 2020. Republicans killed both bills in the Senate.
Democrats floated another bill in 2016 to allow cities to set their own minimum wages, which met the same fate as its predecessors. After that, Everyone Economy members decided they had no recourse but to pursue a ballot measure themselves and formed Colorado Families for a Fair Wage.
Why $12 per hour and not $15?
The amendment’s proponents faced criticism for their decision to pursue $12 instead of $15 per hour in this week’s Westword cover story. According to the story, some former members of the coalition’s steering committee expressed deep dissatisfaction with its decision to pursue a $12 wage, arguing that, in doing so, the coalition shut out those whose voices were most pertinent to the effort — namely, dues-paying union members. They further take issue with the coalition’s failure to conduct focus groups composed of African-American working people, the demographic that would most benefit from a wage increase. CFFW spokesman Mike Kromrey now admits that was a mistake.
In its decision, the campaign relied on polling that showed that $12 per hour was more likely to pass. Campaign spokesman Timothy Markham dismissed any suggestion that the Westword story would affect the election outcome. “It might make for interesting gossip, but it doesn’t change the fundamental facts of the struggles Colorado workers are facing,” he said.
Interestingly, CFFW’s opponents on the right appropriated some of those far-left criticisms in the article and applied them to their own pitch. Keep Colorado Working, a conglomeration of chambers of commerce, industry groups and free-market business advocates that came together to oppose Amendment 70, sent a press release on Wednesday drawing attention to Westword’s report and castigating CFFW for deciding on their ballot language based on “polling, not policy impacts.”
The release does not mention the fact that those reports came from former CFFW members who wanted the minimum wage increase to be greater, not smaller, as Keep Colorado Working does.
How much firepower is against it?
Keep Colorado Working had a slower start raising funds, but has now raised $1.7 million. It has spent just under $1.4 million as of the most recent campaign finance filings, primarily on television advertising and consultants. About half of its funds ($650,000) come from the Alexandria, Virginia-based Workforce Fairness Institute. It has also gotten $525,000 from Colorado Citizens Protecting Our Constitution, a committee that has donated hefty sums to pro-fracking campaigns and to a 2013 effort to recall legislators who had passed gun-control legislation.
For its part, CCFW has outraised its rivals almost 3 to 1, raising about $5.3 million in donations, much of which is from out-of-state groups like its largest donor, the Center for Popular Democracy, which has kicked in over $1 million. Its second-largest donor is the Palo Alto-based Fairness Project, which has contributed over $960,000 to CFFW and is also supporting minimum wage ballot measures in Maine, Arizona and Washington, D.C.
Keep Colorado Working wants to make sure you know that some of CFFW’s donors are not from Colorado. Virtually all of its communications use the terms “wealthy out of state special interests” liberally.
According to the most recent campaign finance filings, CFFW has spent $4.6 million on television and digital advertising, outreach efforts like canvassing and hosting events, mailers, polling and research.
Keep Colorado Working did not respond to requests for comment in time for this story’s deadline.
Will it pass?
Early polls indicate that it will.
An August Magellan Strategies poll of 500 likely Colorado voters showed that 55 percent of respondents supported the measure, 42 percent were opposed and three percent were undecided. A September joint project between Colorado Mesa University, Rocky Mountain PBS and Franklin & Marshall College showed that 58 percent of respondents favored Amendment 70, with 36 percent opposed and seven percent undecided.
CFFW is also conducting its own internal polls and told The Independent that it is consistently getting positive results. Colorado politics expert Eric Sondermann also predicted that it will narrowly pass in a comprehensive ballot prediction for Westword.
CFFW’s case was buoyed in the fall months, starting with the release of a University of Denver study that tied Amendment 70 to a $400 million increase in state GDP. The logic is straightforward: when low-wage workers get a raise, they are very likely to spend it in their local economies, rather than filing it away. Not long after, Governor Hickenlooper endorsed the amendment, tethering worker pay raises to a boost for the overall economy.
Keep Colorado Working countered with another study, commissioned by the Common Sense Policy Roundtable, which concludes that the increase would lead to a decline in income and massive layoffs. But critics say that CSPR’s ties to groups like EIS Solutions, a PR outfit with several oil and gas clients, and Americans for Prosperity, the oil and gas giant Koch brothers’ political arm, undermine the study’s integrity.
Proponents are feeling optimistic as they buckle down for the the pre-election weekend. Andy Jacob, political director for SEIU Local 105, which is CFFW member, said that the group will spend the weekend making phone calls, knocking on doors, communicating with members and “doing everything we can to get this passed.”
If it passes, will it really be a game-changer for workers?
Whether Amendment 70 passes or fails, the work is just beginning for Colorado labor unions and low-wage worker advocates. Most CFFW members acknowledge that $12 per hour is not in fact a living wage for workers with families in some parts of Colorado. Most estimates put a living wage for a single parent of two children in Denver at around $30 per hour. But advocates also believe that the current $8.31 per hour is inexcusable, and any more than $12 is not politically viable.
There’s a sense of immediacy among CFFW members. One hears the term “right now” a lot. They would rather take a safe bet than a real gamble when so many people’s livelihoods hang in the balance.
“Do we go with something that we know is going to be tough but that we know we can win on, or do we go with 15, which the Denver area might be ready for but the state isn’t, and we lose?” SEIU’s Jacob asked.
He works with low-wage union members every day and he believes he’s doing right by them. “‘12 by 2020’ will impact half a million people in Colorado,” Jacob said. “Don’t tell those people this isn’t going to help them. It is.”

WASHINGTON (MarketWatch) — The U.S. central bank remains a bastion of white privilege and Fed Chairwoman Janet Yellen should promptly take steps to “remedy” the issue, 115 Congressional Democrats said Thursday.
In a letter to Yellen, the House and Senate Democrats urged her to “fulfill its statutory and moral obligation to ensure that is leadership reflects the composition of our diverse nation” and include representatives outside of the banking industry. Bernie Sanders, the independent senator from Vermont and a presidential candidate, also signed the letter.
The letter noted that Congress in 1977 passed a law mandating more diversity at the Fed.
“Nearly 40 years later, the leadership across the Federal Reserve system remains overwhelmingly and disproportionately white and male, while major financial institutions and corporations are overrepresented in senior roles,” the letter said.
Leading Democrats including Sen. Elizabeth Warren of Massachusetts and Rep. John Conyers of Michigan signed the letter. Rep. Maxine Waters, the ranking member on the House Financial Services panel, was also a signatory.
At the moment, 11 of the 12 Fed regional presidents are white and ten are men.The five members of the Fed board of governors are all white, while two are women.
“Is the Fed Board of Governors embarks on its search for regional president vacancies, we urge you to engage in an inclusive process to consider candidates from a diverse set of background, including a greater number of African-Americans, Latinos, Asian Pacific Americans, women and individuals from labor, consumer, and community organizations,” the letter said.
In response, a Fed spokesperson said the central bank has “focused considerable attention in recent years” on recruiting directors of regional Fed banks with diverse backgrounds and experiences.
As a result, minority representation at the 12 district banks and their branches has increased to 24% this year from 16% in 2010, the spokesperson said.

The controversial federal program that clouded the HUD secretary's VP prospects gets a timely overhaul.
Julian Castro’s Housing and Urban Development Department announced significant changes Thursday to a federal program that sold delinquent mortgages to private investors — a move that mollified progressive critics who threatened to undermine his vice presidential prospects.
With three weeks remaining until the Democratic convention and Hillary Clinton’s campaign narrowing down its list of potential ticket mates, the U.S. housing agency said it is changing a controversial program to give delinquent homeowners a new chance to reduce the principal they owe on their mortgage. The changes also prohibit financial firms from giving up on trying to sell or recuperate decrepit properties the businesses would rather walk away from.
As HUD secretary since 2014, Castro had been under attack from by at least 11 Latino and populist groups for his oversight of the department’s “distressed asset stabilization program,” which sold struggling homeowners’ mortgages to hedge funds. Castro, they alleged, failed to deliver on a HUD promise to sell more mortgages to non-profit community groups instead of financial firms.
Started in 2012, the program’s two stated objectives are to help struggling residents while also clearing billions of dollars of bad debt off the agency’s books. But liberals have argued the program undermines homeowner protections, especially for people in low-income neighborhoods, as HUD sold mortgages to the same financial firms that exploited borrowers in the lead-up to the 2008-2009 recession.
The changes came not long after Castro surfaced on Clinton's short list of vice presidential candidates — along with Sens. Tim Kaine and Elizabeth Warren — leading to immediate speculation about the HUD secretary’s political motivations.
Warren was among those calling for major reforms to the program.
“Given that Secretary Castro has only spent a brief time on the national stage, the black mark caused by the distressed asset issue stands out prominently on his record,” said Isaac Boltansky, director of policy research for Compass Point Research & Trading in Washington. He covers housing policy.
“There is no question that the left’s attack of this program generally — and Secretary Castro specifically — lowered the odds of him being tapped,” he said.
As severely-delinquent mortgages accumulated after the recession, the Federal Housing Administration, a division of HUD, needed to reduce debt liabilities to the government.
Under the program, delinquent loans held by banks but insured by the FHA are sold to new buyers, including hedge funds, private-equity firms and non-profit community groups. Through May 2016, HUD sold more than 105,000 FHA-insured loans valued at $17 billion, according to a report by the National Consumer Law Center.
Castro has not said much publicly about the program, which in recent weeks erupted into a politically-charged issue for the Obama administration, said sources with familiar with the situation.
The program was supposed to give struggling homeowners another chance to avoid foreclosure. But researchers following the program said that financial companies have used it to circumvent homeowner safeguards.
“If you have an option of selling your loan through [the] DASP, then you don’t have to go through state foreclosure procedures that have the consumer protections in them and actually help enforce FHA rules,” said Geoff Walsh, author of NCLC’s report. He previously worked as an attorney with Vermont Legal Aid, Inc. and specialized in housing, consumer and bankruptcy areas. “A lot of damage has been done,” he said.
The liberal groups held Castro responsible for the program’s flaws, even though it started before his tenure at HUD. But the groups immediately applauded HUD’s new changes to the program that they had advocated for.
Their website attacking Castro was still live on Friday, though it will be updated to reflect HUD’s changes, said Matt Nelson, managing director of Presente.org, which claims to be the largest U.S. online Latino organizing group.
Housing experts acknowledged that pressure from advocacy groups — which used the issue to question Castro’s progressive credentials — played a role in the revisions.
“But for his potential to be vice president, these changes probably don’t get made,” said Edward Gorman, head of community development for the National Community Reinvestment Coalition, whose members include nonprofits that buy DASP loans.
“It was the specific targeting of the secretary on this issue and the gathering of liberal senators in support that caused the [Obama] administration and the secretary particularly to take another look at this issue,” he said. “This will be fodder for Republicans. This will become a political issue.”
For Castro, it had already metastasized into an issue that clouded his vice presidential prospects. Widely regarded as one of the Democratic Party’s rising Latino stars, the former San Antonio mayor was targeted by a coalition of activist groups that recognized the leverage afforded to them by a presidential primary fight colored by questions about Clinton’s ties to Wall Street and Bernie Sanders’ populist, anti-Wall Street rhetoric.
“HUD has continually enhanced the DASP program by making improvements before every sale since 2014,” an agency spokeswoman said in a statement. “As a result, tens of thousands of families have been able to remain in their home or avoid foreclosure through the program.”
Maurice Weeks, a housing staffer at the Center for Popular Democracy, one of the groups supporting the attack on Castro’s handling of the DASP, said he is grateful to see the changes HUD announced. But his group will want to make sure the changes actually result in better conditions for communities.
“It became a political problem for Castro since he’s the head of that department,” Weeks said. “We didn’t set out to determine if Castro was a good VP candidate or not. Our focus was on homeowners across the country.”

NEW YORK CITY — Wal-Mart’s wage hike to a minimum $10 per hour kicks in tomorrow, February 20, but the higher wages fall well short of a living wage. Last year, Wal-Mart earned more than $16 billion in net income and announced plans to spend $10.3 billion on a stock buyback to increase value for wealthy shareholders. Center for Popular Democracy, a national pro-worker coalition, estimates that paying $15 an hour to its 1.2 million full-time employees would cost the company an extra $3.4 billion per year, a third of what it will spend under its share repurchase plan.
The Center for Popular Democracy has fought for a higher minimum wage for Wal-Mart workers along with the United Food and Commercial Workers Union (UFCW), Our Walmart, and a worker-led movement.
JoEllen Chernow, Director of CPD’s Minimum Wage campaign, released the following statement:
“Wal-Mart has announced pay raises in an attempt to reform its image as an employer that doesn’t pay workers enough to take care of their families. But it’s not raising them enough – and, the truth is, Wal-Mart can afford higher wages.
The company has a $10 billion stock buyback program and earned more than $16 billion in net income last year. That will put an additional $5.6 billion directly into the pockets of the Walton family - a family that already controls more wealth than the bottom 42 percent of Americans combined. As the company’s fortunes continue to rise, they must let their workers share more of their success. Wal-Mart workers simply deserve better.”

New York immigrate Family Unity Project (NYIFUP) is an initiative that emerged from seven years of research and interviews with immigration lawyers and defenders of the rights of immigrants. They gave their opinions that the lack of a competent legal representation for many New York immigrants, unfamiliar with the law, do not have money for lawyers and having problems with the language, is unnecessary deportations, which lead to the separation of families and are an unnecessary financial ballast to the government.
Last summer, the New York city council has allocated 500 000 dollars. to fund a pilot program, whose task was to test the reasonableness of the initiative. The draft law school joined them. Benjamin N. Cardozo, and several organizations fighting for immigrant rights, and so created a program of assistance to 190 immigrants.
"It is a matter of justice - says Peter L. Markowitz, a professor at Cardozo Law School. - This is an opportunity to initiate changes in the way immigrants are treated in our country."
In the future, originator NYIFUP plan to organize legal assistance for all poor immigrants awaiting deportation in immigration detention: in New York, Batavia, NY, Newark and Elizabeth, New Jersey. Annually, these centers gets about 2,450 immigrants.
The full annual cost of the program is estimated at 7.4 million dollars. His supporters argue that reducing the time that immigrants spend in detention centers, and limit the number of deportations will bring savings of 5.9 million per year.

Opiniowali oni, że brak kompetentnej reprezentacji prawnej dla wielu nowojorskich imigrantów, nieznających prawa, nieposiadających pieniędzy na prawników i mających problemy z językiem, oznacza niepotrzebne deportacje, które doprowadzają do rozłąki rodzin i są niepotrzebnym balastem finansowym dla rządu.
Ubiegłego lata nowojorska rada miasta przeznaczyła 500 000 dol. na sfinansowanie pilotażowego programu, którego zadaniem było przetestowanie sensowności inicjatywy. Do projektu włączyła się szkoła prawnicza im. Benjamina N. Cardozo oraz kilka organizacji walczących o prawa imigrantów i tak powstał program pomocy dla 190 imigrantów.

W przyszłości pomysłodawcy NYIFUP planują zorganizować pomoc prawną dla wszystkich niezamożnych imigrantów oczekujących na deportację w więzieniach imigracyjnych: w mieście Nowy Jork, Batavia, NY, Newarku i Elizabeth w New Jersey. Rocznie do tych ośrodków trafia około 2450 imigrantów.
Pełny roczny koszt tego programu szacowany jest na 7,4 miliona dolarów. Jego zwolennicy argumentują, że skrócenie czasu, jaki imigranci spędzają w ośrodkach zatrzymań, oraz ograniczenie liczby deportacji przyniesie oszczędności w wysokości 5,9 miliona rocznie.
