Securities and Exchange Commission (SEC) Chair Mary Jo White should recuse herself from the selection of the next chair of the Public Company Accounting Oversight Board (PCAOB) due to an apparent conflict of interest created by the decision’s impact on White’s household income, a national coalition of 14 organizations said in a letter today.
Mary Jo White’s husband John White sits on the PCAOB’s Standing Advisory Group (SAG), selected by the members of the PCAOB, who are in turn chosen by Mary Jo White and the SEC.
John White’s role on the SAG has been marketed extensively by his law firm Cravath Swaine & Moore, LLP, where he practices securities law. His employment as a partner at Cravath forms the large majority of Mary Jo White’s family income, noted the groups.
“SEC Chair White should insure that her household income, which largely derives from her husband’s work as a Cravath attorney, doesn’t compromise her critical decisions affecting Cravath-represented clients,” said Bart Naylor, financial policy advocate for Public Citizen.
Scrutiny of Mary Jo White’s conflict of interest in PCAOB staffing was elevated in early September, whenBloomberg reported that White was considering potential candidates to replace PCAOB Chair James Doty. Doty – whose tough proposed accounting reforms have drawn industry ire and a fierce lobbying effort – has signaled he would like to return for another term.
After ensuing media coverage noted Cravath’s marketing of John White’s role on the SAG, Cravath quickly removed references to White’s position on the SAG from its website by the following day, as reported byMarketWatch.
“If there were any doubts about the improper link between Mary Jo White’s official actions and John White’s financial gain, Cravath’s frantic attempt to scrub its website put them to rest,” said Kurt Walters, campaign manager at Rootstrikers. “Mary Jo White should immediately announce her recusal from all further personnel decisions at PCAOB while her family income is so clearly at stake.”
The groups also called for the public release of any ethics guidance Chair White has relied on to date to continue her involvement in personnel matters at the PCAOB. They highlighted her previous written commitment to obtain ethics waivers before taking any action with a “direct and predictable effect” on her husband’s employment at Cravath.
“Chair White publicly swore to rely on waivers when her actions might have a ‘direct and predictable effect’ on John White’s role at Cravath, and her role helping select the PCAOB creates an appearance of just such an effect,” said Jeff Hauser, director of the Revolving Door Project at the Center for Effective Government.“The public is entitled to review the ethics guidance by which she reached the conclusion that she not only could go forward, but could do so without a waiver. Moreover, given the multiplicity of conflicts the Chair brought with her to the SEC and the absence of any 18 U.S.C. § 208(b)(1) or (b)(3) waivers, complete transparency in ethical guidance (with appropriate redactions) is necessary to restore public confidence in the SEC.”

La ciudad de Nueva York es notable por su liderazgo. Después de tomar las riendas en enero, el Alcalde Bill de Blasio, la Presidenta del Concejo Melissa Mark-Viverito, junto con concejales progresistas, han expandido las leyes de días de enfermedad pagados, han implementado políticas policiales más justas, y han puesto fin a las detenciones injustas de inmigrantes. Federal Reserve Chairwoman Janet Yellen delivered her semiannual testimony on the U.S. economy and monetary policy to the Senate Banking Committee Tuesday. In her prepared remarks, Yellen acknowledged that the country’s economic recovery has not fully extended to the African-American population.
“Jobless rates have declined for all major demographic groups, including for African-Americans and Hispanics,” Yellen said. “Despite these declines, however, it is troubling that unemployment rates for these minority groups remain higher than for the nation overall, and that the annual income of the median African-American household is still well below the median income of other U.S. households.”
An accompanying report revealed that the median Black household income in 2014 was $40,000, which means African-American households are earning just 88 percent of their pre-recession incomes.
The 2014 median white household income was $67,000. According to the report, white, Asian and Hispanic households have regained 94 percent of their pre-recession earnings.
Furthermore, unemployment rates for African-Americans continue to be lower than they were prior to the recession, compared to white unemployment rates, which have nearly returned to original levels.
The Fed has faced growing criticism from activists and lawmakers who accuse the banking system of ignoring the economic disparity faced by minorities in the U.S. Supporters say Fed-controlled interest rates have a direct impact on the economic success of Black Americans.
Tuesday’s comments were a stark contrast to the position taken by Yellen last July, when she argued there was nothing the Reserve could do “about any particular group.”
The statements fired up Connie Razza, director of strategic research at the Center for Popular Democracy, who issued a statement in response.
“With African-Americans still mired in our own Great Recession, we should be hearing a positive vision from the Fed on how to foster full employment,” Razza said on behalf of the Fed Up Coalition. “While the economy is complex and the Federal Reserve’s tools are limited, there is plenty the Fed can do to improve the labor market for Black workers and to reduce racial inequality in the job market.”
The Fed Up Coalition is a consortium of labor unions, community-based organizations and policy think tanks fronted by the Center for Popular Democracy and Action for the Common Good. The group maintains that the economic upswing is a myth for most demographics and stresses that keeping interest rates low will give the economy a chance to truly recover for everyone. Modest rates will raise wages, bringing the country closer to full employment and eliminating the need for discriminatory hiring practices, according to the campaign.
During Yellen’s February address to the House Financial Services Committee, several Democrats pressed the issue of Black unemployment rates.
“Nobody is suffering from unemployment like the African-American community,” Georgia Rep. David Scott said at the hearing, per CNN. “We have got to get the Fed to get off the dime and put the issue of African-American unemployment on the front burner. That is the core of all of the domestic issues that we’re facing.”
The unemployment rate for African-Americans in May was 8.2 percent, which was double the rate of whites at 4.1, according to the Bureau of Labor Statistics.

Efforts to fill top positions at some U.S. Federal Reserve regional branches are casting a spotlight on a decades-old process that critics say is opaque, favors insiders, and is ripe for reform.
Patrick Harker took the reins as president of the Philadelphia Fed this week, in an appointment that attracted scrutiny because he served on the committee of directors that interviewed other prospective candidates for the job he ultimately took.
The Dallas Fed has been without a permanent president for more than three months as that search process stretches well into its eighth month. And the Fed's Minneapolis branch abruptly announced the departure of its leader, Narayana Kocherlakota, more than a year before he was due to go, with no replacement named to date.
The delays and reliance on Fed employees in picking regional Fed presidents can only embolden Republican Senator Richard Shelby to push harder for a makeover of the central bank's structure, which has changed little in its 101 years.
A bill passed in May by the Senate Banking Committee that Shelby chairs would strip the New York Fed's board of its power to appoint its presidents. And it could go further, given the bill would form a committee to consider a wholesale overhaul of the Fed's structure of 12 districts, which has not changed through the decades of shifting U.S. populations and an evolving economy.
The bill is part of a broader conservative effort to expose the central bank to more oversight, and some analysts saw the Philadelphia Fed's choice as reinforcing the view that the Fed needs to open up more to outsiders.
Nine of 11 current regional presidents came from within the Fed, a proportion that has edged up over time. Twenty years ago, seven of 12 were insiders.
"The process seems to create a diverse set of candidates in which the insider is almost always accepted," said Aaron Klein, director of a financial regulatory reform effort at the Bipartisan Policy Center.
Since it was created in 1913, the central bank's decentralized structure was meant to check the power of Washington, where seven Fed governors with permanent votes on policy are appointed by the White House and approved by the Senate.
The 12 Fed presidents who are picked by their regional boards usually vote on policy every two or three years, and they tend to hold more diverse views.
Former Richmond Fed President Alfred Broaddus told Reuters the regional Fed chiefs have more freedom "to do and say things that may not be politically popular" because they are not politically appointed. "On the other hand, there is the question of legitimacy since they are appointed by local boards who are not elected."
"TONE DEAF"
Two-thirds of regional Fed directors are selected by local bankers, while the rest are appointed by the Fed's Board of Governors in Washington.
Critics question how well those regional boards - mostly made of the heads of corporations and industry groups meant to represent the public - fulfill their mission.
Last year, a non-profit group representing labor unions and community leaders organized by the Center for Popular Democracy, urged the Fed's Philadelphia and Dallas branches to make the selection of their presidents more transparent and to include a member of the public in the effort.
Philadelphia's Fed in particular proved "tone deaf" in its head-hunting effort, said Lou Crandall, chief economist at Wrightson ICAP in Jersey City, New Jersey.
Harker was a Philadelphia Fed director when the board started looking to replace president Charles Plosser, who left on March 1, and he was among the six directors who interviewed more than a dozen short-listed candidates for the job, according to the Philadelphia Fed.
But on Feb. 18, Harker floated his own name, recused himself from the process and a week later his colleagues on the board unanimously appointed him as the new president.
While the selection follows Fed guidelines and was approved by its Board of Governors, it raised questions of transparency and fairness.
"The Philadelphia Fed's search process might have made perfect sense in a corporate environment, but is obviously problematic for an official institution," said Crandall.
The board's chair and vice chair, Swathmore Group founder James Nevels and Michael Angelakis of Comcast Corp, respectively, declined to comment, as did Harker.
Peter Conti-Brown, an academic fellow at Stanford Law School's Rock Center for Corporate Governance, and an expert witness at a Senate Banking Committee hearing this year, proposed to let the Fed Board appoint and fire regional Fed presidents or at least have a say in the selection process.
In the past, reform proposals for the 12 regional Fed banks have focused on decreasing or increasing their number and their governance.
Changes to the way the regional Fed bosses are chosen could strengthen the influence of lawmakers at the expense of regional interests.
For now, delays in appointments of new chiefs force regional banks to send relatively unknown deputies to debate monetary policy at meetings in Washington, as Dallas and Philadelphia did last month when the Fed considered raising interest rates for the first time in nearly a decade.
The Minneapolis Fed still has time to find a new president before Kocherlakota steps down at year end.
"For now the Fed criticism is just noise, mostly from Republicans," said Greg Valliere, chief political strategist at Potomac Research Group. "But once the Fed begins to raise interest rates ... then the left will weigh in as well."

With the merger of the Center for Popular Democracy (CPD) and the Leadership Center for the Common Good (LCCG) in January 2014, we are poised to do just that. The stakes are high. The crisis in American society is severe: Inequality is now at the highest level ever recorded. In 2012, the top 1 percent of U.S. households received 19.3 percent of all household income.
The income gap between white and non-white America is growing even faster. Between 2005 and 2009, median white wealth declined by 16 percent, while median black wealth dropped by 53 percent and Latino wealth declined by 66 percent. Increasing economic inequality is being matched by increasing political inequality. Our democracy and the political participation of people of color, young people and the elderly are being eroded by state legislatures, with the tacit support of the Supreme Court.
All this would be much worse of course, if not for the work of the progressive organizations and movements that have fought inequality and racism for decades.
We can, and must, go farther and faster to fight inequality, the erosion of democracy and racial injustice. There is a growing opportunity to challenge the status quo and to build a society characterized by opportunity, equality and inclusion. Increasingly strong and assertive community organizations across the country are stepping up to demand better. Immigrant organizations, worker centers, progressive unions, elected officials and people of faith are envisioning and creating more inclusive and equitable cities and states, even in spite of our failed national politics.
The most successful community campaigns present a new vision for change, a creativity and fearlessness to promote policies many have thought unachievable, as well as a canny understanding of how to navigate local political forces.
My organization, the Center for Popular Democracy, works at the center of this emerging new politics, working to build the capacity and resilience of rooted, democratic, community-organizing institutions. We feel the urgency to grow our movement, to build new strength, to share organizing models and strategies more broadly, and to replicate campaigns and tactics that work to confront racial and economic inequality.
Just as our movement needs more power and reach, so do we. That's why we are merging with the Leadership Center for the Common Good to create a newly powerful Center for Popular Democracy on January 1, 2014. Our organizations' sister c4 organizations, Action for the Common Good and Center for Popular Democracy Action Fund will also merge to create a newly powerful Action for the Common Good. Part campaign center, part capacity builder, part policy shop, our merged and expanded organizations will work together to more effectively build the strength and capacity of democratic organizations to envision and advance a pro-worker, pro-immigrant, racial and economic justice agenda. From recent successes, we have a sense of what is possible when working communities are well organized, resourced and equipped to demand change. In New York, coalitions of community groups, progressive unions, and faith networks came together this year to secure a raft of impressive victories, from a raise in the state's minimum wage, to the adoption of paid sick days' legislation in New York City to the passage of pro-immigrant language access initiatives in both Nassau and Suffolk Counties on Long Island. And, in the face of fierce opposition from outgoing Mayor Bloomberg, CPD and our allies secured passage of new laws to stop the discriminatory policing tactics of the NYPD -- Stop and Frisk. CPD brought our policy expertise, strategy insights, and coalition coordination experience to these fights -- helping drive them to victory.
The New York victories mirror the work we are engaged in across the country -- in 27 states with more than 90 partners nationally. Through strategic and sustained local and state victories, driven by strong community and labor partners, and supported in important ways by CPD, we can secure tangible improvements in working people's lives and generate the upward pressure and momentum necessary to refocus national policy on furthering values of equity, opportunity and democracy for all.
Strong local organizations with a clear vision and an appetite for bold action are well able to scale up to win national victories when strategic opportunities present themselves. Last May, for example, the Home Defenders League, a project of LCCG and many close allies, staged a dramatic week of action which included civil disobedience by foreclosed homeowners at the Department of Justice as well as at other sites. Their actions tied together the simmering public outrage over the lack of prosecutions of Wall Street banks with a need to find relief for the hard hit families and communities. Five months later, reports of a pending $13 billion federal settlement with JPMorgan Chase suggest the long fight may be about to yield results.
The launch of the merged and expanded Center for Popular Democracy and Action for the Common Good is our ambitious move to help increase the strength, scale and reach of community organizing. Together, we are stronger. Together, we can build the power we need to win.

The Federal Reserve has received a lot of criticism recently for its lack of diversity. The leaders of the central banking system are almost all white men.
But now that the president of one of the Fed’s 12 regional banks in Atlanta is stepping down, some see an opportunity for change.
Several congressional lawmakers and the activist group Fed Up are calling on the agency to appoint the system’s first black president at the Federal Reserve Bank of Atlanta.
“The fed is the nerve center of our entire economic system, and nobody is suffering from an economic depression as the African-American community,” Congressman David Scott said.
The Georgia Democrat co-wrote a letter, along with Reps. John Lewis, Maxine Waters and John Conyers, to Federal Reserve Chair Janet Yellen on the issue.
Black workers still struggle, Scott said, even as the overall economy has recovered. The jobless rate for African Americans, for example, is more than double their white neighbors.
Outside an unemployment office on the west side of Atlanta, Formosa Williams is at her wit’s end.
“At this point, I don’t know what to do,” Williams said.
For years, Williams said she has struggled to find stable work.
“The only jobs that really seem to be hiring are like fast food,” Williams said. “And it’s no way I’m going to go back to that.”
Scott and the activists hope stories of minority workers, like Williams, will take a more prominent place in the central banking system’s discussions once it has a black regional president.
“Unless you have a voice at that table that has gone through the experience of being an African American, you’re missing so much,” said Scott.
The congressman and activists argue the appointment also makes sense, given the region the bank covers -- the South -- and that region’s history with civil rights.
But while many economists might agree that diversity is good, they aren’t all sure how it translates into policy.
“I think you have to start out with the recognition that our Federal Reserve officials have really one tool, and that’s interest rates,” said Tim Duy, an economics professor at the University of Oregon. “That tool is a very blunt instrument.”
That tool affects the broader economy at a macro-level, said Duy, who also authors a blog called Fed Watch. Meanwhile, he said, many of the problems facing African-American workers are at the micro-economic level.
“The Federal Reserve is not going to be a silver bullet to these issues,” Duy said.
The search for the next Atlanta Fed president is being led by a committee of business leaders from around the South.
The chair, Thomas Fanning, who is president of Southern Company, said they’re looking for the best person most of all.
And if he or she happens to make history, as the first African American?
“That would be a great thing,” Fanning said.

Times Union - September 17, 2014, by Andrew Friedman & Javier Valdes - With President Barack Obama once again delaying immigration reform with a path to citizenship, immigrants aren't waiting any longer for Washington to act on their behalf.
Instead, they are uniting around a new strategy for progress: the extension of state citizenship to millions of noncitizen residents.
New York is at the forefront of this national effort.
Legislation called the New York is Home Act, recently introduced by state Sen. Gustavo Rivera and Assembly Member Karim Camara, would extend the full rights and responsibilities of state citizenship to nearly 3 million non-citizens who meet very specific criteria and apply through New York's Office for New Americans.
Earlier this week, Senate Republicans, aware of their political vulnerabilities this election season, launched a thinly-veiled fear-mongering campaign over the legislation. They are trying to turn a commonsense legislative proposal into a wedge issue and divide Democrats in the process.
Gov. Andrew Cuomo, Senate Democrats, and progressive leaders like New York City Mayor Bill de Blasio should not take the bait. Instead, they should rally around this legislation, and recognize how sensible and pragmatic it is.
Today, as in the past, New York is home to many immigrants who make valuable contributions to the communities where they live and work.
From Buffalo to the Bronx, non-citizen residents overwhelmingly want the same things as native-born New York residents: good schools, decent jobs, safe neighborhoods, economic security, and real opportunities for inclusion and advancement.
According to the New York is Home Act, non-citizen residents who can show proof of identity, three years of residency, tax payments, and a commitment to follow the law and serve on juries would be eligible to become state citizens.
To non-citizen residents who meet those specific criteria, access to the following benefits would be granted: financial aid for higher education, health care, drivers' licenses, professional licenses, the right to vote, the right to run for office, and complete protection against racial profiling.
The argument for full equality and inclusion of immigrant residents is that state citizenship should recognize and reward the efforts of noncitizens who make our communities stronger.
We all stand to gain when everyone who calls New York home is treated as a real contributor to the greatness of our state. By the same token, viewing immigrants as expendable, exploitable and deportable hurts us all and undermines our shared values.
What happens in New York with this legislation is being closely watched around the country, especially in states like Oregon, California, Illinois, and New Jersey, where efforts to introduce and pass similar legislation are gaining traction because of Washington's failure on immigration.
The New York is Home Act would enable the full and equal participation of immigrants in all activities that define our democracy and economy.
It respects the federal government's authority over federal immigration, while asserting New York's authority to define its state citizenry and the beneficiaries of state citizenship.
State laws around the country have long excluded non-citizens from voting rights, higher education, health care, drivers' licenses, and professional licenses. This exclusion is a loss for all of us, because it limits the ability of immigrants to participate fully in activities that strengthen the social and economic fabric of our country and advance our common interests as Americans.
It's time to promote full inclusion and equality for all.
Taking all the necessary political steps to get this done in New York will be a challenge, but with a reunified Democratic state Senate and leadership from Cuomo, it can happen.
We should set a clear example for the nation and create a model for other states to follow.
Through the expansion of state citizenship, non-citizens can exercise greater economic and political power on behalf of everyone, and do more to help our entire state and country grow, thrive, and prosper. New York is the only home many noncitizen residents have ever known.
Now is the moment to start counting and respecting these New Yorkers as real citizens.
