New Yorkers need policies that would help them balance work and family responsibilities, according to a report released today by New York City Comptroller Scott M. Stringer, in partnership with A Better Balance.
The report, “Families and Flexibility: Building the 21st Century Workplace,” is based on a survey of more than 1,100 New Yorkers working in a broad range of industries and provides a follow up to Comptroller Stringer’s report, “Families and Flexibility,” from June 2014. The online survey, while not scientific, asked workers in all five boroughs about: · The availability of flexible work arrangements; · How comfortable they are requesting flexible schedules; · The need for paid family leave; and · For “shift workers,” the predictability of their work schedules. “No New Yorker should ever have to choose between keeping their job and caring for their family,” said Comptroller Stringer. “With policies like FlexTime, paid family leave, and advanced notification of schedules, we can give workers the tools they need to address their personal and professional responsibilities.” Flexible work arrangements, which allow employees to work outside the traditional 9-to-5 schedule and from locations other than their offices, are one of the most effective ways to help individuals establish a work-life balance. Flexible work arrangements also help businesses boost their bottom line by improving morale and minimizing turnover. But, nearly half of workers surveyed do not have access to flexible work arrangements. Just as troubling, respondents who had requested flexible work arrangements in the past reported that they had experienced missed promotions, negative reviews, and belittling comments. Among respondents without office-wide policies on flexible scheduling: 59% were “uncomfortable” or “very uncomfortable” asking for FlexTime; and 71% said they would be more likely to ask for flexibility if everyone in their workplace had the right to request it. People who did have flexible work arrangements reported that it allowed them to better manage their lives. For example, one respondent was able to complete a Master’s program thanks to FlexTime, while another was able to care for her father during the last six weeks of his life without worrying about losing her job. Comptroller Stringer calls on Congress to pass the Flexibility for Working Families Act and on Albany and City Hall to enact local “right-to-request” laws These laws – which are sponsored by Representative Carolyn Maloney in Congress and Assemblywoman Nily Rozic and State Senator Daniel Squadron in Albany – would create a framework for employees to discuss FlexTime with their bosses without fear of retaliation. “New Yorkers shouldn’t be intimidated or fearful when asking for flexibility in their schedules,” Comptroller Stringer said. “That’s why it is critical that we pass right-to-request legislation which would enable employees to discuss FlexTime without fear of retaliation. New Yorkers should be able to take their son to the doctor, pick their daughter up from school, or care for their elderly parents without having to worry about their jobs.” The Comptroller’s survey also found strong support for paid family leave, which allows new parents to bond with their children and provides support for individuals caring for sick family members: 80% of respondents support a paid family leave system funded by a small employee payroll deduction, as state legislation in Albany has proposed; and 86% support equal amounts of paid family leave for both mothers and fathers. A 2011 study of California’s program by the Center for Economic and Policy Research shows that paid family leave helps employees care for their loved ones, and is also good for business. Over 89% of employers reported it had a “positive effect” or “no noticeable effect” on productivity, profitability, turnover, and employee morale. This legislation, sponsored by Assemblywoman Catherine Nolan and State Senator Joseph Addabbo, Jr., would create a state-wide paid family leave insurance system, which would be funded by a small employee payroll deduction. “Two countries in the world don’t have paid family leave: New Guinea and the United States,” the Comptroller said, referring to a study by the International Labor Organization. “That needs to change. Mothers and fathers should have the opportunity to bond with their newborns, and all workers should be able to care for sick family members without fear of losing their job. While this issue should be addressed at the federal level, we can and must take steps now in Albany to support paid family leave for all New Yorkers.” The survey found that among “shift workers,” whose schedules often change week-to-week, 18% receive their schedule only a day in advance, with some respondents reporting that they often don’t know their schedule until the day of—or even during their shift. This uncertainty prevents workers from scheduling day care for their kids, providing elder care for their loved ones, and furthering their own education. Among these workers: Nearly one-fifth receive their schedules a mere 24-hours before their shift begins; and Almost one-third reported retaliation after requesting schedule changes. “Advance notification of schedules isn’t a perk – it’s a basic necessity for millions of Americans who deserve to know when they need to clock in so that they can plan their lives accordingly,” Stringer said. “Enacting this as standard workplace policy is long overdue." “Now more than ever, so many workers are struggling to juggle the responsibilities of their jobs with the demanding tasks that come with having a family. In a city as high-paced as New York, that battle is only intensified, and no one should be forced to have to ultimately choose between their job and their family. I commend Comptroller Stringer for not only providing us with hard evidence that proves flexible work arrangements really are needed in our city, but for putting forth recommendations that can help us one day make that a reality,” said Senator Addabbo, Jr. “Everyone has the right to strike a balance between work and their personal lives, so they can plan to take care of important issues, including healthcare, education and childcare matters,” added Senator Jose Peralta. “Flexible scheduling creates a win-win scenario for both employers and workers. More than a hundred Democratic party lawmakers have written to Federal Reserve chair Janet Yellen complaining of a lack of diversity within the central bank system and a leadership that is “overwhelmingly and disproportionately white and male”.
The letter, signed by 11 senators and 116 representatives, calls on the Fed to do more to ensure its senior ranks reflect the country’s make-up in terms of gender, race and ethnicity, economic background and occupation. It also demands that the Fed place greater priority on securing full employment for minorities as it pursues its economic goals.
“When the voices of women, African-Americans, Latinos, and representatives of consumers and labour are excluded from key discussions, their interests are too often neglected,” the letter says. “By fostering genuine full employment, the Federal Reserve can help combat discrimination and dramatically reduce the disproportionate unemployment faced by minority populations.”
The signatories include senators Elizabeth Warren of Massachusetts, Bernie Sanders from Vermont and Kirsten Gillibrand from New York; and representatives including Maxine Waters, the ranking member of the Financial Services Committee and John Conyers from Michigan. All Democratic members of the Congressional Black Caucus put their names to the letter. It was not signed by Republican lawmakers.
The letter is the latest sign of political pressure on the Fed from both sides of the party divide. Republicans have been calling for greater Congressional scrutiny over the Fed amid persistent concerns about the ultra-loose monetary policy stance it has pursued since the financial crisis. Democrats, on the other hand, have urged Ms Yellen to maintain low interest rates in pursuit of higher employment, and in her most recent hearings before Congress Ms Yellen faced a barrage of complaints about the uneven economic progress seen between different races and ethnicities.
Eleven of the 12 regional Federal Reserve Bank presidents are white and 10 of the 12 are men. All of the 10 current voting members of the Federal Open Market Committee, which sets monetary policy, are white, while four of them are women. Members of the Fed’s Board of Governors, who rank among the top rate-setters, are selected by the president and confirmed by the Senate, but the Board of Governors has a key role in selecting the Fed’s regional bank presidents.
A spokesperson for the Federal Reserve Board said: “The Federal Reserve is committed to fostering diversity — by race, ethnicity, gender, and professional background — within its leadership ranks. To bring a variety of perspectives to Federal Reserve Bank and Branch boards, we have focused considerable attention in recent years on recruiting directors with diverse backgrounds and experiences.”
The Fed said that minority representation on its reserve bank and branch boards had increased from 16 per cent in 2010 to 24 per cent in 2016, while the proportion of women directors has risen from 23 per cent to 30 per cent over the same period. Some 46 per cent of all directors are “diverse in terms of race and/or gender”, the Fed added.
The Fed in December lifted interest rates for the first time in nearly a decade. It has since kept them on hold as it weighs up conflicting evidence about the strength of the recovery. Referring to monetary policy, the letter from the lawmakers urges Ms Yellen to “give due consideration to the interests and priorities of the millions of people around the country who still have not benefited from this recovery”.
Jesse Ferguson, a Clinton campaign spokesman, said: “The American people should have no doubt that the Fed is serving the public interest. That’s why Secretary Clinton believes that the Fed needs to be more representative of America as a whole as well as that commonsense reforms — like getting bankers off the boards of regional Federal Reserve banks — are long overdue.”

The Boston Globe - April 19, 2015, by Dante Ramos - Because life-threatening crises arise at odd times, people in some fields have days when they’re on call. EMTs get called to accident scenes. Doctors have patients who might fall ill or go into labor at any moment. But do unforeseen variations in sweater sales, or in foot traffic in the housewares department, have the same urgency? Of course not.
Recently, New York Attorney General Eric Schneiderman sent letters demanding information from Gap, Abercrombie & Fitch, Urban Outfitters, and 10 other major retail chains about their use of on-call shifts — periods for which an employee must keep an open schedule but might not end up working.
Instead of simply reporting for work, the employee has to check in with a supervisor a few hours in advance. If she gets called in, she may have to scramble for a babysitter. If she doesn’t get called in, she doesn’t get paid, and it’s too late to get a shift on a second job. “People will be scheduled for eight on-call shifts in a pay period and only get called in for one shift,” says attorney Rachel Deutsch of the Center for Popular Democracy, a labor advocacy group.
Some of the retailers Schneiderman targeted have written the practice into their employee handbooks. Others, such as JC Penney, told reporters last week they have policies against it. Still others have responded cryptically to reporters’ inquires; TJX, the Massachusetts-based discount giant, told CNN Money that its schedules “serve the needs” of workers and the chain. I contacted the company to clarify, but it didn’t respond.
On-call shifts are a new frontier: They’ve proliferated at big chains because of just-in-time scheduling software, which uses up-to-the-minute data to maximize sales while minimizing the number of employees on the clock at slower times. Statistics are hard to come by, although a 2011 survey by Retail Action Project, another advocacy group, found that 43 percent of New York City retail workers were assigned to on-call shifts sometimes or often. Until Schneiderman’s office started sending out letters, the practice had attracted little regulatory attention. (In Massachusetts, the attorney general’s office is watching what happens in New York, but hasn’t taken similar action.)
Despite their relative novelty in retail, on-call shifts speak to an age-old tension. Economic life is full of uncertainty. How much should employers bear, and how much should fall on workers? Jon Hurst, president of the Retailers Association of Massachusetts, argues that stores face stiff competition from e-commerce and survive at the mercy of the customer who, he says, “moves on a dime.” He adds, “If you choose to work in retailing, you have to live with the consumer.”
In other sectors, though, people who work on call are often paid salaries that presume some unpredictability, or they’re paid for the time they spend waiting around. Deutsch used to work as a union rep for hospitals in the Bay Area. One hospital, she says, had a handful of technicians on staff who performed echocardiograms during the workday. After hours, there was a technician on call, who was paid half-time for those shifts even when there was no work.
A key difference: Echocardiogram techs have a specialized skill. Entry-level retail workers don’t, and those averse to on-call shifts are easily replaced.
Businesses aren’t social-service agencies. To rely on employers as guarantors of health care and retirement security, as the US government did after World War II, is to assume they and their workers want to be bound together intimately, for decades on end. But at the other extreme, companies that treat employee relationships as fleeting and transactional — the workplace equivalent of a one-night stand — will end up with lots of churn in their ranks.
Or they’ll be subject to lots of government mandates. Responding to a variety of complaints about unpredictable schedules, San Francisco last year approved a far-reaching “retail worker bill of rights” that, among other things, requires employers to post schedules weeks in advance. A proposed Massachusetts law has similar provisions. Hurst points out that parts of the bill would have hamstrung local retailers in February, when sales plunged during a four-week Ice Age.
Retail chains can forestall such rules by changing their ways. When stores train workers to do more than scan tags and say “I can help who’s next,” those workers can improvise. They might tend to customers during a sudden rush while prioritizing other jobs, like restocking shelves, at slower moments. If employers still believe they need on-call shifts, they can simply guarantee employees some pay for those periods. Ideally, chains would do so voluntarily. In practice, some will need a regulatory nudge.
When retailers can claim free options on hourly workers’ time, they have no incentive to make firm decisions in advance. But no one likes being strung along, and no one’s life is infinitely flexible.

En Nueva York, anualmente 75 trabajadores de construcción mueren por accidentes, una cifra que a nivel nacional supera los 4 mil, reportó Blanca Rosa Vílchez a Univision.
El 41 por ciento de los trabajadores de construcción en Nueva York son latinos; sin embargo, cuando se habla de accidentes, significan el 74% de los muertos, una estadística que en sí refleja la magnitud del problema.
Líderes comunitarios exigen soluciones
En el mismo lugar en el que un trabajador de construcción fue la última víctima mortal de un accidente, la organización que realizó el estudio y líderes comunitarios discutieron los grandes riesgos a los que se exponen diariamente estos trabajadores.
“Había momentos en que el jefe le decía que tenía que subir a una determinada altura y él no estaba acostumbrado a eso y tenía que hacerlo porque eran órdenes del jefe”, aseguró Elsa Ramos, madre de un trabajador.
Una multa para los contratistas no supera los 2 mil dólares y la muerte de un trabajador los 12 mil, además se presentó un proyecto para eliminar lo que se conoce como la “ley del andamio”.
Muchos casos no se denuncian
“Quieren hacer ese cambio para que los trabajadores no puedan seguir juicio contra una compañía de construcción aunque haya violaciones, nosotros tenemos que seguir previniendo que se haga ese cambio”, mencionó Francisco Moya, asambleísta.
Sin embargo, muchos casos ni siquiera se reportan por temor de los trabajadores.
“Ya me hicieron cirugía de la nuca en 2010 y me hicieron cirugía de la espalda en diciembre de 2012, todavía tengo dolor, ese dolor lo voy a tener toda mi vida”, afirmó Pedro Corchado, trabajador accidentado.

The Paychex/IHS Small Business Job Index posted a 0.19 percent monthly increase in February, rising to 100.84. That follows January's 0.09 percent gain and marks the second straight month of advances. On a year-over-year basis, the index, which measures hiring at businesses with 50 or fewer workers, slipped 0.31 percent.
"Small businesses are off to a solid start in 2015 when it comes to job growth," said Martin Mucci, president and CEO of Paychex, in a press release. "While it's still early in the year, the first two months have seen consistent positive improvement."
Nationally, signs of increased small-business hiring abound. Only two regions that were measured in February showed a decline, and 13 of the 20 states analyzed have index levels topping 101. The Pacific Region had the best performance in February, while New England, which has gotten pounded this winter with record-setting snowfall, showed the worst one-month performance.
Indiana edged out Texas and Florida to become the leading state for small-business hiring, and Dallas led all metropolitan areas.
The index is calculated using aggregated small-business payroll data on 350,000 small businesses and with a base year of 2004 because it was a period of expansion before the start of the economic downturn. Although politicians often refer to small businesses as an engine of economic growth, economists have disputed this notion in recent years.
Nonetheless, the report does underscore positive job market trends. During 2014, 37 states and the District of Columbia showed statistically significant improvements in employment. Texas had the largest gains (457,900), followed by California (320,300) and Florida (230,600). The biggest job losses were in Minnesota (5,200), Idaho (1,700) and New Mexico (1,600). The strengthening continued in January, when the nation's overall unemployment rate slipped to 5.7 percent.
According to the Federal Reserve, economists believe the "long-run normal" unemployment rate would be between 5 percent and 6 percent over the next five to six years in the absence of "shocks."
Jobless rates for certain categories of workers, though, remain stubbornly high. Unemployment for Millennials, for instance, was 14 percent as of January. According to Fivethirtyeight.com, this generation is poorer than people their age were in 1989 because so many are deeply indebted with student loans and are less likely to own a house.
The national jobless rate for African-Americans was 10.3 percent in January. In the two-thirds of states for which data are available, the median real wages of African-Americans fell between 2000 and 2014, while pay for whites rose 2.5 percent during the same period. Two liberal think tanks, the Center for Popular Democracy and the Economic Policy Research Institute, argued in a report released today that these job-market disparities indicate the Federal Reserve should resist pressure to raise interest rates.
"America needs the Federal Reserve to concentrate on labor market stability and ensure that wages are rising with productivity, so that workers reap the benefits from their efficiencies and hard work; that means prioritizing a wage growth target, rather than inflation," the report said. "A Federal Reserve dominated by banks and major corporations will produce an economy that works for them, at the risk of leaving tens of millions of working families -- particularly Black working families -- with little hope of a better life."

We are writing to offer you our view about the urgency of appointing an individual who deeply understands the economic realities facing working class Americans to serve as President of the Federal Reserve Bank of San Francisco.
For all of the dynamism and strength of the US economy, it has come to be characterized most fundamentally by enormous disparities in wealth, income and opportunity that strongly correlate to race, ethnicity and geography. Failing to address significant disparities in income and net worth between major segments of our population, and particularly in segments that are driving our nation’s demographic growth, will result in a less globally competitive US economy. This is a significant economic risk for the 12th District and the United States.
The San Francisco Fed will be strengthened by having a President whose experience and expertise better reflect the large segments of our population that are not proportionally experiencing the benefits of our economy. Ensuring that this expertise and perspective is represented within the Fed is a critical way to prepare for the challenges and opportunities in our economic future. This will require considering candidates with more diverse experience including in the fields of community development and philanthropy. We submit that the San Francisco Fed has a historic opportunity to name the first Hispanic, East Asian American or Pacific Islander President of a Federal Reserve Bank.
We applaud Chairman Powell's insightful comments on the necessity for diversity in Federal Reserve System and the larger economics profession. In his testimony before the Senate Banking, Housing and Urban Affairs Committee on November 28th, 2017, he stated, “We make better decisions when we have diverse voices around the table—both at the Board of Governors and at the Reserve Banks…We’ve seen what works. It’s about recruiting. It’s about going out of your way. It’s about bringing people in. Once they’re in, it’s about giving them paths for success. And it’s about having an overall culture and company that is very focused on diversity and sticks with that focus for a long period of time. That works.” This recognition must be coupled with bold leadership and action.
In order to decide the course of monetary policy through an informed assessment of different regional economic conditions from diverse points of view, the Federal Reserve System was designed to be decentralized, independent and include representatives of the public in its governance. The Fed’s mission is undermined when regional Reserve Banks fail to recruit leaders who live up to the mandate to “represent the public.” Selections that fail to allow meaningful opportunities for public input and engagement have tended to result in the elevation of Fed insiders. This insularity undermines the Fed’s public credibility and increases the likelihood that Congress will ultimately intervene to reform the process. The process for selecting the President of the New York Fed perpetuated the status quo. We urge the San Francisco Fed to avoid the same mistake. As a first step, we call on the San Francisco Fed to include the Chair of its own Community Advisory Board in the official selection committee for the next President.
Please accept this letter as an offer of support. We will do anything we can to help identify strong candidates as well as to publicly support actions that the San Francisco Fed takes to ensure progress on diversifying its Board of Directors and executive leadership.

As Chair of the Board of Directors for the Federal Reserve Bank of San Francisco, I know that I speak for all of my board colleagues in saying that the appointment of a Federal Reserve Bank President is among our most important responsibilities and one that we take very seriously. Dear Mr. Mehran:
Thank you for your letter dated April 20 and for your commitment to finding a San Francisco Fed president who “understands and is able to represent the varied needs and interests of the richly diverse people and business communities throughout the Twelfth district.”
We appreciate that the San Francisco Federal Reserve Bank has shown its commitment to public representation by strengthening diversity among Reserve Bank staff. Unfortunately, that commitment has not extended to the position of President. Similarly, diversity and public representation on the San Francisco Fed’s governing board remains lacking. The Twelfth District is one of the most demographically diverse districts in the country, yet a recent analysis by the Center for Popular Democracy found that the San Francisco Fed’s board of directors is the least diverse in the Federal Reserve System.
Your letter indicated that it would not be possible to include a Community Advisory Council member on the search committee because “only the Class B and C directors (those not affiliated with banks or financial institutions) are eligible to participate in the appointment process.” We would like to clarify our request regarding Mr. Matsubayashi’s inclusion. Following established precedent, Mr. Matsubayashi can play a critical advisory role on the search committee by suggesting, interviewing, and advising on candidates under consideration. We are not suggesting or expecting that he would have final decision-making authority over which candidate is ultimately chosen.
The Federal Reserve Act clearly designates Class B and C directors as the final arbiters of who serves as president of each Reserve Bank. We do not agree that inclusion of a member of the public on the search committee would in any way violate the law. We have consulted with legal experts on the Federal Reserve Act, and they concur. Whenever a regional Reserve Bank encounters a presidential vacancy, it is customary to hire an executive search firm to identify and vet candidates who can fill that vacancy. We posit that employees of those executive search firms are participating in the search process. In 2014, outgoing Dallas Fed President Richard Fisher solicited the participation of non-Class B/C directors when he reportedly convened an advisory committee consisting of former Dallas Fed chairmen to help choose his successor.2 Freedom of Information Act requests have also revealed that members of the Board of Governors have occasionally suggested candidates to fill Reserve Bank presidential vacancies, thereby going beyond the final approval role that the Federal Reserve Act prescribes for governors. We fail to see how the inclusion of Mr. Matsubayashi on the search committee in an advisory capacity is distinguished from these other examples of involvement by non- Class B and C directors in recent Reserve Bank presidential selections.
In your letter of April 20th, you identified the establishment of the Community Advisory Council as an important step toward giving an “even stronger voice to those representing underserved communities,” in the District. The Council includes individuals selected by the San Francisco Fed itself as credible representatives of diverse communities. If the San Francisco Fed is unwilling to find a way to meaningfully include a leading member of that advisory council in the selection process for the next President, it is difficult to understand how underserved communities are truly gaining a stronger voice.
It is also difficult to be assured that people of color will be given due consideration for the position of President when communities of color and other important segments of the District’s population are not adequately reflected in the selection process. Despite clear calls for consideration of diverse candidates from members of Congress and the public, the last two Reserve Bank presidential vacancies have resulted in the selection of white, male, longtime Fed insiders. Including the Chair of the San Francisco Fed’s Community Advisory Council on the search committee in San Francisco is an essential step to maintain the credibility of the selection process for the next President of the San Francisco Fed.
In light of this clarification, we respectfully request that you consider including the Chair of the San Francisco Fed’s Community Advisory Council in the search process in a manner consistent with the Federal Reserve Act. If the San Francisco Fed chooses not to accept this recommendation, we would appreciate an explanation as to why. Regardless of your decision, we look forward to your continued collaboration as you take on the important responsibility of finding a qualified candidate to fill a policymaking role of crucial importance to the public.

De Blasio Administration Rejects Two Council Voter Registration Bills

Gotham Gazette - October 23, 2014, by Kristen Meriwether -In 2000 the City Council passed Local Law 29 which aimed to increase voter registration by requiring 19 city agencies to offer voter registration forms to its customers. It's fourteen years after the law's passage and compliance has been abysmal.
A report compiled by Center for Popular Democracy released this week shows during their walk-ins to 14 of those city agencies, 95 percent of people were never asked if they wanted to register to vote. Of those who self-identified as citizens, the report indicated 84 percent were not given a voter registration form.
On Thursday the City Council held an oversight hearing to discuss the poor compliance and introduce two bills aimed to increase voter registration at the city agency level. Intro 493, sponsored by Committee on Government Operations chair Ben Kallos, would require 15 additional agencies to be covered under the agency-based voter registration law. Intro 356, sponsored by Council Member Jumaane Williams, would assign a code to each agency that would be printed on the voter registration forms and allow the City to track how many forms are being utilized from each agency.
Both bills are being rejected by the de Blasio administration.
"We are committed to getting agency-based voter registration right," Mindy Tarlow, director of the Mayor's Office of Operations, said during her testimony. "But to get it done, we are going to need time and space to manage the agencies and correct long-standing behavior."
Tarlow pointed to Directive 1, issued by Mayor Bill de Blasio on July 11, 2014. In the directive—his first as mayor—he ordered each agency covered under Local Law 29 to prepare a plan showing how they would implement the requirements of the Charter and submit it within 60 days.
The directive also requires each agency submit a semi-annual report on how the plan is being implemented which will include the number of voter registration forms distributed, the number of registration forms completed, and the number of forms transmitted to the Board of Elections.
Tarlow said she agrees with the assessment that there is a problem, but she argued that with the administration already addressing the problem, it was too early for further legislation.
"It is hard. We are trying to bring a number of agencies along," Tarlow said, adding that before moving on new legislation, "we want a chance to feel like we have made some inroads."
Tarlow did not provide an exact timeline as to when the Council would see the results from Directive 1, but did promise to share preliminary reports with the Council some time at the end of November. Kallos jokingly said he looked forward to to reading it in between bites of his Thanksgiving dinner.
"We need the flexibility to watch this over time," Henry Berger, special counsel to the mayor, said during the hearing.
Intro 356The administration's rejection of the second bill, Intro 356, is based less on Directive 1 and more on privacy concerns. Tarlow argued that by putting a code which would identify what agency a voter was getting services from may deter voters from registering at agencies.
"This is to protect the privacy of the individuals who receive services from government that they don't wish to be disclosed," Tarlow said in her testimony.
The council members now face the prospect of attempting to negotiate the bills with the administration.
On Thursday, Council Member Williams went through a lengthy back-and-forth with members of the administration as well as representatives of the Board of Elections (who testified in a later panel) to dispute objections. Williams argued there was already a code (the number 9) on all voter registration forms coming from City agencies and a separate code for those coming from CUNY.
Both Williams and Kallos asked if it was a matter of that information being released to the public or simply being documented. Tarlow said it wasn't a matter of determining who the person was, but what services they were seeking or receiving. She said the administration believes the fear of that information getting out would deter people from signing up to register to vote.
Williams pointed out information such as social security numbers, fax numbers, and driver's license numbers are all exempt from public reporting, but records are still kept. He argued this code could be exempt as well.
Michael Ryan, executive director of the New York City Board of Elections (BOE), said during his testimony the BOE did not believe this code could be exempt based on current law, but he admitted they did not have a chance to dive in deeply on the issue because they were preparing for the upcoming election.
"I don't know that I have been persuaded," Williams said.
