For the undocumented, life looks different outside a sanctuary city

The marker between two territories is not just a line on a map. Norma Casimiro knows this all too well. Seventeen years ago, she left her home state of Morelos, Mexico, with a young son. Since then, she has lived in Westbury, New York, a suburban town in Nassau County with a population of just over 15,000. She lives in a studio in a sublet single-family home with her husband, who is also undocumented, and their eight-year-old daughter who was born in the United States.
Now, in the aftermath of the presidential election, Casimiro is anxious. Westbury is 11 miles from Queens, which means 11 miles from the protections that a so-called "sanctuary city" offers undocumented immigrants.
"We’ve never really considered moving to the city because we have jobs here and we feel as if we’re a part of the community," Casimiro said. "But it does sometimes cross our minds because of what could happen after January 20."
She knows that New York City would provide better public services for her and her family. "You can feel safer over there," she said, "especially after I heard Mayor (Bill) De Blasio say he would defend all New Yorkers, regardless of their immigration situation."
Living in the middle-class suburbs comes with a number of everyday difficulties, like limited transportation, scant social programs and high cost of living. Now, Casimiro feels even more vulnerable, anxious over the president-elect’s campaign threat to deport millions of undocumented immigrants. She also lives in fear that Trump’s anti-immigration policies may leave her son without the benefits of DACA (Deferred Action for Childhood Arrivals), a type of administrative relief from deportation created during the Obama administration.
Since the election, she's perceived a change in the way people in the community look at her. "I have noticed some disapproving looks that left me with a bad taste," she said. "In Westbury, there are more Latinos than in other parts of the island and you feel safer. But I still feel afraid of going to some stores alone."
She and her family know that Westbury law enforcement has collaborated with the US Immigration and Customs Enforcement (ICE) in the past. That's why the family generally avoids any type of conflict and rarely goes out at night.
Once, Casimiro had an incident while cleaning a house in the area, which left her shaken.
“I was taking the trash out ... and the alarm went off in the neighbor’s home," she said. "The police cornered me and asked me lots of questions. They asked for my ID. I wish I had one of those IDs they give out in New York. I told them I didn’t have it on me because the owner had brought me in her car. Luckily, the babysitter, who speaks good English, came and intervened on my behalf."
In 2014, the Nassau Sheriff’s Department ceased cooperation with ICE and stopped holding immigrants in jail for longer than allowed by law. The Sheriff’s Department also adopted a set of recommendations, such as that agents not ask anyone about their immigration status.
The organization Make The Road New York explains the difference between living in a city or the suburbs. "The very structure of a city offers more protection because of the existence of public transportation, a more dense population and lots of diversity," organizer Natalia Aristizabal said. "The mere fact of being surrounded by neighbors in an apartment building makes people feel safer than living in an isolated house."
New York City offers access to social programs and diverse community centers. A policy, passed last year, states that municipal IDs can be used as official identification and to open bank accounts. There are also a number of reliable lawyers for low-income people at risk of being deported.
Legislation also exists in New York that prohibits the Department of Corrections from sharing information about any prisoner with ICE before sentencing. Nor can other law enforcement agencies provide the federal government with any information about the immigration status of New Yorkers.
These protections disappear outside the boundaries of the five boroughs. And Long Island’s geography does not help. Immigrants usually own a car because of the lack of public transport, but driving without a license creates risk. "The racial profiling techniques used in the past to intercept a Latino in a vehicle and automatically report their immigration status are well known," said Walter Barrientos, the lead organizer for Make the Road New York in Long Island. "In some places, measures have been taken to control these actions, but not so much in Nassau."
Scattered infrastructure and lack of diversity facilitate more discrimination. "This isn’t Manhattan," Barrientos said. "It’s really easy to see who does and who doesn’t have papers here. It’s those who drive old cars or are walking towards the train station."
Nassau’s Police Department reported 32 hate crimes in 2015. The department also reports an uptick in these types of attacks since the election. "Over the last few months, our people have clearly seen how there are people who are incorrigible when it comes to expressing who they do not want in their neighborhoods," Barrientos said.
In Nassau, legal advice for immigrants is almost non-existent. So it's difficult to explain, for instance, that pleading guilty to a traffic violation could affect an immigration process. "Any problem with the justice system opens a door to deportation. This is the biggest fear of our community: that Trump’s promise to deport all immigrants with a criminal history may come true."
Ana Maria Archila, co-executive director of the Center for Popular Democracy, said it is important now to find creative ways to defend people against a Trump administration that "seeks to fulfill their promise of harassing immigrants." This includes establishing a network of allies within the community who are "willing to turn their homes into 'sanctuaries' where people can stay and feel safe," she said.
In the meantime, Norma Casimiro waits. In nearly 20 years of living in the United States, she has never felt so insecure about her future and the future of her children. "All we can do is fight so that our voices are heard," she said. "And hope that someday we will enjoy the same protections as those in New York City."

Fed Bank of St. Louis President James Bullard told Bloomberg Radio that the U.S. central bank may begin tightening monetary policy earlier than officials previously expected.
“The evidence is leading toward an earlier increase than would have been in the works earlier this year,” said Bullard. “Labor markets have improved quite a bit relative to what the committee was thinking.”
Bullard spoke after Kansas City Fed President Esther George told Bloomberg Television that broad-based employment gains suggest the U.S. economy is strong enough to withstand higher interest rates. Philadelphia Fed President Charles Plosser, who voted against the Fed’s policy statement last month, told CNBC he’s concerned about the Fed not adjusting policy appropriately.
By contrast, Atlanta Fed President Dennis Lockhart urged more patience, warning in a separate interview with Bloomberg Radio against “moving prematurely and snuffing out some progress.”

Those are among the conclusions of papers being presented at the symposium. Here is a review of their contents, which can be read in full on the Kansas City Fed’s website.
Robots and computers don’t steal as many jobs as some believe, and automation actually benefits many workers, Massachusetts Institute of Technology Professor David Autor said in his paper.
A key reason humans aren’t obsolete yet is that simple tasks such as visually identifying a chair, which any child can do, aren’t so easy for engineers to teach to computers, Autor said.
“Journalists and expert commentators overstate the extent of machine substitution for human labor and ignore the strong complementarities that increase productivity, raise earnings, and augment demand for skilled labor,” he wrote. “Challenges to substituting machines for workers in tasks requiring flexibility, judgment, and common sense remain immense.”

The U.S. labor market became less fluid in recent decades partly because of an aging workforce, a shift to older businesses, and the spread of occupational licensing and certification, economists Steven J. Davis and John Haltiwanger wrote in their paper.
The economists define labor market fluidity as “flows of jobs and workers across employers.” The paper found the U.S. “underwent a large, broad-based decline in the pace of labor market flows in recent decades.”
“An aging workforce is a factor behind the slowdown of worker reallocation,” the paper said.

U.S. workers in the aftermath of the 2007-2009 recession haven’t experienced unprecedentedly long bouts of non-employment, according to a paper by economists Jae Song and Till von Wachter.
Their findings “suggest that the potential for hysteresis in the aftermath of the Great Recession is moderate,” the paper said. Hysteresis posits that people out of work for too long have a harder time finding work, leading to a persistent decline in the employment-to-population rate

Policy makers would benefit from a better understanding of labor markets, economist Giuseppe Bertola argued in a paper that weighed the impact of rules making those markets rigid or flexible.
Rules that protect workers from job losses and provide more generous unemployment benefits can soften and smooth shocks to the economy, said Bertola.

George opened the symposium late yesterday by putting the presenters on the spot.
The last conference devoted to labor markets was 20 years ago, George told the group of almost 200 as they ate steak and salmon dinners beneath elk antler chandeliers.
The presenters and discussants back then included five future Nobel Prize winners and two academics who would go on to be central bankers: Bank of England Deputy Governor Charles Bean and Stanley Fischer, the Bank of Israel governor who became Fed vice chairman in June. Fischer sat at one of the front tables last night.
“So for those of you that will be on the program,” George said to laughter, “We’re either setting you up for a blessing or a curse.”
This year’s topic is “Re-Inventing Labor Market Dynamics.” In 1994 it was “Reducing Unemployment: Current Issues and Policy Options.”
George said she went through the 1994 proceedings only to find central bankers and economists are still grappling with some of the same basic issues today.
“I saw that the discussion included things like the decline in demand for low-skilled workers due to technology and the challenge of the long-term unemployment,” George said. “And questions were raised by that symposium, as they are today, about the usefulness of the unemployment rate as a measure of economic slack.”
It reads like a list of the most vexing issues the Fed faces now and will be attempting to tackle today and tomorrow.

Fed Chair Janet Yellen arrived at the dinner to be greeted by about 10 people wearing bright green T-shirts emblazoned with “What Recovery?” and carrying placards with labor market data.
The protesters had traveled to Wyoming to highlight the plight of “struggling workers from around the country” who want the Fed to pursue “full employment that reduces poverty and expands the middle class,” according to the Center for Popular Democracy, a Brooklyn-based organization. The backs of their T-shirts had a graph comparing the performance of wage growth among the top 1 percent and the rest.
Ady Barkan, a staff attorney with the group, spoke briefly with Yellen at the door of the lodge’s Explorers Room. “She said she understands the issues we’re talking about and is doing everything they can,” he said, after she had entered the room.
Yellen has regularly cited weak labor markets as a scourge of the economy she’s trying to boost with easy monetary policy.
Shemethia Butler, who works part time at a McDonald’s Corp. restaurant in Washington, was one of those to make the trip. The 34-year-old said that while she isn’t up on monetary policy, she wants policy makers to know she fears higher interest rates for her and her community. She said she works 25 to 35 hours a week for $9.50 an hour at a job she’s had for just over a year. Before that she was unemployed for two years.
“There’s no recovery,” Butler said. “The economy is broken because there aren’t enough jobs for people like me.”

Yellen’s speech will be the main event of the first full day of the conference. She will speak at 8 a.m. Mountain Time today.
Her address will be followed by the presentation of the paper by Davis and Haltiwanger.
Autor will then discuss job polarization before a panel on demographics featuring Karen Eggleston of Stanford University, David Lam of the University of Michigan and Ronald Lee of the University of California, Berkeley.
European Central Bank President Mario Draghi will deliver the keynote luncheon speech.
Tomorrow, Von Wachter and then Bertola will present their papers.
The final panel will provide an overview of labor markets and monetary policy. It will include Bank of England Deputy Governor Ben Broadbent, Bank of Japan Governor Haruhiko Kuroda and Brazilian central bank chief Alexandre Tombini.

The conference is lacking Wall Street participants for the first time.
An exception is Jacob Frenkel, chairman of JPMorgan Chase International, who is attending in his capacity of chairman of the board of trustees of the Group of 30, a private-sector group of mainly former policy makers which advises central banks and governments. Tim Adams, president of the Institute of International Finance, is also present.
Draghi, Kuroda and Bank of Canada Governor Stephen Poloz provide international central banking firepower.
Among academics in attendance are Alan Blinder of Princeton University, Harvard University’s Kenneth Rogoff and Martin Feldstein, and John Taylor of Stanford University. President Barack Obama’s administration is represented by Jason Furman, chairman of the Council of Economic Advisers and Jeffrey Zients, director of the National Economic Council.

The backdrop for the symposium and Yellen’s speech was set by the release of the minutes from the Federal Open Market Committee’s July discussions.
Fed officials in July raised the possibility they might raise rates sooner than anticipated, as they neared agreement on an exit strategy. Some participants were “increasingly uncomfortable” with the pledge to keep interest rates low for a “considerable period,” the minutes said.
At the same time, “many participants” still saw “a larger gap between current labor market conditions and those consistent with their assessments of normal levels of labor utilization.”

The opening day of Jackson Hole has been associated with stock-market gains in each of the past seven years. The Standard & Poor’s 500 Index rose an average 1.3 percent on each of them from 2007 to 2012, following speeches by then-Chairman Ben S. Bernanke, who skipped last year’s conference.
The biggest climb was the 1.9 percent of 2009, when Bernanke said the economy appeared to be “leveling out.” Gains also followed his signals of 2010 and 2012 that fresh asset-purchases were imminent.
The bar is therefore set high for Yellen who identifies slack labor markets as a reason for easy monetary policy. Economist Ed Yardeni says the “Fairy Godmother of the Bull Market” won’t let us down.
Still, Steven Englander of Citigroup Inc. says that because “dovishness is increasingly anticipated,” Yellen may have to intensify her support for low interest rates if risk-assets such as stocks are to rally anew.

WNYC - November 20, 2013, by John Hockenberry - Fifty years ago, in a case called Gideon v. Wainwright, the Supreme Court mandated that those accused of a crime must be provided a lawyer, regardless of their ability to pay. With that decision the public defense system was born.
While Gideon has changed the equation for many indigent defendants, the law doesn't apply to all cases—just those in criminal court. Immigrants facing detention or deportation have no right to a court-appointed attorney and are left to advocate for themselves. In New York, at least 60 percent of detained immigrants lack access to counsel during their immigration proceedings.
But the New York Immigrant Family Unity Project is looking change that.
With funding from the New York City Council and Cardozo Law School in Manhattan, the Project—the first of its kind in the country—provides indigent immigrants representation in detention and deportation proceedings, regardless of whether they can pay.
The Project is the result of a task force of attorneys, activists and experts, chaired by Judge Robert Katzman, chief judge of the U.S. Second Circuit Court of Appeals.
According to the task force, immigrants facing deportation in New York courts that have the help of an attorney are 500 percent more likely to win their case than those who lack counsel. Judge Katzmann says he hopes the Immigrant Family Unity Project will allow more immigrants access to justice, while helping immigrant families to stay together.

Hillary Clinton is the latest voice calling for changes at the Federal Reserve.
A spokesman for the front-runner for the Democratic presidential nomination released a statement Thursday saying that the Fed “needs to be more representative of America as a whole” and arguing that “commonsense reforms -- like getting bankers off the boards of regional Federal Reserve banks -- are long overdue.”
The statement, sent by Clinton spokesman Jesse Ferguson and first reported by the Washington Post, comes as Democrats unleash a volley of criticism against the central bank. Earlier on Thursday, lawmakers called for more consideration of African American, Latino and female candidates for top Fed posts in a letter to Chair Janet Yellen. The missive was signed by a majority of the Democratic members of Congress.
Clinton’s position garnered praise from the union-backed Fed Up coalition, which coordinated the congressional letter.
The campaign’s comment also partly echoed a proposal that Fed Up put out last week, in which former Fed economist Andrew Levin suggested structural reforms for the central bank. Levin argued that the Fed should be made a more public institution.
Currently, regional reserve bank boards have nine directors: six are elected by member banks, with three representing commercial banks and three representing the public. The final three directors are appointed by the Board of Governors in Washington, and are also meant to represent the public.
Bank Control
That means two-thirds of the board seats at the 12 regional Fed banks are controlled by commercial banks, Levin wrote, saying that the directors should instead be affiliated with small businesses and non-profit organizations and selected through a “process overseen by the Federal Reserve Board and involving the elected officials in each Fed district.”
“The process should ensure that directors are representative of the public in terms of racial/ethnic and gender diversity and educational background and professional experience,” Levin wrote.
Esther George, president of the Kansas City Fed, said Thursday that “diversity for the Federal Reserve is critical,” and that progress has been made both at the board of directors and at the staff level in making sure the Fed reflects the communities that it serves.
Preserving Independence
Richmond Fed President Jeffrey Lacker pushed back against proposals to make the Fed more public in an article posted Thursday. He said the regional branches’ hybrid governance structure “has come to play an important role in the independence of monetary policy” and “independence allows monetary policy to place greater weight on the long-term benefits of low and stable inflation.”
“The current Fed governance structure may not be ideal,” Lacker wrote. “But until there is a proposal that preserves the monetary policy independence that is so vital to the Fed’s mandate, we should stick to what we have.”
While there have been various Congressional attempts at shaking up Fed structure in recent years, those have made little headway. For instance, Republican Senator Richard Shelby proposed a bill last year that would have tweaked the New York Fed, making its leader a presidential appointee, among other changes, but it never passed.
Donald Trump, the presumptive Republican presidential nominee, has also weighed in on the Fed in recent days. On CNBC last week, Trump said that he’s a “low-interest” person and that he would replace Yellen when her term ends.

After A Wave Of Bad Press, This Controversial Software Company Is Making Changes

In April, the New York attorney general’s office launched an investigation into the scheduling practices of 13 national retail chains, distributing a letter to the Gap, Target, J.C. Penney, and 10 other companies. The letter asked, among other things, whether these companies’ store managers use software manufactured by a company called Kronos to algorithmically generate schedules.
A few months later, Kronos was also featured prominently in an article published by the New York Times about the ill effects of erratic scheduling on Starbucks employees, especially one particular family. In a follow-up piece, the author, Jodi Kantor, points directly to Kronos’ scheduling software as the root of the problem. “I saw that her life was coming apart and that the Starbucks software had contributed to the crisis,” Kantor wrote of one of the story’s subjects.
The piece’s argument centered around the financial and scheduling unpredictability engendered by platforms like Kronos. When you don’t know if your shift might be canceled, if or when you’ll be called in, or what your hours will look like next week or the week after, it becomes very difficult to make even the most basic plans for your future. This can have devastating long-term financial and emotional impacts on workers. According to a recent study by the Economic Policy Institute, a left-leaning think tank in Washington, D.C., 17 percent of the American workforce is negatively affected by unstable schedules.
For their part, Kronos representatives argue that the algorithm is far from the root of the problem. “The populist view is that scheduling is evil, in that it’s causing erratic schedules for employees, and so forth,” Charlie DeWitt, vice president of business development for Kronos, told BuzzFeed News. “The fact of the matter is it’s an algorithm. It does whatever you want it to do.”
And you don’t necessarily need to work for Kronos to believe that in a competitive retail climate, the problem is more complicated than technology alone. Lonnie Golden, a Penn State economist who has extensively studied the impact of erratic scheduling, acknowledges that Kronos’ product itself is less to blame than the managers who make staffing decisions based on the data it provides. “It’s not necessarily the technology that’s responsible for minimum to no advance notice,” he said. “It’s the way in which it’s applied.”
But, he added, “where there’s a technology problem, there’s usually a technology solution.” And while Kronos maintains that managers, and not the software, are responsible for early dismissals and last-minute shift cancellations, the company is nonetheless pursuing some technological solutions.
Kronos wants to help managers better understand how scheduling adjustments affect workers and, ultimately, the bottom line. Though the company maintains that its software doesn’t produce the kind of erratic schedules that hurt wage workers, DeWitt said there was nonetheless an interest in figuring out why that perception existed — and, if possible, fixing it.
To that end, earlier this month at a retail conference in Philadelphia, the company announced that it’s working on a new plug-in that will give managers better insight into workers’ schedule stability, equity of hours worked among employees, and the consistency of schedules from week to week. In addition, Kronos is improving a feature meant to help give employees more control over their schedules: Though the software already incorporates employee availability and preferences into its scheduling calculations, improvements to a shift-swapping feature on its employee-facing web and mobile apps will theoretically allow employees to work around conflicts among themselves.
Golden said increased employee input and control would be a good thing. But some retailers, DeWitt pointed out, are uncomfortable making workers use an app outside of work hours; indeed, the practice could be seen as a shift of management responsibilities onto lower-paid individuals.
Part of the idea behind the new Kronos plug-in is to help companies tie fairer scheduling practices to reduction in absenteeism and turnover, which can be enormously costly. In other words, if Kronos can help executives see the connection between treating workers fairly and a store’s ability to increase revenue, DeWitt said, managers will have an impetus to create more predictable, stable schedules.
And just because companies are looking at this kind of data doesn’t mean they have to use it. “Companies like Kronos and Workplace Systems are starting to integrate some of these principles into their software,” said Carrie Gleason, director of the Fair Workweek Initiative at the Center for Popular Democracy, “but it’s all optional, so companies can decide not to do it.” While 12 states are currently considering legislation that would create new labor standards around the workweek, Gleason said the technology alone lacks a mechanism for enforcement.
Given market pressures and standard management practices, it’s unlikely that any change to Kronos’ technology would give workers more power — especially because, given the competitive retail climate at the moment, the bottom line tends to be the priority. “It’s not just bad managers. They have extreme pressure to increase productivity on an ever-shrinking labor budget,” Gleason said.
With these changes, Kronos has taken logical steps toward both repairing its reputation and making sure its software creates sustainable work environments. But while the company cannot control exactly how the algorithm that forecasts schedules and optimizes workforces is deployed inside different workplaces, the Kronos engineers who designed the product are nonetheless the partial architects of work environments that have been proven to be untenable for low-wage workers. The Kronos scheduling algorithm isn’t designed to serve those people; it’s designed to be sold to their bosses, and as such, will ultimately be shaped to serve the needs of management — until regulations exist that compel them to change how it’s used.

Starbucks employees say their schedules aren’t nearly as sweet as those pumpkin spice lattes they’re serving up this fall.
In a new report from the Center for Popular Democracy, a nonprofit that works with community groups, Starbucks workers said the coffee company has failed over the past year to make good on a promise to improve employees’ schedules. Instead, employees said they still face unpredictable workweeks, obstacles to taking sick leave, insufficient rest and staffing, and a failure to honor their availability.
“Starbucks’ frontline employees bear the brunt of the management imperative to minimize store labor costs, which takes precedence over attempts to stabilize work hours, provide healthy schedules, and to ensure employees have real input into their working conditions,” the report states.
The issues detailed in the report are familiar to anyone to many who work on “non-standard” schedules common among low wage jobs.
Starbucks first came under fire after a New York Times article from August 2014 described the struggle of a Starbucks barista and single mother, whose irregular work schedule caused turbulence in her personal relationships, other jobs and parental routine. The source of such chaos was supposedly Starbucks’s sophisticated scheduling software that cuts labor costs by arranging workers’ weeks based on sales patterns.
While this technology can boost a business’s profits, it can also leave workers working back-to-back shifts (also known as ‘clopening’), or not receiving enough hours to make ends meet. Sometimes, as the Timesarticle pointed out, employees would commute to work just to find their schedule changed.
After the public backlash, Starbucks promised to revise its policies and end the irregular scheduling practices for its roughly 130,000 baristas in the U.S.
To achieve this, Starbucks said it would post all work hours 10 days in advance, and give any baristas with more than an hour long commute the option to transfer to a more convenient location. Starbucks also said it would revise the scheduling technology and kill the clopening shift.
But much has remained unchanged, according to the 200 workers across 37 states the Center for Popular Democracy interviewed.
Nearly half of the surveyed Starbucks employees said they received their schedule one week or less in advance, and one in four workers said they still had to work clopening shifts.
Employees also reported feeling as though managers disregarded their availability, and denied them more hours when they needed additional work. Finally, 40 percent of employees said they faced barriers to taking sick leave when they were ill.
None of this seems to fit with Starbucks’s reputation as a “fabulous company” to work for, as jobs and recruiting website Glassdoor described it in its annual ranking of the 50 best places to work in 2014. Starbucks came in at No. 39.
The Center for Popular Democracy’s report did have some suggestions for improvement, however, recommending that Starbucks guarantee minimum hours and full-time work for those who want it. It also said the company should mandate that managers provide predictable schedules so working families can have a more stable work-life balance, in addition to taking the pressure off sick employees to find a replacement for a shift.
