Gotham Gazette - October 23, 2014, by Kristen Meriwether -In 2000 the City Council passed Local Law 29 which aimed to increase voter registration by requiring 19 city agencies to offer voter registration forms to its customers. It's fourteen years after the law's passage and compliance has been abysmal.
A report compiled by Center for Popular Democracy released this week shows during their walk-ins to 14 of those city agencies, 95 percent of people were never asked if they wanted to register to vote. Of those who self-identified as citizens, the report indicated 84 percent were not given a voter registration form.
On Thursday the City Council held an oversight hearing to discuss the poor compliance and introduce two bills aimed to increase voter registration at the city agency level. Intro 493, sponsored by Committee on Government Operations chair Ben Kallos, would require 15 additional agencies to be covered under the agency-based voter registration law. Intro 356, sponsored by Council Member Jumaane Williams, would assign a code to each agency that would be printed on the voter registration forms and allow the City to track how many forms are being utilized from each agency.
Both bills are being rejected by the de Blasio administration.
"We are committed to getting agency-based voter registration right," Mindy Tarlow, director of the Mayor's Office of Operations, said during her testimony. "But to get it done, we are going to need time and space to manage the agencies and correct long-standing behavior."
Tarlow pointed to Directive 1, issued by Mayor Bill de Blasio on July 11, 2014. In the directive—his first as mayor—he ordered each agency covered under Local Law 29 to prepare a plan showing how they would implement the requirements of the Charter and submit it within 60 days.
The directive also requires each agency submit a semi-annual report on how the plan is being implemented which will include the number of voter registration forms distributed, the number of registration forms completed, and the number of forms transmitted to the Board of Elections.
Tarlow said she agrees with the assessment that there is a problem, but she argued that with the administration already addressing the problem, it was too early for further legislation.
"It is hard. We are trying to bring a number of agencies along," Tarlow said, adding that before moving on new legislation, "we want a chance to feel like we have made some inroads."
Tarlow did not provide an exact timeline as to when the Council would see the results from Directive 1, but did promise to share preliminary reports with the Council some time at the end of November. Kallos jokingly said he looked forward to to reading it in between bites of his Thanksgiving dinner.
"We need the flexibility to watch this over time," Henry Berger, special counsel to the mayor, said during the hearing.
Intro 356The administration's rejection of the second bill, Intro 356, is based less on Directive 1 and more on privacy concerns. Tarlow argued that by putting a code which would identify what agency a voter was getting services from may deter voters from registering at agencies.
"This is to protect the privacy of the individuals who receive services from government that they don't wish to be disclosed," Tarlow said in her testimony.
The council members now face the prospect of attempting to negotiate the bills with the administration.
On Thursday, Council Member Williams went through a lengthy back-and-forth with members of the administration as well as representatives of the Board of Elections (who testified in a later panel) to dispute objections. Williams argued there was already a code (the number 9) on all voter registration forms coming from City agencies and a separate code for those coming from CUNY.
Both Williams and Kallos asked if it was a matter of that information being released to the public or simply being documented. Tarlow said it wasn't a matter of determining who the person was, but what services they were seeking or receiving. She said the administration believes the fear of that information getting out would deter people from signing up to register to vote.
Williams pointed out information such as social security numbers, fax numbers, and driver's license numbers are all exempt from public reporting, but records are still kept. He argued this code could be exempt as well.
Michael Ryan, executive director of the New York City Board of Elections (BOE), said during his testimony the BOE did not believe this code could be exempt based on current law, but he admitted they did not have a chance to dive in deeply on the issue because they were preparing for the upcoming election.
"I don't know that I have been persuaded," Williams said.

The minimum wage has already been an issue on the presidential campaign trail. Now, three national progressive groups plan to use it to pressure Senators in tight races to back higher wages or face a backlash on election day.
The Working Families Organization, the National Employment Law Project Action Fund, and the Center for Popular Democracy Action Fund are teaming up with grassroots organizations in seven battleground states to educate voters about where lawmakers stand on a policy they say can help low-wage workers and the economy.
They also plan to pressure candidates who have opposed higher minimum wages or who haven’t picked a side. In the coming weeks, they are planning a series of actions they hope will influence swing voters, drive voters to the polls, and shame lawmakers into advocating for higher pay floors.
“There’s unprecedented momentum this year for raising the minimum wage. Voters are hungry for leaders who’ll take a strong stand in raising wages and frustrated with their Republican majorities in Congress,” said Paul Sonn, a spokesperson for the National Employment Law Project Action Fund.
While the focus is on Senate races, “partners in this effort are educating voters on where candidates for office from president down to city councilperson stand on raising wages,” said Mr. Sonn, who added that Hillary Clinton is a strong supporter of raising the federal minimum wage while Donald Trump “has been all over the map.”
With control of the Senate hanging in the balance after Republicans won the majority in 2014, the groups are betting minimum wage could be a pivotal issue in key races in Pennsylvania, Missouri, Wisconsin, Ohio, Arizona, New Hampshire, and North Carolina. They are in the process of scheduling protests outside of Senate debates, arranging door-to-door canvassing, organizing candidate forums and town halls and doing polling on the issue. Another tactic they plan: inviting candidates to spend a day shadowing a low-wage worker on the job, and possibly exposing those who won’t do it.
Republicans are defending 24 Senate seats this November, while Democrats are defending 10. Democrats need to win at least five net seats to gain back control from Republicans, or four if Hillary Clinton wins the White House and Tim Kaine is elected vice president and can break tied Senate votes.
Some of the lawmakers the groups plan to target because of the lack of support they’ve shown for higher minimum wages are Arizona Republican Sen. John McCain, who is in a contest against Democratic Rep. Ann Kirkpatrick, and Missouri Republican Sen. Roy Blunt, challenged by Democrat Jason Kander.
In Pennsylvania, GOP Sen. Pat Toomey could feel some heat from the groups in his race against Democrat Katie McGinty, who has repeatedly called for raising the federal minimum wage. And in Wisconsin, they will target Republican Sen. Ron Johnson in his contest with Democrat Russ Feingold, who has made raising the minimum wage a pivotal part of his campaign.
Marina Dimitrijevic, the state director of the Wisconsin Working Families Party, one of the grassroots groups involved, said the organization plans to bring a crowd to a mid-October debate between Sen. Johnson and Mr. Feingold. It will also invite Mr. Johnson to a roundtable discussion about raising minimum wages.
“I hope he comes and listens,” she said.
The federal minimum wage is $7.25 an hour, and leading Democrats in Congress have gained no traction on bills to increase it. Pay floors have been rising in cities and states instead to as high as $15 an hour.
Hillary Clinton has said she supports a $12 federal minimum wage but thinks states or cities should be allowed to set higher rates if they have local support. She has stopped short of backing the $15 federal minimum many unions and other left-leaning groups are calling for, but she has won many of their endorsements nonetheless.
Donald Trump has wavered on the issue, saying last year that wages were “too high,” then saying this year that he would like to see an increase in the minimum wage. He recently called for a $10 federal minimum, though he said the states should really call the shots.

The Nation - April 28, 2015, by Brad Lander & Karl Kumodzi - In August 2014, the municipality of Ferguson, Missouri erupted onto the national scene. In the wake of the killing of Michael Brown, we learned much about economic and political life in Ferguson and greater St. Louis County.
To many, it was no surprise to learn that, for years, African-American residents of municipalities throughout St. Louis County have been disproportionately and illegally stopped for minor offenses. Blacks are far more likely to be stopped, searched, ticketed, fined, and arrested. Many wind up jailed, leading to a cycle of lost jobs, drivers’ licenses, homes, or child custody. Some are beaten, terrorized, or—like Michael Brown—even killed.
It was more surprising to learn that in Ferguson, “Driving While Black” isn’t only about racial profiling: it’s also about municipal revenue. Fines and court fees have become the city’s second largest revenue source, and the over-criminalization of Black people has become a strategy for collecting taxes.
It is important to understand and address the revenue crisis facing U.S. municipalities. As cities have become unable to pay their bills, they often turn to regressive strategies that disproportionately harm people of color and low-income residents.
Ithaca, NY is like Ferguson. Up until January 2014, residents had to pay for installations and repairs of public sidewalks adjoining their properties—with one notable case in which 28 homeowners were forced to pay a combined $100,000 out of their personal pockets to the city for repairs. Detroit, MI is like Ferguson. After the city filed the largest municipal bankruptcy in US history, the city’s water department responded to pressures to lower their $90 million portion of the overall $20 billion debt by shutting off crucial water services to mostly Black low-income residents who owed over a mere $150 on their water bills. This April, Baltimore followed Detroit’s lead.
These cities are like Ferguson because of a common underlying problem: All across America, cities and towns are struggling to maintain enough revenue to provide crucial services to residents. The collateral damage of this revenue crisis—over-criminalization, utility shut-offs, the withdrawal of public services, and slashed budgets for schools—is dire.
Local Progress, a national network of progressive municipal elected officials, is working to address inequality from an often overlooked source: municipal budgets. In our new report, Progressive Policies for Raising Municipal Revenue, Local Progress lays out forward-thinking strategies and policy options that cities can pursue to restructure their revenue streams in a way that doesn’t fall disproportionately on the backs of their most vulnerable residents.
The roots of the municipal revenue crisis were decades in the making. Following the post-war desegregation of housing and education, and other civil rights victories of the 50’s and 60’s, racial animosity and the conservative backlash against taxation—referred to by historians as the tax revolt—helped to fuel the exodus of higher-income families from urban centers to suburban enclaves.
This “white flight” dramatically eroded the tax base of urban centers like Detroit, Cleveland, and St. Louis—and later of first-ring suburban municipalities like Ferguson.
The tax revolt also led directly to policies that dramatically reduced the ability of cities to collect enough revenue through property and other taxes. Most dramatic was the 1976 passage of Prop 13 in California, which contributed heavily to the erosion of California’s public education system and other public services.
In 2008, the Great Recession caused the municipal revenue crisis that had been brewing for decades to explode, spurring significant and rapid declines in general fund revenues for municipalities. In order to deal with the impacts of this dramatic shortfall, cities were forced to cut personnel, cancel capital projects (and their much-needed jobs), and slash funding for education, parks, libraries, sanitation, and more. These cuts hit low-income families the hardest. And they are especially harmful to Black families because African-Americans are 30 percent more likely to be employed by the public sector than other workers.
The strategies that many municipalities adopted to address the crisis hit low-income people of color the hardest. When property tax revenue declined in St. Louis County, fines-and-fees revenue increased in order to maintain revenue. Tickets are issued for everything from failure to cut one’s lawn to sleeping over at someone’s house without being on the occupancy certificate. In nearby Edmundson, the city averages $600 per person per year in court fines, and forecasts increasing revenue from these fines in their future budget proposals – essentially creating a hidden tax on the most vulnerable residents. Black residents throughout the region report feeling “as if their governments see them as little more than sources of revenue.”
Many towns have resorted to privatizing formerly public responsibilities such as trash collection, sewage, roads, parks, and introducing new fees to force residents to foot the bill directly. These fees and taxes are often extremely regressive, because as everyone is forced to pay a flat rate, poor people end up paying a higher percentage of their income. A recent study conducted by the Institute on Taxation and Economic Policy found that the nationwide average effective state and local tax rates are 10.9% for the poorest fifth of taxpayers and 5.4% for the wealthiest 1 percent. In fact, in the ten states with the most regressive tax structures, the poorest fifth pay as much as seven times the percentage of their income in taxes and fees as the wealthiest residents do.

Addressing the municipal revenue crisis is, therefore, a central barrier to achieving racial and economic justice in our urban centers, and to rebuilding a more democratic, just, and livable America with genuinely shared prosperity.
Luckily, there are creative and progressive strategies that municipalities can adopt to generate more revenue in a progressive way, such as:
● Expanding the progressivity of existing local income taxes by creating more tax brackets with greater differences between brackets, and doing the same for property taxes in order to generate more revenue from commercial and high-end development.
● Eliminating corporate tax breaks at the city level, particularly Tax Increment Financing and business improvement districts that come with tax breaks
● Restructuring fines so that residents pay different rates based on income. A $200 traffic ticket has no deterrent effect for a millionaire, but can be devastating for a low wage worker; a more rational fine system, like the one adopted in Finland, would be more fair and generate more revenue.
● Mandating that major tax-exempt institutions like hospitals and universities make genuine and fair payments in lieu of taxes (PILOTs) to help cover the costs of crucial city services that they use.
● Converting city services into municipality-owned utilities when possible, charging utility fees to all users, and applying conservation pricing so lower-income households pay a lower rate while bulk users—such as commercial and industry—pay higher rates
● Forming statewide coalitions of municipal elected officials, grassroots organizations, school boards, and other affected parties to change preemption and revenue policies at the state level.
These policy innovations and many more are detailed in our report.
Cities are America’s bedrock and its future: both for our country and for the progressive movement. Cities are home to 67% of the population, account for 75% of our GDP, and house our best public institutions and infrastructure.
The policy recommendations laid out by Local Progress in our new report can help municipalities develop progressive revenue solutions—so they can pay for public education, health, and housing programs that help families thrive, invest in the infrastructure of public transportation, climate resilience, parks that sustainable cities need, and stimulate inclusive economic growth that creates good jobs.
Through progressive revenue strategies, cities can turn the Ferguson-like cycle of disinvestment and inequality into a cycle of reinvestment and opportunity—and help make sure that our cities can become the models for our vision of a more progressive and prosperous America.

Three Democratic congresswomen have teamed up in a new effort to help African-American women overcome economic and social barriers. Rep. Robin Kelly (D-IL), Rep. Yvette D. Clarke (D-NY), and Rep. Bonnie Watson Coleman (D-NJ) have launched the Congressional Caucus on Black Women and Girls, the first caucus devoted to public policy that eliminates the significant hurdles and disparities faced by black women. The three hope that the new caucus gives the same attention to black women that President Obama’s My Brother's Keeper initiative has given to black men and boys.
The caucus is an outgrowth of a MoveOn.org petition from the #SheWoke Committee, a group of seven women asking congressional leaders to find ways to improve the lives of black women. That committee includes Ifeoma Ike, the co-founder of Black and Brown People Vote; philanthropic strategist Nakisha Lewis; and Sharon Cooper, sister of Sandra Bland, the Illinois woman who died in police custody in Texas after being stopped for a traffic violation.
The formal launch for the caucus is April 28, when the three congresswomen will lead a symposium at the Library of Congress titled “Barriers and Pathways to Success for Black Women and Girls.” The event will featuring academics, advocacy leaders, business executives, and media personalities. Among the speakers on two different panels are Melissa Harris-Perry, the Maya Angelou Presidential Chair at Wake Forest University and now editor-at-large at Elle magazine (now that she’s no longer at MSNBC); Beverly Bond, founder and CEO of Black Girls Rock!, the annual award show that honors women of color; and Monique Morris, co-founder and president of the National Black Women’s Justice Institute and author of Pushout: The Criminalization of Black Girls in Schools.
An evening event (both the daytime and evening meetings are open to the public) will give members of Congress “an opportunity to address organizations focused on black women, other civic leaders, and individuals who are committed to advancing the quality of life of black women in America,” according to the congressional office of Rep. Watson Coleman.
“I hope that what we will do is to highlight the issues facing black girls and black women—the issues that are impacting their lives,” Watson Coleman said. The range of issues to be addressed in the April 28 symposium include black women’s experiences with law enforcement; disparities in health care, including clinical trials; inequality in salaries; unemployment; domestic violence; and many other topics.
The April 28 events are only the first in what Watson Coleman hopes will be a series of public hearings, ongoing symposiums, and other avenues of gathering information. “We will coordinate all of this information, and we will be presenting public policy.
“There’s so much to do here,” Watson Coleman said. “We’re not trying to make this a quick fix.” Some answers could come in the form of legislation, some might be sought through presidential executive orders, and some might come from elsewhere. “It can be either and all,” she said. “Public policy has left us out of this area. We’re going to be guided by what we learn from experts. We’re not committed to any one thing.”
Watson Coleman said that while the caucus would be coordinated by the three congresswomen chairs, all of the House’s black congresswomen—20 in all—and several black congressmen are on board, too. “All of them have signaled interest,” she said.
Although there’s no coordination of effort, it’s possible that the caucus’s eventual direction may be getting some monetary support from another source. One day after the caucus was announced on March 22, the NoVo Foundation, run by Warren Buffet’s son Peter and his wife, Jennifer, pledged $90 million to “support and deepen the movement for girls and young women of color” in the U.S. "This work is about dismantling the barriers that prevent them from realizing that potential and leading us toward a truly transformative movement for change," said Jennifer Buffett, co-president of the NoVo Foundation. The monetary pledge is part of the foundation’s initiative, “Advancing Adolescent Girls' Rights,” which works to empower girls all over the world.
Another source for information is Grantmakers for Girls of Color, a website that “captures new knowledge and insights about girls and young women of color, with a focus on the structural barriers that prevent them from achieving their full potential.” The site was initially started by the NoVo Foundation, the Foundation for a Just Society, the Ms. Foundation for Women, and other partners. It serves as a shared resource across the philanthropy community, and it will grow and expand based on suggestions and feedback from those givers.
National unemployment rates for both men and women of color are more than double the jobless rates for whites, according to the most recent figures from the Dept. of Labor. Although the unemployment rate for African-American men was higher in every age group than the rate for black women, rates for young black men and women were especially high, ranging from 10.7 percent for black women from 20 to 25 years old to 13.6 percent for men in the same age group, with even higher figures for those under 20 years old.
Some 2 million African Americans are unemployed and looking for work, as jobs have been slower to return to the black community after the Great Recession. A 2015 report from the Economic Policy Institute and the Center for Popular Democracy painted a bleak employment picture for the black community. Most jobs that came back after the recession have been lower-wage jobs in the service and retail sector. The report stated that on an hourly basis during the past 15 years, average wages for black workers have fallen by 44 cents, while Hispanic and white workers’ wages have risen by 48 cents and 45 cents, respectively. As the report said: “The recovery has not yet reached Martin Luther King Jr. Boulevard.”
In addition, the National Women’s Law Center, in a recent report about lifetime wage gaps between men and women, said that the gap over a 40-year career between white men and African-American women is $877,480.
So good for three African-American congresswomen for shining a spotlight on black women and the myriad problems they face. Let’s hope they can identify some real solutions.

PITTSBURGH (AP) - Pittsburgh police say they're using uniformed and plainclothes officers and "extreme caution" to safeguard police and the public at an activists march on Friday.
The march opening the People's Convention at the city's convention center is billed as protesting "growing inequality and a toxic atmosphere of hate." Organizers expect 1,500 activists to march through downtown protesting what they believe are various social ills.
Pittsburgh's Public Safety Department is working with the FBI and other law enforcement in the wake of sniper shootings that killed five police officers and wounded seven others at a protest march in Dallas on Thursday.
Pittsburgh Bishop David Zubik also planned a noon Mass to pray for "peace and reconciliation."
And Philadelphia Archbishop Charles Chaput (SHAP'-yoo) says the Dallas murders "only discredit" such protesters' "legitimate anger."

New Yorkers need policies that would help them balance work and family responsibilities, according to a report released today by New York City Comptroller Scott M. Stringer, in partnership with A Better Balance.
The report, “Families and Flexibility: Building the 21st Century Workplace,” is based on a survey of more than 1,100 New Yorkers working in a broad range of industries and provides a follow up to Comptroller Stringer’s report, “Families and Flexibility,” from June 2014. The online survey, while not scientific, asked workers in all five boroughs about: · The availability of flexible work arrangements; · How comfortable they are requesting flexible schedules; · The need for paid family leave; and · For “shift workers,” the predictability of their work schedules. “No New Yorker should ever have to choose between keeping their job and caring for their family,” said Comptroller Stringer. “With policies like FlexTime, paid family leave, and advanced notification of schedules, we can give workers the tools they need to address their personal and professional responsibilities.” Flexible work arrangements, which allow employees to work outside the traditional 9-to-5 schedule and from locations other than their offices, are one of the most effective ways to help individuals establish a work-life balance. Flexible work arrangements also help businesses boost their bottom line by improving morale and minimizing turnover. But, nearly half of workers surveyed do not have access to flexible work arrangements. Just as troubling, respondents who had requested flexible work arrangements in the past reported that they had experienced missed promotions, negative reviews, and belittling comments. Among respondents without office-wide policies on flexible scheduling: 59% were “uncomfortable” or “very uncomfortable” asking for FlexTime; and 71% said they would be more likely to ask for flexibility if everyone in their workplace had the right to request it. People who did have flexible work arrangements reported that it allowed them to better manage their lives. For example, one respondent was able to complete a Master’s program thanks to FlexTime, while another was able to care for her father during the last six weeks of his life without worrying about losing her job. Comptroller Stringer calls on Congress to pass the Flexibility for Working Families Act and on Albany and City Hall to enact local “right-to-request” laws These laws – which are sponsored by Representative Carolyn Maloney in Congress and Assemblywoman Nily Rozic and State Senator Daniel Squadron in Albany – would create a framework for employees to discuss FlexTime with their bosses without fear of retaliation. “New Yorkers shouldn’t be intimidated or fearful when asking for flexibility in their schedules,” Comptroller Stringer said. “That’s why it is critical that we pass right-to-request legislation which would enable employees to discuss FlexTime without fear of retaliation. New Yorkers should be able to take their son to the doctor, pick their daughter up from school, or care for their elderly parents without having to worry about their jobs.” The Comptroller’s survey also found strong support for paid family leave, which allows new parents to bond with their children and provides support for individuals caring for sick family members: 80% of respondents support a paid family leave system funded by a small employee payroll deduction, as state legislation in Albany has proposed; and 86% support equal amounts of paid family leave for both mothers and fathers. A 2011 study of California’s program by the Center for Economic and Policy Research shows that paid family leave helps employees care for their loved ones, and is also good for business. Over 89% of employers reported it had a “positive effect” or “no noticeable effect” on productivity, profitability, turnover, and employee morale. This legislation, sponsored by Assemblywoman Catherine Nolan and State Senator Joseph Addabbo, Jr., would create a state-wide paid family leave insurance system, which would be funded by a small employee payroll deduction. “Two countries in the world don’t have paid family leave: New Guinea and the United States,” the Comptroller said, referring to a study by the International Labor Organization. “That needs to change. Mothers and fathers should have the opportunity to bond with their newborns, and all workers should be able to care for sick family members without fear of losing their job. While this issue should be addressed at the federal level, we can and must take steps now in Albany to support paid family leave for all New Yorkers.” The survey found that among “shift workers,” whose schedules often change week-to-week, 18% receive their schedule only a day in advance, with some respondents reporting that they often don’t know their schedule until the day of—or even during their shift. This uncertainty prevents workers from scheduling day care for their kids, providing elder care for their loved ones, and furthering their own education. Among these workers: Nearly one-fifth receive their schedules a mere 24-hours before their shift begins; and Almost one-third reported retaliation after requesting schedule changes. “Advance notification of schedules isn’t a perk – it’s a basic necessity for millions of Americans who deserve to know when they need to clock in so that they can plan their lives accordingly,” Stringer said. “Enacting this as standard workplace policy is long overdue." “Now more than ever, so many workers are struggling to juggle the responsibilities of their jobs with the demanding tasks that come with having a family. In a city as high-paced as New York, that battle is only intensified, and no one should be forced to have to ultimately choose between their job and their family.
