The St. Louis resident is neither an economist nor a central banker. He's a 57-year-old unemployed worker, who said he is trained in the green technology field and can't find a job.
He was among a group of activists who gathered on the sidelines of the Fed's annual symposium wearing green t-shirts with "What Recovery?" on the front and a chart depicting sluggish U.S. wage growth on the back.
"From the world where I reside, there is no recovery. We need a boost. We need a jump start," said Rounds. "The key is jobs creation."
The ten activists, most of whom were unemployed and seeking jobs, were sent as emissaries for a coalition of advocacy groups that has launched an unusual campaign from the left to press the U.S. central bank to keep monetary policy easy.
The coalition, consisting of more than 70 organizations, released an open letter to Fed officials earlier this week urging them to hold off on interest rate hikes until wages were rising more swiftly.
While small in number, the activists managed to get a great deal of face time with senior officials. On Thursday, they spoke with the host of the conference, Kansas City Federal Reserve Bank President Esther George, for two hours.
On Friday, Fed Vice Chairman Stanley Fischer stepped out of the conference to spend ten minutes to listen to their plight.

In April, the New York attorney general’s office launched an investigation into the scheduling practices of 13 national retail chains, distributing a letter to the Gap, Target, J.C. Penney, and 10 other companies. The letter asked, among other things, whether these companies’ store managers use software manufactured by a company called Kronos to algorithmically generate schedules.
A few months later, Kronos was also featured prominently in an article published by the New York Times about the ill effects of erratic scheduling on Starbucks employees, especially one particular family. In a follow-up piece, the author, Jodi Kantor, points directly to Kronos’ scheduling software as the root of the problem. “I saw that her life was coming apart and that the Starbucks software had contributed to the crisis,” Kantor wrote of one of the story’s subjects.
The piece’s argument centered around the financial and scheduling unpredictability engendered by platforms like Kronos. When you don’t know if your shift might be canceled, if or when you’ll be called in, or what your hours will look like next week or the week after, it becomes very difficult to make even the most basic plans for your future. This can have devastating long-term financial and emotional impacts on workers. According to a recent study by the Economic Policy Institute, a left-leaning think tank in Washington, D.C., 17 percent of the American workforce is negatively affected by unstable schedules.
For their part, Kronos representatives argue that the algorithm is far from the root of the problem. “The populist view is that scheduling is evil, in that it’s causing erratic schedules for employees, and so forth,” Charlie DeWitt, vice president of business development for Kronos, told BuzzFeed News. “The fact of the matter is it’s an algorithm. It does whatever you want it to do.”
And you don’t necessarily need to work for Kronos to believe that in a competitive retail climate, the problem is more complicated than technology alone. Lonnie Golden, a Penn State economist who has extensively studied the impact of erratic scheduling, acknowledges that Kronos’ product itself is less to blame than the managers who make staffing decisions based on the data it provides. “It’s not necessarily the technology that’s responsible for minimum to no advance notice,” he said. “It’s the way in which it’s applied.”
But, he added, “where there’s a technology problem, there’s usually a technology solution.” And while Kronos maintains that managers, and not the software, are responsible for early dismissals and last-minute shift cancellations, the company is nonetheless pursuing some technological solutions.
Kronos wants to help managers better understand how scheduling adjustments affect workers and, ultimately, the bottom line. Though the company maintains that its software doesn’t produce the kind of erratic schedules that hurt wage workers, DeWitt said there was nonetheless an interest in figuring out why that perception existed — and, if possible, fixing it.
To that end, earlier this month at a retail conference in Philadelphia, the company announced that it’s working on a new plug-in that will give managers better insight into workers’ schedule stability, equity of hours worked among employees, and the consistency of schedules from week to week. In addition, Kronos is improving a feature meant to help give employees more control over their schedules: Though the software already incorporates employee availability and preferences into its scheduling calculations, improvements to a shift-swapping feature on its employee-facing web and mobile apps will theoretically allow employees to work around conflicts among themselves.
Golden said increased employee input and control would be a good thing. But some retailers, DeWitt pointed out, are uncomfortable making workers use an app outside of work hours; indeed, the practice could be seen as a shift of management responsibilities onto lower-paid individuals.
Part of the idea behind the new Kronos plug-in is to help companies tie fairer scheduling practices to reduction in absenteeism and turnover, which can be enormously costly. In other words, if Kronos can help executives see the connection between treating workers fairly and a store’s ability to increase revenue, DeWitt said, managers will have an impetus to create more predictable, stable schedules.
And just because companies are looking at this kind of data doesn’t mean they have to use it. “Companies like Kronos and Workplace Systems are starting to integrate some of these principles into their software,” said Carrie Gleason, director of the Fair Workweek Initiative at the Center for Popular Democracy, “but it’s all optional, so companies can decide not to do it.” While 12 states are currently considering legislation that would create new labor standards around the workweek, Gleason said the technology alone lacks a mechanism for enforcement.
Given market pressures and standard management practices, it’s unlikely that any change to Kronos’ technology would give workers more power — especially because, given the competitive retail climate at the moment, the bottom line tends to be the priority. “It’s not just bad managers. They have extreme pressure to increase productivity on an ever-shrinking labor budget,” Gleason said.
With these changes, Kronos has taken logical steps toward both repairing its reputation and making sure its software creates sustainable work environments. But while the company cannot control exactly how the algorithm that forecasts schedules and optimizes workforces is deployed inside different workplaces, the Kronos engineers who designed the product are nonetheless the partial architects of work environments that have been proven to be untenable for low-wage workers. The Kronos scheduling algorithm isn’t designed to serve those people; it’s designed to be sold to their bosses, and as such, will ultimately be shaped to serve the needs of management — until regulations exist that compel them to change how it’s used.

NBC News - June 25, 2014, by Kat Aaron and Seth Freed Wessler - Leroy Samuels walked into the Varick Street immigration court in lower Manhattan, his wrists handcuffed and attached to a chain around his waist. “My heart is beating,” Samuels’ older sister Anneisha said from a courtroom bench as her father beside her, his head in his hands to hide tears. Samuels, dressed in an orange jumpsuit, nodded at his family and lowered his eyes.
Three days earlier, the 24-year-old had been in a New Jersey detention center preparing to appear at his first hearing alone. Immigrants facing deportation, like Samuels, aren’t eligible for court-appointed attorneys. And like most immigrants in his position, he couldn’t afford one on his own
“I found some lawyers online, but they asked for $4,000,” Anneisha said. “I just hung up.”
Without legal defense, Samuels was sure he’d be deported to Jamaica, the country where he was born but has not been for nearly 15 years since his father brought him to the U.S.
But Samuels arrived in court that December morning with an attorney anyway. He is one of 190 people facing deportation from New York City who have been provided a free lawyer through the Family Unity Program, a city council-funded pilot initiative that provides for two public defenders’ offices to hire lawyers to represent poor immigrants in detention. It's the first program of its kind in the country. Now city lawmakers are poised to expand it almost ten-fold, making New York City the first municipality to provide legal defense to all detained indigent residents facing deportation.
“Justice shouldn't depend on the income level of anyone,” says Judge Robert Katzmann, Chief Judge of the U.S. Court of Appeals for the Second Circuit, who convened a multi-year study group from which the pilot emerged. “I think that the project will create momentum for greater support for providing counsel for people facing deportation.”
A number of other cities, including Boston and Chicago, are exploring similar programs. And this year, Alameda County, California, which includes the cities of Oakland, Fremont and Berkeley, started a program that approaches New York’s.
“This is part of a trend,” says Raha Jorjani, the immigration attorney hired by Alameda County. “Public defenders are saying that until Congress acts to provide legal defense for immigrants in deportation proceedings, we at the county level have to do our part to mitigate harm to clients.
In recent years, more immigrants have found themselves in court as the U.S. government has deported and detained nearly 400,000 each year. Though not all people facing deportation are detained, those who get locked up, either because they were previously charged with a crime or entered the country without papers, are less likely to have an attorney to represent them and more likely to be deported. The two biggest factors in successfully resolving a case are having a lawyer and being free during the trial, according to a report by Katzmann’s group.
Preliminary data on the New York City pilot, which comes to a close on June 30th, shows that of 190 detainees, almost half have been released or have a legal case to argue for release. Some may still be deported but can now fight from outside prison.
Providing these immigrants with legal defense, Katzmann says, creates both fairness and efficiency, saving county and federal governments money they’d otherwise spend locking people up. “It's a benefit to the judge, it’s a benefit to the government and to the non-citizen. It's really an example of how the government process can be made better.”
For Samuels, the road to immigration court started with legal trouble in 2010. He’d been without a place to stay and was sleeping on a friend’s couch. The friend, Samuels says, asked him to hold onto a package of drugs. Samuels says police officers arrived at the apartment and arrested him. He pleaded guilty and was convicted of criminal possession of a controlled substance and sentenced to time-served, six days in jail.
Samuels and his family say he quickly straightened his life. He found a steady job at a pharmacy, stopped hanging with friends who sold drugs and made sure to see his son, who lived with his ex-girlfriend, at least twice a week. A year passed and then two. He thought the criminal case was behind him.
Then at around 8:30 one morning last December, as he walked home to his Brooklyn apartment after working the night shift, he was stopped on the street and arrested by federal immigration agents. He was placed in detention in New Jersey, facing deportation. Immigration attorneys say it’s not uncommon for officials to detain immigrants long after an arrest.
“I never really thought about being deported,” Samuels said this winter from behind glass in the visitation room at the Hudson County, New Jersey, detention center. “I had a good job. I had visits with my son. I was on my way,” Samuels said. He’d hoped to enroll in culinary school, but from detention, he saw his plans evaporating. And his live-in girlfriend was pregnant and due in May. “What if I’m not there?” he said.
“The first time that I visited my brother at Hudson,” Anneisha Samuels says, “I didn’t know what to do. It’s not like when people are arrested, regular arrested, and they get a lawyer.”
Anneisha had recently lost her job as a home health aide. Their father was between jobs, too.
The next day, Anneisha received a call from Talia Peleg of Brooklyn Defenders Services, one of three attorneys from her office working on the immigrant defense pilot program. (The Bronx Defenders office employs three others.) Peleg bore good news: She would represent Leroy in court free of charge.
“An attorney knows how to talk the talk and walk the walk,” Peleg explained recently. “And to translate these complex immigration issues into a narrative that makes sense to the court,” without a lawyer, “I don’t know if that would be possible.”
The program attorneys say their representation by no means guarantees that their clients will stay in the U.S. For people with many criminal convictions, there’s no viable legal argument to stay. Many of these people are subject to what's known as mandatory detention. For them, fighting to remain in America can mean months or even years in detention while their case winds through the system. Some opt to leave.
Diego Garcia, originally from Guerrero, Mexico, picked up several misdemeanor and disorderly conduct charges in New York. He was fired from a catering job and was drinking heavily.
Eventually, those arrests led to deportation proceedings. He landed in the Hudson County detention center, and then at the Varick Street Immigration Court, where he, too, met Peleg. He was so eager to get out of prison that he told her he just wanted to be deported, but she encouraged him to sit through a 35-minute intake questionnaire to see what his options might be.
It turned out Garcia was eligible for a U visa, a special visa for victims of crime–in his case, witness tampering. The catering company he’d worked for had paid him and others far less than minimum wage, according to the Department of Labor. Garcia’s lawyers say his employer then pressured him to lie to federal investigators who were at the time looking into workplace violations.
Garcia was thrilled to hear there was a possible path to staying in America.
Peleg explained that the visa—if it came through—would take months, and he'd have to stay at Hudson while they fought. Rather than wait in jail, Garcia accepted the removal order, and went back to Mexico. “I wanted to be free,” he said recently by phone from Mexico City, “and fight from there.”
“It's very hard to be incarcerated, waiting,” Garcia said “When you're there, you feel confused, fearful.”
Peleg and Garcia are in regular contact as she pursues his U visa. And he has some money to help him get through the wait. When Peleg contacted the Department of Labor, which had repeatedly fined the catering company, officials said they had more than $3,000 in back wages for Garcia.
According to New York City Councilwoman Julissa Ferreras, who represents several heavily immigrant communities in Queens, before the pilot project, she heard from families who spent thousands of dollars on immigration lawyers. “Often times it was money that these families didn't have,” she said. But no one was beating down her door demanding publicly-funded lawyers, she said. “My constituency didn't even know that that's what they needed to cry out for.”
Now, that’s changed. The families she talks to are getting help from attorneys whose sole focus is on immigration defense. “We're raising the level of justice,” Ferreras said.
The final draft of the budget, released by the city council Tuesday night, allocates $4.9 million to expand the program. Now, all poor New Yorkers facing deportation, both at Varick Street and nearby immigration courts in New Jersey, will be appointed an attorney.
Ultimately, the goal of the project’s advocates is to provide counsel for all migrants facing deportation in New York State, which would cost $7.4 million, said Peter Markowitz, who runs the immigration legal clinic at Cardozo School of Law, which has helped lead advocacy for the pilot program.
That price tag would be offset by savings for the state, which would spend less on health care and foster care for children whose parents are deported, according to a study by the Center for Popular Democracy, another group supporting the program. The private sector would benefit, too; New York State employers now lose an estimated $9.1 million dollars in turnover costs to replace detained and deported workers, the study found.
Nationally, it would cost just over $200 million to give a lawyer to every indigent immigrant facing deportation, according to one recent study. The federal government would save close to $175 million in detention costs, the study found.
In April, Leroy Samuels appeared in in the Varick Street court again. He walked through the doors in cuffs, and his sister and father sat in the same spot. His attorney had already made a deal with the federal government’s lawyer: Samuels would be granted release. After a short hearing, the judge warned Leroy not to get into any more trouble, and then told the now-25-year old that he could leave. In the courthouse cafeteria Samuels embraced his father and sister and thanked his attorneys.
Samuels’ return has been difficult. He says that he hasn’t been able to get his job back—his former boss told him the company isn’t hiring.
But weeks ago, his girlfriend gave birth to their son. The day he was released, Samuels said, “I feel like I got a fresh start because of these lawyers.”

New York City Mayor DeBlasio and several advocate groups gathered recently to show support for the introduction of “Fair Workweek” legislation, designed to ensure that 65,000 hourly employees in the fast food industry receive fair notification on work hours.
Currently, employers nationwide aren’t required to provide their hourly employees with advance notice of upcoming shifts. As a result, too many families can't budget in advance, plan for education or family care, or secure a necessary second job, according to advocates.
The New York City event echoes the demands of coalition of New York-based advocates who launched a national campaign on Sept. 6. The groups — the Center for Popular Democracy, the Rockefeller Foundation and the online organization Purpose — are asking for scheduling at least two weeks in advance, eliminating on-call assignments that leave employees "scrambling for child care and unable to hold second jobs with uncertain paychecks."
Dive Insight:
Employers do realize that predictability and fairness are reasonable demands, but more often than not, labor cost (and in some cases, labor shortage) creates problems when trying to create better schedules. Frontline managers are expected to create the schedules while also trying to keep costs down, and balancing the two expectations isn't always successful.
What it will take is better workforce planning, with some technology solutions already available to help make that happen, say experts. Also, there are potential negative legal and compliance outcomes for employers who don't follow state and local laws that already require "reporting pay" time be allowed.

Some organizations say Minnesota is experiencing a crisis level of inequality with wages and jobs.
Black unemployment is four times higher than whites in the state.
“It’s a report that shows, I think, what we already knew,” Neighborhoods Organizing for Change’s Anthony Newby said.
He says he did not need a report to know the challenges faced by many in his community.
“If you look right outside the door here on Broadway Avenue, you’ll see a total lack of industry. We’ve got low-wage jobs, low-wage opportunities,” Newby said. “We’re a mile and a half or so from downtown Minneapolis, which is considered one of the economic hubs, certainly of the Midwest.”
The report spells out how the economy is bouncing back, but not for African Americans — especially those who live in Minnesota.
Since 2000, wages have decreased by 44 cents an hour for African Americans. This statistic does not ring true for whites or Latinos.
“We’re told that Minnesota is one of the best places in the country to live if you want a job, and that’s true if you’re a white person. Unemployment is 2.8 percent. If you’re black, its 10.9 percent,” Newby said.
Kentha Parker says she is more than a statistic.
“I’ve been looking for work since 2011, since the tornado,” Parker said.
She’s a mother who is struggling to find work to take care of her family. She says she’s tired of hearing these words: “We’re not hiring at this time, we’ll keep your application on file."
“The Federal Reserve, which has a branch right here in Minneapolis, could do a lot to actually influence the general economy,” Newby said.
He believes the Federal Reserve has the power to keep interest rates low, which in turn could boost wages and help reduce income inequality.
Newby says Neighborhoods Organizing for Change will push to be a part of the conversation.
He wants to see people of color at the table when the Federal Reserve produces its policies.

NY1 - A forum was held Wednesday at the CUNY Murphy Institute on a new report by United New York and the Center for Popular Democracy that recommends increasing the city's minimum wage to $10 an hour.
It also calls for earned sick leave, schedule predictability, and passing legislation that allows the city to adjust its own minimum wage above that of the state.
The report focused mostly on service industry jobs.
"This is a moment in New York City where we can finally demand that this be a city that stands up for low-wage workers and doesn't shy away from that role," said Deborah Axt of Make the Road New York.
"If we are to maintain our progressive reputation as the bright shining star, then New York City really needs to claim a lot of the recommendations that came out of this forum here today," said City Councilwoman Letitia James, whose district covers part of Brooklyn.
The report said that the city's unemployment rate rose from 5 to 10 percent since 2007, while its homeless population has doubled since 1992.
It also found that real median income is down $3,000 since 2008.

The president of the Federal Reserve Bank of Minneapolis met with activists and northside residents Wednesday over racial and economic disparities.
Neel Kashkari talked with leaders from Neighborhoods Organizing for Change for an hour — an unusual meeting of a banking insider and a group known for street demonstrations and putting political pressure on the powers that be.
"A big part of my job is to get out and understand first hand what is happening, what are the challenges," said Kashkari who has served on the central bank system since January.
In that time, the former head of the federal government's bank bailout program in 2008 has drawn attention for his warning that failure of some big banks could lead to another financial crisis.
Kashkari said that the Fed's monetary policy can have an effect on unemployment, interest rates and inflation, but he said Congress' fiscal policy will also be key in addressing racial disparities.
Anthony Newby, executive director of Neighborhoods Organizing for Change, said they talked about the high unemployment rate among African-Americans.
"Now we can spend more time collaborating, doing a deeper dive and figure out what are the structural barriers and then what can the Fed do to bridge that gap," Newby said. "That's a big deal and big starting point."
Newby added he was pleased to have someone in Kashkari's position listening to real people struggling to make ends meet.
Kashkari agreed to meet with them again.
