The Times-Picayune - 05-08-2015 - Louisiana understaffs its charter schools oversight offices and, instead of proactively investigating these schools, relies on charters' own reports and whistleblowers to uncover problems, according to a report released Tuesday (May 12) by the Center for Popular Democracy and the Coalition for Community Schools. That allows theft, cheating and mismanagement to happen, such as the $26,000 stolen from Lake Area New Tech High and the years of special education violations alleged at Lagniappe Academies.
The report also casts a skeptical eye on the veracity of the data that Louisiana uses to calculate the performance scores that keep charters open and determine their renewal terms. And it faults the state for closing struggling charters instead of intervening to improve them.
The Center for Popular Democracy's partners include the American Federation of Teachers, which has an uneasy relationship with charters, and the Annenberg Institute for School Reform, which studies charter school oversight. Kyle Serrette, the center's director of educational justice campaigns, said its parent members had children in charter and conventional public schools.
That said, one of the report's recommendations is to "impose a moratorium on new charter schools until the state oversight system is adequately reformed."
The Louisiana-based Coalition for Community Schools opposes charter schools outright and filed a civil rights complaint against the state Education Department in 2014. That complaint also included a demand to freeze chartering in New Orleans.
The two groups' report said Louisiana charters could suffer from "tens of millions of fraud in the 2013-14 school year alone," based on the methodology of the Association of Certified Fraud Examiners. In that time, employees of three New Orleans charter schools stole about $110,000, and two charter operators were accused of meddling with retirement payments.

"The state has invested heavily in increasing the number of charter schools while failing to create a solid regulatory framework that truly protects students, families and taxpayers," the authors write. Furthermore, "oversight agencies play almost no role in helping charter schools improve academic outcomes. ... The state has no system in place to provide a path to high-quality academics for all struggling charter schools."
Charter schools are publicly funded but run by independent non-profit boards. They control their own curriculum and hiring but must meet academic and operational standards to stay open. The state Education Department oversees most of Louisiana's 130-plus charters; local school systems oversee the rest.

However, as of December, the Education Department's charter audit team consisted of only three people, according to a critical December report from the Louisiana legislative auditor's office. Education Superintendent John White defended his team at the time, saying they reviewed charter schools' audits, among other activities.
Tuesday's paper says that isn't enough. Not only do charters hire their own accountants to conduct annual audits, but the audits are not designed to prevent or detect fraud. Indeed, reports typically contain a disclaimer saying they are not expressing an opinion on fraud controls. The legislative auditor's office might dig deeper but rarely does so, the report states.
"The only audits Louisiana charter schools routinely undergo are the ones they pay for themselves," the authors write.
The report faults the Education Department for not spending enough time on-site at charters. Charters receive regular visits and reviews from state inspectors, and Louisiana Recovery School District officials said their own findings of wrongdoing at Lagniappe Academies in New Orleans showed that their oversight procedures worked.
The authors of Tuesday's report disagreed. The state's 2013-14 review of Lagniappe Academies gave full points for special education, the two organizations said, and it was only later that state inspectors uncovered extensive reports of violations during that time period.
"The situation at Lagniappe shows exactly the problems with the state's oversight structure for charter schools," the report says. "The state relies on a largely self-reporting oversight structure that is easily manipulated by the schools themselves."
The authors doubt the accuracy of the test scores that are used to measure charters' academic performance, writing that the data "is vulnerable to manipulation."
Finally, the authors disagree with the state's readiness to close charters, including Lagniappe.
"Clearly there are times when problems are significant enough that a school must be closed. Yet, the current intervention (process) is designed to make school closure a normal and common part of the state's accountability system," the authors write. "The system needs to be updated to produce more stability for Louisiana children." In six years, more than 1,700 New Orleans students have seen their charter schools close, according to the report.
Louisiana's laws are "designed to set a high standard but not to help," Serrette said.
The state does at times intervene instead of closing schools, although this is not mentioned in the report. The Recovery School District has chosen successful charter operators to take over failing schools, for example, and White directed Lycée Français to find a new chief executive and assigned it a consultant team. Lycée has gone on to make a B grade, and its charter contract has been extended.
The report's recommendations include:
Require fraud audits every three years, to be conducted by the state legislative auditor's office
Train charter staff and boards on preventing fraud
Hire more staff for the legislative auditor's office and charter school oversight teams
Require "mandatory, hands-on, long-term, strategic support" for charters in trouble
Go beyond test scores when calculating school letter grades
Create local committees, including neighbors and parents, to design schools that serve the needs of a community
Coordinate social services at and around schools
Release raw testing data to the public.
Some of these issues are not unique to charters. Louisiana's conventional public schools also face pressure to keep test scores high: If they don't, they may be taken over by the state. There have been numerous examples of corruption and fraud in school boards and systems. Serrette said it was likely Louisiana's regular school systems needed stronger oversight as well.

It is always amusing to be the subject of a John McClaughry jeremiad. While I don’t mind being labeled as the “foremost defender” of public education, he insists on giving me full personal credit for what is a state school board position.
In the instant case, John appears to be affronted by the suggestion that private (independent) schools that take public money must actually be held accountable for that money. This principle is at the core of the state board’s review of the independent school rules. Now this seems like a straightforward and fundamentally democratic concept that is generally accepted, but it has been a long-standing problem for some.
The law (16 VSA 166) provides a list of reporting requirements for independent schools if they want to chow down at the public trough. Unfortunately, as far back as the 1914 Carnegie Commission, we find evidence of the refusal of some independent schools to provide private school data even though it was the law of the land. (At that time, the Cubs were still basking in the glory of their World Series victory.)
The second paramount principle is that we have to educate all the children — regardless of needs and handicaps. That’s a necessity in a democracy. Denying a child admission on the basis of a handicap is, in most cases, illegal. Furthermore, it’s wrong. Public schools serve every child. The false fear John peddles is that the private school can’t afford to serve these children. That’s incorrect. It’s really quite simple. While great eruptions of umbrage are displayed, this problem has been solved for years. The private school contracts with (or hires) a specialist who bills the costs back to the public school. Approval in a given area requires that one sheet of paper be filed with the state. As simple as the solution actually is, some independent schools refuse to adopt an equal opportunity policy.
Instead, John proposes that Vermont “clone” Florida’s McKay Scholarship program where parents can choose the school for their handicapped child. That hasn’t worked out too well. If you think a “business management class” that sends students onto the street to panhandle is an acceptable education, then the McKay program may be just your thing. The Florida Department of Education has uncovered “substantial fraud,” including schools that don’t exist, non-existent students, and classes held in condemned buildings and public parks. And the state of Florida does not have the staff to adequately monitor the program. This is a recipe for abuse. Last May, the Center for Popular Democracy estimated that $216 million in charter school money went out the back door.
Finally, John raises the cost question and says private school scholarships would be “less expensive.” Yet he also criticizes the cost of the state’s excess public school capacity. Now let’s look at Vermont’s private independent school numbers. In 1998, there were 68 independent schools, and by 2016, the number had exploded to 93. In the decade 2004-14, independent school enrollments went down from 4,361 to 3,392. A 37 percent increase in schools with a 29 percent drop in students suggests somebody needs to revisit their business plan.
Taking it all together, (1) all who profit from the public treasury must be accountable for that money, (2) children have the right to be admitted to private schools, free of discrimination, on an equal opportunity basis, (3) private schools are a part of our system, (4) the public purse must be protected from fraud and abuse, and (5) directly or indirectly building and operating a parallel school system would be inordinately expensive and wasteful. Do these principles sound reasonable?

Democrats rallied at Legislative Hall on Tuesday in favor of legislation that would allow Delawareans to register to vote on the same day as a primary or general election.
"We should so everything we can to make sure eligible others have every opportunity to exercise their constitutional right to vote," said Rep. John Viola, D-Newark, the legislation's sponsor.
Democrats and activists supporting the bill dismissed concerns that same-day registration could lead to voter fraud.
"There's nothing there," Viola said, adding that he feels "confident" the bill will pass the House in the "next couple weeks."
The bill was voted out of committee in May, and would still need to go to the Senate for committee and floor votes if it passes the House. Delaware's current registration deadline is the fourth Saturday prior to an election.
Rep. John Kowalko, a Newark Democrat, told supporters gathered outside Legislative Hall on Tuesday that "you deserve the right to vote" and said the measure only reinforces the constitutional rights of Delawareans. Rep. Paul Baumbach, D-Newark, called the legislation "as American as it gets."
Representatives from several left-leaning advocacy groups attended the rally in support of the legislation on Tuesday, including the Delaware Alliance for Community Advancement and American for Democratic Action.
Same-day registration is already law in 11 states and the District of Columbia, according to the National Conference of State Legislatures.
Mike Begatto, executive director of the American Federation of State County and Municipal Employees, the public employees union, also spoke in favor of the bill on Tuesday. Sen. Margaret Rose Henry, a Wilmington Democrat, is sponsoring the measure in the Senate.

Lawmakers should strip banks’ influence from the Federal Reserve’s leadership, make its regional banks publicly owned corporations and increase transparency in selecting its top leaders, according to a report released Monday by the Fed Up Coalition, a campaign led by the left-leaning Center for Popular Democracy.
The 17-page report — co-authored by Fed Up Coalition Campaign Manager Jordan Haedtler, economist Valerie Wilson of the Economic Policy Institute and Dartmouth College economist Andrew Levin — is a more detailed version of a Fed overhaul framework proposed in April by Levin, a former Fed staffer, and urges members of Congress to make the central bank a “fully public institution” and scrub the influence of banks from its top echelons.
The report also proposes establishing annual audits of the Fed by the Government Accountability Office, reworking the selection process of Fed regional presidents and directors, returning capital shares to commercial banks invested in the regional Fed branches and opening the 12 regional banks to the Freedom of Information Act.
“We have really strived to make a proposal that we see as sensible and pragmatic and nonpartisan,” Levin said Monday in a conference call with reporters. “Over the years, both progressives and conservatives have felt strongly that big banks should not have an undue influence in the governance and the decision-making process of the Federal Reserve, and making the Fed fully public is an important way to do that.”
The proposal differs from previous “audit the Fed” measures, such as Sen. Rand Paul (R-Ky.)’s legislation that failed to garner the 60 votes needed to advance during a procedural vote in January, because it would prevent “political interference” in the central bank by establishing an annual schedule for GAO audits and giving the reviews a comprehensive focus rather than allowing members of Congress or congressional committees to single out monetary policy decisions, Levin said.
The report calls for greater diversity at the Fed’s top levels — both in terms of increasing racial and ethnic diversity and limiting the influence of financial sector power-brokers. It also said policymakers should be limited to a single seven-year term. Currently, the Fed chair is appointed to a four-yeart term that can be renewed. Members of the central bank’s Board of Governors are appointed to staggered 14-year terms, but their tenures average about four years. Regional Fed presidents have renewable five-year terms, and they typically hold office for at least two decades, according to today’s report.
The authors said that refunding shares to commercial banks with stakes in the regional Fed branches would save taxpayers about $3 billion over the next 10 years.
Members of the Fed Up Coalition are scheduled to meet later this week with Fed officials, including Federal Reserve Bank of Kansas City President Esther George, at the central bank’s annual policy symposium in Jackson Hole, Wyo. The meeting with George won’t center on today’s report, but instead will focus on “presenting stories of communities that still have not recovered from the Great Recession,” Haedtler said.

More than two dozen activists demonstrated outside the Fed and then met with Chair Janet Yellen on Friday as part of a new campaign seeking policy reforms and a commitment to keep interest rates low until good jobs are plentiful for all workers. Although the labor market has steadily strengthened this year, wages have remained stagnant.
During the hour-long discussion with Yellen and three other Fed board members, coalition representatives discussed problems their communities were facing with high unemployment and weak wage growth.
Ady Barkan, one of the organizers of "Fed Up: The National Campaign for a Strong Economy," said Yellen and the other Fed officials listened but made no commitments about future Fed policy.
"It was a very good conversation," said Barkan, an attorney with the Center for Popular Democracy in Brooklyn. "They listened very intently, and they asked meaningful follow-up questions."
Fed officials confirmed that the meeting took place but declined to comment on the issues raised at the meeting.
The Fed's outreach to community activists was the latest move by Yellen to focus attention on lingering problems from the Great Recession. Wearing green tee-shirts with the phrase "What Recovery?" the group had protested outside of the Fed's headquarters on Constitution Avenue under the watchful eye of nine Fed security officers.
Members of the group, some of whom had demonstrated at a central bank gathering in August in Jackson Hole, Wyoming said it was important that Fed officials not be swayed by arguments that it needs to move quickly to raise interest rates to make sure inflation does not become a threat.
"The banks are the ones that crashed the economy ... but they're the ones who got the bonuses and the bailouts while workers and homeowners like me were left to drown," said Jean Andre, 48, of New York, who said he was having a tough time finding full-time work.
In addition to Yellen, the Fed officials who took part in the meeting were Fed Vice Chairman Stanley Fischer and Fed board members Jerome Powell and Lael Brainard.
Members of the coalition said about half of the meeting was taken up by their members telling stories about the difficulty in finding jobs, particularly in disadvantaged groups and communities dealing with unemployment much higher than the 5.8 percent national average.
The Fed officials also were presented a petition signed by 5,000 people around the country urging the central bank to keep interest rates low until the country reaches full employment.
The group also pushed for a more open process in the selection of presidents of the Fed's 12 regional banks. They say the current process is too secretive and dominated by officials from banks and other businesses with little input from the public. The regional presidents, along with Fed board members in Washington, participate in the deliberations to set interest rates.

Los obreros de construcción hispanos e inmigrantes sufren muchos másaccidentes y muertes por caídas que otros trabajadores del mismo gremio, debido a las pobres condiciones de seguridad en las que trabajan en el estado de Nueva York, según reveló un estudio.
El reporte, comisionado por el Center for Popular Democracy, muestra que en el 60% de las muertes por caídas en los accidentes, investigados entre 2003 y 2011 en el estado, el fallecido era latino y/o inmigrante.
En la ciudad, esta cifra se incrementa hasta casi el 75% – tres de cada cuatro – a pesar de que sólo supone el 40% de la fuerza total de trabajo en ese reglón.
Encuestas realizadas a empleados latinos evidenciaron que muy pocos se atreven a quejarse por las condiciones de seguridad por temor a represalias de sus jefes.
Problemas de seguridad
Ese fue el caso de Pedro Corchado, un obrero que cayó desde una escalera durante la renovación de un edificio hace cinco años, y sufrió graves heridas por no contar con un arnés de seguridad.
“Casi cualquiera que trabaje en construcción te dirá que es muy difícil negarse a las órdenes de escalar un andamio que no es seguro o subir una escalera sin equipamiento de seguridad”, dijo Corchado. “Para la mayoría de trabajadores como yo, decir ‘no’ al jefe simplemente no es una opción”.
El grupo que elaboró el estudio y otras organizaciones que defienden a estos trabajadores, argumentaron que la mejor manera de detener esta tendencia es aumentar los fondos deOSHA, porque ahora mismo la oficina no cuenta con los suficientes medios ni inspectores.
Calcularon que, para que OSHA inspeccione cada lugar de construcción que hay actualmente en Nueva York, les llevaría 107 años.
Por otro lado, hicieron un llamado para que se proteja la llamada “Ley del Andamio”, que ayuda a asegurar las condiciones de seguridad en los sitios de construcción y que varios promotores inmobiliarios presionan para que se derogue porque incrementa significativamente el coste de nuevos edificios.
“En lugar de invertir en la seguridad en el trabajo, la comunidad de negocios quiere que la responsabilidad por heridas y muertes pase a los que son más vulnerables y no tienen control sobre las condiciones laborales”, denunció Joel Shufro, director ejecutivo delComité para Seguridad y Salud en el Trabajo de Nueva York. “Pondría a todos los obreros de construcción en riesgo, particularmente a los jornaleros y a los no sindicados”.
Una última petición es que se tomen medidas para asegurar que tanto los promotores, dueños y trabajadores de la construcción, reciban entrenamiento de seguridad de acuerdo con los estándares de OSHA.
