Newark, N.J.’s refusal to detain undocumented immigrants for minor offenses could serve as an olive branch to the immigrant community.
As of last month, the Newark, New Jersey police department is no longer taking orders from Immigration and Customs Enforcement (ICE) to detain undocumented immigrants who have been picked up for minor criminal offenses such as shoplifting or vandalism.
The policy was signed into law by Newark Police Director Samuel DeMaio on July 24.
Newark may be the first and only law enforcement agency in New Jersey no longer to honor detainer requests from ICE, but it’s far from the only police department in the country to have done so. Police departments in Los Angeles, the District of Columbia, Chicago, New York City and New Orleans have also implemented policies stating they won’t honor ICE detainer requests.
The policy change was applauded by civil rights and faith leaders, who say the detainers — which allow law enforcement to hold in custody for up to 48 hours, without a warrant, those whose immigration status is in question — discourage communities of immigrants and law enforcement officials from having a cooperative relationship.
Immigrant-rights advocates said they view the new police protocol as an olive branch to undocumented people living in the U.S., who may be hesitant to cooperate with police officers who are investigating crimes in the community for fear they may be deported. New Jersey reportedly has one of the largest immigrant populations in the nation.
“Law enforcement officials across the country have recognized that local police officers should not be in the business of federal immigration enforcement,” said Udi Ofer, executive director of the American Civil Liberties Union (ACLU) of New Jersey, which advocated for the policy shift.
“With this new policy in place, the Newark Police Department has made it clear that all residents, regardless of their immigration status, are safe to cooperate with the police,” Ofer continued in the release. “This policy ensures that if you’re a victim of a crime, or have witnessed a crime, you can contact the police without having to fear deportation. This will make all Newarkers safer.”
Emily Tucker is an attorney at the Center for Popular Democracy. She said the group was “thrilled that Newark is standing in solidarity with immigrant families by rejecting all future collaboration with the federal deportation apparatus.
“Spending local tax dollars to take parents away from their children and workers away from their jobs is both morally wrong and bad for the economy,” Tucker said. “We hope the Newark policy will serve as a model for the rest of New Jersey, and for cities around the country who don’t want local resources being spent to help ICE meet its arbitrary enforcement quotas.”
New Jersey to New Orleans to Los Angeles
The New York Times recently published an editorial applauding those cities that have announced they will no longer be cooperating with ICE’s detainer requests and encouraged other cities to follow suit.
“The federal dragnet that makes little distinction between tamale sellers and dangerous criminals — greatly expanded by the use of local law enforcement officials across the country — has been ensnaring record numbers of minor offenders,” the editorial board wrote. “This melding of local crime fighting and immigration enforcement has led to unjust imprisonment, policing abuses, racial profiling and paralyzing fear in immigrant communities.
“The damage to public safety is measurable; a recent study by researchers at the University of Illinois at Chicago found that Latinos, both immigrants and native-born, often shun the police and are reluctant to cooperate with criminal investigations. Combating domestic violence, sexual abuse and gang-related crimes becomes far more difficult when local cops are de facto federal agents.”
Amy Gottlieb, director of the American Friends Service Committee, said she hoped other law enforcement agencies would implement similar policies, adding that “any detainer policy where people are aware that the police department is acting in support of the immigrant community is going to be helpful for police and immigrant relations.”
While Newark officers will no longer hold persons in an immigration detention center for committing a minor-level offense, the Newark Police Department will still report information to ICE after arresting an individual and also will continue to share fingerprint information with federal investigators.
“If we arrest somebody for a disorderly persons offense and we get a detainer request, we’re not going to hold them in our cell block,” DeMaio said. “I don’t know if we’ve ever gotten a detainer request on a guy with a misdemeanor,” adding that the department received a total of eight detainer requests in 2012.
Helpful or harmful to a city’s crime fighters?
While California Gov. Jerry Brown (D) has said he would sign legislation limiting who state and local law enforcement officials can hold for deportation, and while Connecticut’s legislature unanimously passed similar legislation, not everyone thinks the policy is a good idea.
Republican U.S. Senate candidate Steve Lonegan, for example, called the policy “another in a long line of missteps” by his opponent, Newark Mayor Cory Booker (D), saying the new policy will only lead to an increase in crime.
“We’re sending a signal,” he said, that “you can come to the country illegally, you can shoplift, you can vandalize but it’s alright. We’re going to make sure you’re safe. It’s a great message to our kids.”
Kevin Griffs, a spokesman for the Booker campaign, said Lonegan’s understanding of the policy was inaccurate and explained that “all serious offenders obviously go to the county jail, and ultimately, the mayor’s thinking was that this was going to improve relations between the police department and the immigrant community and help the Newark Police Department catch more of the real bad guys.”
ICE officials have declined to comment on the policy change.

· Far greater provisions for transparency in the sale process
· A commitment to work with local governments and non-profits on targeted sales
These reforms come on the heels of an aggressive community pressure campaign, led by local elected officials affiliated with Local Progress, a national network of progressive elected leaders, and community groups affiliated with the Center for Popular Democracy.
The East Orange City Council passed a resolution sponsored by First Ward Councilman Christopher James in April 2016 calling on HUD to make reforms along these lines. In September of 2015, Councilman James traveled to Washington, D.C. to join others in meeting with top officials at HUD about this issue.
“This is one giant step in the right direction toward helping residents get back on their feet and rebuilding our communities,” said James. “Mutual understanding of the process and greater transparency will allow us to assist our residents in avoiding foreclosure.” As a city, East Orange has taken aggressive steps to reduce the lingering impact of the foreclosure crisis in its neighborhoods.
“My administration, with the support of the City Council, has taken progressive action to address the foreclosure crisis and stabilize our neighborhoods. In November 2014, we established a Division of Vacant and Abandoned Properties solely dedicated to identifying, registering and collecting fees and fines from agencies, such as banks and other creditors, who violate our city code,” said Mayor Lester E. Taylor III. “With these new reforms, we continue to take advantage of every opportunity – including the enforcement of new state laws – that will help us to revitalize our city, boost property values and restore community pride.”
Last summer, Local Progress members led a successful effort to get a resolution passed at the June meeting of the U.S. Conference of Mayors, calling on HUD to prioritize selling these troubled mortgages to mission-driven purchasers, not Wall Street speculators.
With public events, reports and lobbying, these leaders put HUD, and specifically its head Secretary Julián Castro, in the spotlight for running a program that has been benefitting Wall Street at the expense of communities. HUD’s “Distressed Asset Sales Program” (DASP) has been conducting bulk auctions of delinquent mortgages to the highest bidder, which has meant 98% of these troubled mortgages have been sold to Wall Street speculators. Local elected leaders and stakeholders now plan to make sure that HUD sells delinquent mortgage pools to mission-driven purchasers.
The persistence of local elected officials and community groups has paid off, and the major changes announced last week are proof of their hard work. This campaign proved particularly timely as prominent Wall Street speculator Blackstone has recently become the largest single family landlord in the country. With more homes in the hands of non-profits instead of Wall Street speculators, communities will gain further control over their neighborhoods and be less at the mercy of Wall Street. Leaders from the Center for Popular Democracy and Local Progress plan to continue to apply direct pressure on HUD on this issue, and continue the fight for housing justice and community control to strengthen and protect neighborhoods across the country.

The Morning News recently sent out a questionnaire to the candidates running for the Florence School District One Board of Trustees. Here are the answers from Alexis D. Pipkins, Sr. who is running for another term representing District 4; he faces one challenger.
1. What do you feel you have contributed during your current tenure on the board?
My background as a lifelong resident of the Florence Community, and working closely within the region has given me a clear sense of both the educational and economic issues and needs that we face. Over the past 15 years, as a member of the Florence School District 1 Board of Trustees, I have ensured that I have been knowledgeable of the issues, needs, and concerns of my constituents, and I have represented and I have been a voice even during turbulent of challenges. Further, I understand that leadership must be politically astute to represent the views and concerns of those you represent even though others may not agree, or do not care, and only want to advance their own agenda that is only best for “their community” and not all communities. I have attained the Level 6 on the SCSBA, which is the highest level for a school board member, and presently I serve as the President of the SC Caucus of Black School Board Members which provides dialogue on educational issues and concerns to address the full growth and development of Black and other minority children, and I am also affiliated with the National Local Progress Movement which focuses on progressive thought and insight for local officials
2. What are the issues that you think need to be addressed?
Student achievement, and recognizing the individuality and creativity of each student’s needs
Recognizing that the public schools are becoming more diverse
Equity in funding for all schools
Special Education
Technology infusion and integration for all students
Early Childhood
Career Clusters and Pathways- which is more opportunities for expansion of vocational and career center programs
Funding throughout the district
Special Education and meeting the diverse needs of students, to include the increase diagnosis of Autism
Impact of poverty, mental health, and other risk factors have on today’s learners
Lack of teachers
New and innovative approaches to teacher development and recruitment in order to develop and retain a diverse, qualified, and effective 21st Century pool of educators and staff
3. How have you sought to make changes in those areas?
By asking for items to be placed on the agenda, and engaging staff and others throughout the state and country on best practices and promising practices to ensure that we are utilizing the best program for all of our children. Also, researching the issues and knowing the national agenda. I have always committed myself to being engaged and welcoming to constituents and having a listening ear to see what the children are saying and feeling. As an educator and advocate for children and families, I always empathize and evaluate how I would feel when making decisions and question if policies or procedures that are guiding discussion or the direction of the Board are relevant today. I have demonstrated that my approach to knowing what the educational needs and issues are not based on perception or a one way train rail.
4. What specific program are you most proud of in FSD1 and why?
Small Learning Communities at our schools to decrease class sizes
Implementation of the Parents As Teachers Program to address 0-3, to provide parents with skills and supports to ensure that their children are ready to enter school
Montessori which provides learners the opportunity to be creative
Career and Technology which provides students the opportunity to enter the work place upon graduation
The work that was done by the previous Discipline Code Committees which has ensured the district recognized inequalities and unfair discipline practices and the underutilization and non-utilization of support services for students with complex needs and behaviors. This dialogue that I led was the foundation for the present Code of Conduct which will have to be assessed over the next few years to evaluate its effectiveness and impact on student learning and behavior.

5. How do you handle inquiries and complaints from the community?
I refer families to the Superintendent’s Office or to the appropriate office for support. I also follow-up with families and community that approach me to ensure that their complaints and inquires have been addressed. I also request items be placed on the agenda for discussion and action.
6. What do you think the role of the board is, in the district and in the community?
The board is responsible for establishing the Vision and Mission for the local school district, and ensuring that the Superintendent has the resources to implement the vision by having good policies and procedures, and good stewards of the district’s Operational Funds and Capital or Building Funds. This role must be student centered and family centered by recognizing the diverse needs of students within our community. Not all students learn in the same manner, thus the board must be aware of such and hold the administration accountable for creating programs and services which will help students achieve and be successful. It is the job of the board to be knowledgeable, and current on educational issues and trends, and not just be a “rubber stamping board” but ask questions, communicate with the public- and not just those who share your personal beliefs and positions.
7. What are your past/other areas of service? (church, civic organizations, etc.)
Professional:
I am an advocate, teacher, educator, trainer, and servant-leader. Presently, I am employed as the Executive Director of Lee County First Steps, and the Lee County Adult Education Family Literacy Coordinator.

Atlas Left - May 24, 2014, by Josh Kilburn - The House of Representatives recently passed a bill that would grant $3 million in taxpayer money to charter schools; schools that both Democrats and Republicans are lining up behind. In the wake of this, Ring of Fire took a critical eye to some of the rampant abuses in the system with guest and Bill Moyers.com senior digital producer, Joshua Hollands, present to help explain what it meant.
While discussing how abused the system is, Joshua Holland referenced a report by Integrity in Education and the Center for Popular Democracy in regards to the systematic abuse and waste in charter schools:
[They found] in fifteen states, just fifteen states they looked at, they found $140 million dollars in public funds that were lost to fraud, waste, and abuse . . . This is all taxpayer money, so, that’s right. What they found, for example, was using public education dollars, these private operators were using them to prop up other businesses. There was an incident where somebody was feeding these public dollars into their health food store. In another instance, there was somebody who was using these dollars to make repairs on their apartment complex that they’d rented out. This again is somewhat unsurprising given that you have such limited oversight.And the reason for that limited oversight? Charter schools try to have it both ways; when it comes to public money, they’re suddenly public institutions. When it comes to public oversight, they change the color of their scales and become private institutions with “proprietary secrets.”
There are other problems as well; charter school teachers are paid less than public school teachers, administrations are paid more, and they’re less likely to be unionized than public school teachers. And that’s the union busing angle: the private sector unionization is at an all time low — only 7%. The majority of unionized workers are in the public sector, which is what the big businesses are targeting in an systematic, widespread anti-union, anti-worker putsch to restore our nation to the gilded glory days of the 1870s and 1880s.
Our public schools are not the problem. In wealthy districts, the public schools are top in the world as far as reading, writing, and other testing goes. It’s only in the poorer districts, where childhood poverty is rampant, that we find the lower numbers pulling down the average. Since “we tolerate a high level of childhood poverty relative to other nations,” in the words of Joshua Holland, and poor children don’t preform as well as their wealthy counterparts do, low test scores should come as no surprise. Out of 35 nations tested, the United States rates 34 in child poverty; the only country below us is Romania. And until we do something about the rampant poverty, instead of blaming it on the teachers, the problem won’t be going away.

Starbucks officials asked store managers to "go the extra mile" to improve employee scheduling in the aftermath of a scathing report issued by an advocacy group this week.
The nonprofit Center for Popular Democracy alleged that the company largely failed to deliver on its promises to alter scheduling practices in 2014.
More than a year ago, a New York Times report chronicled the havoc wreaked on Starbucks' baristas by its sophisticated scheduling technology.
In response, the coffeehouse giant vowed to establish more consistent hours, provide more notice regarding schedules and prevent workers who close stores from having to reopen again just hours later.
According to the CPD report, however, nearly half of 200 employees surveyed reported receiving schedules with one week or less of notice.
Employees also said that although schedules generally followed the previous week's pattern, dramatic fluctuations could happen in any week.
One in four respondents, meanwhile, said that either they or their coworkers still were scheduled to "clopen" stores.
"Many Starbucks scheduling policies fail to reflect the company’s human-focused values, while other policies designed to promote sustainable schedules have been implemented inconsistently," the group wrote in the report.
Company spokeswoman Jamie Riley told the Times this week that the CPD report "doesn’t align with what we’re seeing," but that the company is "the first to admit we have work to do."
Meanwhile, Cliff Burrows, Starbucks’ U.S. chief, responded with a memo to store managers calling for a "consistent schedule — free of back-to-back close and open shifts that are less than 8 hours apart — that is posted 2 weeks in advance."

Por eso la crisis de ejecuciones hipotecarias fue tan difícil, en especial para los latinos y las personas de raza negra. Significó que su patrimonio, en ocasiones acumulado por varias generaciones, desapareció casi instantáneamente.
Ambos recordamos claramente las difíciles conversaciones que tuvimos con vecinos que pasaban apuros durante el caos. Aquí en Nueva York, como en todas partes, a pesar de que las personas de color no constituían la mayoría de los propietarios de vivienda, se veían afectadas por las ejecuciones hipotecarias con mayor frecuencia. Eso significó que al perder su patrimonio, más y más de ellos se fueron de la ciudad y nuestros vecindarios cambiaron.
Desafortunadamente, aún estamos viendo los efectos. Una purga lenta que se viene produciendo desde hace años a medida que la ciudad se aburguesa se ha facilitado por las ejecuciones hipotecarias y alquileres cada vez más altos, con los que más familias han dejado de ser propietarias para pasar a ser inquilinas. Muchas familias trabajadoras que han perdido su vivienda ahora además tienen dificultad para alquilar, debido al costo en aumento en el mercado.
Wall Street ha encontrado un socio inverosímil en estos desalojos: el Departamento de Vivienda y Desarrollo Urbano de Estados Unidos (HUD por su sigla en inglés). En todo el país, cientos de miles enfrentan ejecuciones hipotecarias. A pesar de la misión de HUD de “crear comunidades sólidas y sostenibles que incluyan a todos, con viviendas económicas y de calidad”, el departamento ha operado un programa que vende decenas de miles de hogares muy descontados a especuladores de Wall Street.
Cuando los fondos de especulación y firmas inversionistas privadas adquieren estos préstamos, por lo general fuerzan a los propietarios a dejar su vivienda —por medio de ejecuciones hipotecarias o ventas al descubierto (que no cubren las obligaciones hipotecarias) — y luego convierten las residencias en caras propiedades para alquilar, lo que hace que aumenten los precios en todo el vecindario.
En un extraño vuelco del destino, Blackstone Group, una de las más grandes firmas privadas de inversión en el mundo, ahora también es el mayor propietario de casas unifamiliares en alquiler en Estados Unidos. No se trata simplemente de ilusas propuestas por liberales. Cada vez hay más instituciones financieras dedicadas al desarrollo comunitario que han conseguido capital y están listas y dispuestas a adquirir estos préstamos hipotecarios en mora y colaborar con familias en apuros.
Usan la reducción del monto principal debido para ayudar a modificar los préstamos afectados y hacer que los pagos sean más costeables. Cuando es realmente imposible evitar las ejecuciones hipotecarias, estas entidades sin fines de lucro formulan planes para la disposición de las propiedades que toman en cuenta las necesidades de vivienda económica de la comunidad que las rodea.
Estos préstamos hipotecarios en mora están vinculados con los propietarios y las viviendas en apuros en nuestros vecindarios. Vender nuestro inventario residencial a los propios depredadores que los pusieron en esta situación no solo demuestra poca visión de futuro, sino que daña nuestras comunidades irreparablemente.
Los especuladores de Wall Street se enriquecieron creando la crisis de vivienda que causó estragos en nuestras comunidades. No se debe permitir que vuelvan a enriquecerse aprovechándose de los restos de los vecindarios que ya han destrozado.
