When former President Bill Clinton recently meandered onto the topic of charter schools, he mentioned something about an “original bargain” that charters were, according to the reporter for The Huffington Post, “supposed to do a better job of educating students.”
A writer at Salon called the remark “stunning” because it brought to light the fact that the overwhelming majority of charter schools do no better than traditional public schools. Yet… charter schools are rarely shuttered for low academic performance….
In a real “bargaining process,” those who bear the consequences of the deal have some say-so on the terms, the deal-makers have to represent themselves honestly (or the deal is off and the negotiating ends), and there are measures in place to ensure everyone involved is held accountable after the deal has been struck.
But that’s not what’s happening in the great charter industry rollout transpiring across the country. Rather than a negotiation over terms, charters are being imposed on communities – either by legislative fiat or well-engineered public policy campaigns. Many charter school operators keep their practices hidden or have been found to be blatantly corrupt. And no one seems to be doing anything to ensure real accountability for these rapidly expanding school operations.
But in May, BillMoyers.com looked at a report issued by Integrity in Education and the Center for Popular Democracy — two groups that oppose school privatization. The study examined charter schools’ performance in 15 states, and revealed $136 million in fraud, waste and abuse in those states. The authors of that study wrote that, “where there is little oversight, and lots of public dollars available, there are incentives for ethically challenged charter operators to charge for services that were never provided.”
Last week, they released a follow-up study of charter schools in Pennsylvania. It found that “charter school officials have defrauded at least $30 million intended for Pennsylvania school children since 1997.”
Yet every year virtually all of the state’s charter schools are found to be financially sound. While the state has complex, multi-layered systems of oversight of the charter system, this history of financial fraud makes it clear that these systems are not effectively detecting or preventing fraud. Indeed, the vast majority of fraud was uncovered by whistleblowers and media exposés, not by the state’s oversight agencies.
The authors found that while the auditing techniques used by Pennsylvania regulators could identify inefficiencies, oversight agencies don’t use tools “specifically designed to uncover fraud.” It also found that oversight agencies were understaffed and underfunded. “With too few qualified people on staff, and too little training, agencies are unable to uncover clues that might lead to fuller investigations and the discovery of fraud,” write the report’s authors.
They also noted that their findings weren’t unique:
Numerous government entities have raised the flag about the risk of fraud nationally and in Pennsylvania. Reporting in 2010 on the lack of charter-school oversight in states throughout the country, the Office of the Inspector General for the U.S. Department of Education raised concerns that state-level education departments were failing “to provide adequate oversight needed to ensure that Federal funds [were] properly used and accounted for.” Also in 2010 in Philadelphia (which educates 50 percent of all Pennsylvania charter-school students), the Office of the Controller performed a “fraud vulnerability assessment” of the city’s oversight of charter schools and reported that the Charter School Office… made the city’s more than $290 million paid to charter schools “extremely vulnerable to fraud, waste, and abuse.” A 2014 follow-up report found that the School District of Philadelphia continues to provide “minimal oversight over charter schools except during the charter renewal process.”

A coalition called the Committee for Better Banks, which includes unions and community groups, is planning protests Monday outside big-bank offices in Minneapolis and St. Paul, Minn. The organizers are marrying long-standing complaints about the impact of bank practices in low-income neighborhoods and the large salaries of top executives with newer gripes about the banks' treatment of their own tellers and sales representatives. The central message is that the country's biggest banks should be paying higher wages, offering better benefits, and eliminating aggressive sales goals that can create stress for lower-pay employees. "While the financial industry has recovered in a big way since the crash — it's really come back strong — frontline workers have not experienced that," said Aditi Sen, a research analyst at the Center for Popular Democracy, an advocacy organization that released a report Thursday in connection with the upcoming protests.
In May 2014, the annual mean wage for tellers at depository institutions was $26,720, or $12.84 per hour, according to the Bureau of Labor Statistics.
It's not clear whether the upcoming protests will include a substantial number of bank employees. Erin Mahoney, a spokeswoman for the coalition, said in an email that "thousands of bank workers have been engaging with us" using petitions and other methods.

Aiming to foster the rights of immigrants and to keep their families together, two legal services organizations, the Bronx Defenders and Brooklyn Defender Services, have been picked for a unique pilot project to represent indigent detainees facing deportation.
The two organizations will form the New York Immigrant Defenders, which will take on 166 cases in the next year at the Varick Street Immigration Court.
The program will be funded by a $500,000 grant made available by the New York City Council in June.
Robin Steinberg, executive director of the Bronx Defenders, said that her organization created an in-house immigration practice more than a decade ago when it realized that nearly one-third of its clients were facing adverse immigration consequences from even minor brushes with the law.
“The Bronx Defenders joining forces with the Brooklyn Defender Services to create NYID is a natural and necessary step in ensuring that all residents of New York City—no matter where they were born—have their day in court with lawyers who will fight for their right to stay here, with their families and in the communities they now call home,” she said in a statement.
Lisa Schreibersdorf, executive director of Brooklyn Legal Services, agreed that working with immigrants was “very much in line with our mission.”
Schreibersdorf said that she had told her daughter after the group’s selection Thursday that the new program was part of the most groundbreaking public defense development of her generation—the extension of the right to counsel to immigrants.
“This is a groundbreaking program. There is no program of this sort anywhere else in the country. It’s a program that aligns American values with the reality on the ground when it comes to immigrants and due progress,” said Angela Fernandez, executive director of the Northern Manhattan Coalition for Immigrant Rights, one of the groups that advocated for creation of the program.
According to Brittny Saunders, senior staff attorney for the Center for Popular Democracy, another leading advocate for the effort, potential clients will be screened only for economic need, with anyone making under 200 percent of the poverty limit making the cut.
The poverty limit currently is $11,400 for a single person and $23,550 for a family of four.
Other factors, such as the strength of immigrant cases, will not be considered.
Oren Root of the Vera Institute of Justice, a nonprofit and nonpartisan center for justice issues, said the program will stress the importance of keeping families together. In many cases, the detainee has lived in the country for years, is the family’s principal wage earner, serves as the caretaker for family members and has children born and raised in the United States.
The one-year pilot project will be administered by Vera, which will coordinate the delivery of legal services and analyze the data that emerges from the effort.
Root said that Vera is “thrilled” to be working with “such high-caliber, innovative organizations as Brooklyn Defender Services and the Bronx Defenders.”
Providing support for the effort to represent immigrant families has been the Kathryn O. Greenberg Immigration Justice Center at the Benjamin N. Cardozo School of Law.

Schreibersdorf said studies show that detainees with a lawyer are “more likely to identify valid immigration remedies.”
She cited one case of a 17-year-old on a minor offense handled by her agency. His attorney dug into the defendant’s family background and discovered that his parents had been naturalized, and thus he was a citizen himself.
“Without a lawyer, that kid would have been deported,” she said.

Freno a la epidemia de robo de salarios fue la consigna que gritaron sin cesar unas 30 empleadas domésticas y jornaleros frente a la Corte de Brooklyn. La acción, liderada por el Proyecto de Justicia Laboral (WJP), sirvió para exponer a un contratista inescrupuloso como parte de “una maquinaria que exprime a las familias trabajadoras”.
Los defensores denunciaron que la creación de’ empresas fantasma’ es una estrategia que los empleadores para esquivar a las autoridades y seguir en el negocio pese a tener casos abiertos en las cortes de la ciudad.
Samuel Just, propietario de Just Cleaning, fue arrestado el verano pasado por la Fiscalía de Brooklyn luego de que el WJP documentara varios casos de robo de salario. Pese a la presión de las autoridades y de los grupos defensores de los jornaleros, el empresario se niega a pagar a las víctimas, la mayoría mujeres latinas.
“El robo de salario es un crimen. No hay otra manera de calificarlo”, sentenció Ligia Guallpa, directora ejecutiva del WJP.
Otras organizaciones se unieron a la protesta para denunciar que el robo de salario afecta radicalmente a las comunidades inmigrantes. Gonzalo Mercado, director ejecutivo de Staten Island Community Job Center, explicó que los contratistas están creando empresas fantasmas para evadir a las autoridades y las pesquisas de los activistas.
“Hemos visto a empleadores circulando por las paradas de jornaleros con camionetas sin logotipos. Su estrategia es evitar ser identificados”, sentenció. “Muchos trabajadores no saben quién los contrata, lo que hace más difícil la recuperación de los salarios”.
El mexicano Oscar Lezama (36) contó que una compañía de Staten Island, que se dedica a la instalación de cocinas, se negó a pagarle unos mil dólares por horas extra.

La organización Staten Island Community Job Center ayudó a Lezama a recuperar su salario mediante negociaciones directas con el propietario, pero Mercado dijo que identificar a la compañía implicó una investigación exhaustiva.

La protesta frente a la Corte de Brooklyn fue la quinta acción colectiva convocada por WJP para exponer al propietario de Just Cleaning, pero también para crear conciencia acerca de que el robo de salario es un problema, que se agudizó en los últimos años, según defensores.

The ground this week is not East of Eden, where Cain slew Abel; it is St. Paul, Minnesota, where Philando Castile was gunned down while reaching for his ID. It is Baton Rouge, Louisiana, where Alton Sterling was shot at point-blank range, already immobilized and pinned down by police.
And while you, reader, are not Cain — after all, you did not pull the trigger — neither can any of us object, as he did, “Am I my brother’s keeper?!” We are our brothers’ and sisters’ keepers, as Americans, as mostly-white and mostly-privileged Jews, as participants in a society where so many tragedies become travesties of racial injustice.
But what can we do? What can I do?
First, we must, communally, recognize that this is a real crisis and make it a subject of dinner conversations, rabbinic sermons and communal action. Because in fact, the problem isn’t just the cops; it’s us.
Thanks to the proliferation of recording technologies, the crisis of police violence is now more visible than ever before; Castile was killed live on Facebook. Indeed, as best as we can tell, the rates of violence haven’t risen much; we’re just seeing the evidence of it more.
Yet even in the face of gruesome videos, there is still a great deal of denial among white Americans that the deaths of Eric Garner, Laquan McDonald, Mike Brown, Sandra Bland, Rekia Boyd and now Castile and Sterling, are, in fact, a crisis of police violence against people of color. After all, none of the officers were found guilty in a court of law; they had reasons to believe they were in danger; these things happen.
But these things don’t just happen. Yes, most police officers are diligently doing their jobs and keeping us all safe. Painting with a broad brush is not only inaccurate, but leads to tragedies such as the shooting deaths of three police officers at a Dallas protest this week. At the same time, the statistics paint a convincing, terrible picture.
Over 1,000 people are killed by police every year, nearly 60% of whom were either unarmed or should never have been stopped in the first place. Compare that number to other countries. Germany had 6, Britain, 2; Japan, 0. What the hell is wrong with us, as a country?
One problem is how we police. “Quality of life” policing is a gigantic dragnet, ostensibly based on the “broken windows” theory that even petty crime leads to a deterioration of law and order in general. In practice, however, it creates confrontations where none need to exist. And then “these things happen.”
I’ll give you an example that isn’t in the news, and isn’t based on race. Just last week, an acquaintance of mine was relaxing on a beach when his towel slipped off. He wasn’t wearing anything underneath. This was a minor infraction of the law — but my friend was suddenly jumped by five police officers (two in civilian clothes), pinned to the ground and dragged, naked, off the beach while he pleaded for help.
That entire confrontation should never have taken place. At most, he should have been given a citation; really, he should have just been warned. But, presumably because that particular beach is popular with LGBTQ people and with people of color, someone, somewhere, decided that a crackdown was necessary. Thank God my friend didn’t resist arrest; he, too, could have been a statistic.
Now multiply that encounter by ten thousand, maybe a hundred thousand. Even without “stop and frisk,” our nation’s approach to policing creates dangerous situations. Violence becomes inevitable.
“Broken windows” must end. “For-profit policing,” in which cops are given quotas for minor offenses in order to generate revenue and evaluate police performance, must end. Profiling must end. Escalation of minor incidents must end. The philosophy must change.
Another problem is how police are trained and reviewed. In many places, cops are not adequately trained to balance protecting safety (their own and others’) with defusing conflict. They respond, routinely, with overwhelming and often deadly force to situations that could be resolved without it. They are often scared kids, put into stressful situations with inadequate mental resources.
The rules of engagement must be changed at the training level and the legal level. States and cities should adopt international standards for the use of deadly force — both as cops are trained and as their actions are reviewed. Standards of review should be changed.
And of course, cameras should be placed on every cop in America — with strict rules that civilians’ faces be obscured before any recording is released to the public. This should help the vast majority of cops, since recordings help explain and defend appropriate conduct as much as they reveal misconduct. And in addition to holding bad cops accountable, body cameras could help prevent misconduct from happening in the first place.
Yet of the 509 fatal shootings by police that have taken place this year, body cameras were worn in only 64 of them. Who knows how many of the remaining 445 lives might have been saved, or what we would have known about the circumstances of their deaths?
Another problem is weaponization. The last two decades have witnessed a massive militarization of civilian police forces. Town sheriffs are buying tanks, military-grade weaponry — it’s outrageous and dangerous and unwarranted. Arm cops to the teeth, and they will use the tools they’re given.
And then, of course, there’s race.
Of those 509 people fatally shot by police so far this year, 202 were black or Hispanic. Young black men were killed at five times the rate of similarly-aged white men. Even taking into account higher crime rates in communities of color, this has been shown by exhaustive, detailed studies to be disproportionate. According to once such study, correcting for all these and other factors, the probability of being black, unarmed and shot by police is 3.49 times the probability of being white, unarmed and shot by police.
That’s why we need #blacklivesmatter and not #alllivesmatter: because when it comes to police violence, black lives clearly matter less.
Part of this is demographics: White men are less than one third of the U.S. population, but they are two thirds of police officers. Most of them are not overtly racist. But unconscious bias affects all of us, no matter how well-meaning we are. That’s what white privilege is: precisely that which is often invisible.
And when it comes to cops, we’re talking about life and death. This, too, must change, through recruiting, training and changes in the way our entire society talks about race.
Finally, while I doubt those Forward readers intending to vote for a candidate espousing white supremacy will ever be persuaded by evidence, it’s worth bearing in mind the yawning gap between the presidential candidates, and political parties, on this issue. Hillary Clinton has proposed creating national use-of-force guidelines, ending all forms of racial profiling, and improving training in conflict de-escalation.
Donald Trump has proposed nothing, but has said “We have to give strength and power back to the police.”
And in this regard, most other Republicans are right on board with him, usually refusing to acknowledge that a crisis is taking place or that is has anything to do with race. This, of course, reflects the racialized preferences of their white, conservative base. (The racism Trump’s candidacy has ignited didn’t come from nowhere.) It is also reprehensible.
As on so many other issues — climate change, gun regulation, the wealth gap — the Republican Party is on the wrong side of justice. If Trump is elected, more innocent black people will die. It is that simple. And those #StillBernie lefties still spreading calumnies about Clinton in the name of this or that pet issue should reflect on that.
Now, I didn’t come up with a single solution in this column. They and others are listed, and described in detail, on the websites of Campaign Zero, the Center for Popular Democracy and the Presidential Task Force on 21st Century Policing: ending “broken windows,” limiting use of force, demilitarization, body cameras, oversight, et cetera.
And yet, each time something like this happens, we white people ask ourselves “What can be done?” often throwing up our hands in despair. When in fact, a lot can be done. The problem is that around half the population doesn’t want to do it.
So, ironically, we need to make this crisis worse. Police violence against people of color requires local involvement, pushing for city- and county-level reforms. That gives Jewish communities, and other organized groups, unique leverage to make change — if we care enough to do so. Unfortunately, too many of our fellow privileged Jews aren’t “woke” to the crisis or the ways to address it. While God may hear the cries of our brothers’ blood, we are often deaf to them.

Gap Inc. is the latest retailer to end its practice of requiring workers to remain on-call for short-notice shifts following an inquiry from New York’s attorney general.
A spokeswoman for the San Francisco-based retailer says the decision also applies to Gap’s other brands, including Banana Republic, Old Navy and Athleta and was part of an effort to “improve scheduling stability and flexibility” for workers.
Spokeswoman Laura Wilkinson says the change will apply “across our global organization” and that the company is working to establish scheduling systems giving store employees at least 10 to 14 days’ notice.
Attorney General Eric Schneiderman’s office sent letters to Gap and 12 other retailers earlier this year questioning them about on-call scheduling, which required hourly workers to stay on-call for shifts set the night before or the same day, giving them little time to arrange for child care or work other jobs.
“Workers deserve stable and reliable work schedules, and I commend Gap for taking an important step to make their employees’ schedules fairer and more predictable,” said Schneiderman, a Democrat.
Abercrombie & Fitch and Victoria’s Secret also ended the practice this summer.
Carrie Gleason, director of the Fair Workweek Initiative at the Center for Popular Democracy, said in a statement that Gap’s decision reflects not only Schneiderman’s concerns but also a new ordinance in San Francisco requiring chain retailers to set schedules in advance. Similar proposals are pending before other city governments.
“Working people in hourly jobs are starting to speak out about the impact that employers’ scheduling practices has on their lives,” Gleason said in a statement.

WASHINGTON (MarketWatch) — The U.S. central bank remains a bastion of white privilege and Fed Chairwoman Janet Yellen should promptly take steps to “remedy” the issue, 115 Congressional Democrats said Thursday.
In a letter to Yellen, the House and Senate Democrats urged her to “fulfill its statutory and moral obligation to ensure that is leadership reflects the composition of our diverse nation” and include representatives outside of the banking industry. Bernie Sanders, the independent senator from Vermont and a presidential candidate, also signed the letter.
The letter noted that Congress in 1977 passed a law mandating more diversity at the Fed.
“Nearly 40 years later, the leadership across the Federal Reserve system remains overwhelmingly and disproportionately white and male, while major financial institutions and corporations are overrepresented in senior roles,” the letter said.
Leading Democrats including Sen. Elizabeth Warren of Massachusetts and Rep. John Conyers of Michigan signed the letter. Rep. Maxine Waters, the ranking member on the House Financial Services panel, was also a signatory.
At the moment, 11 of the 12 Fed regional presidents are white and ten are men.The five members of the Fed board of governors are all white, while two are women.
“Is the Fed Board of Governors embarks on its search for regional president vacancies, we urge you to engage in an inclusive process to consider candidates from a diverse set of background, including a greater number of African-Americans, Latinos, Asian Pacific Americans, women and individuals from labor, consumer, and community organizations,” the letter said.
In response, a Fed spokesperson said the central bank has “focused considerable attention in recent years” on recruiting directors of regional Fed banks with diverse backgrounds and experiences.
As a result, minority representation at the 12 district banks and their branches has increased to 24% this year from 16% in 2010, the spokesperson said.
