The Jersey Journal - January 24, 2014, by Terrence McDonald - When Jersey City in September 2012 became the first New Jersey municipality to mandate that most private businesses provide paid sick leave for its workers, Mayor Steve Fulop predicted a legal fight.
Four months later, and no lawsuit filed, the measure is now law.
Fulop called today “very exciting.”
“I think it’s going to help tens of thousands of working families in Jersey City,” he said at an event at Saint Peter's University.
Jersey City is the sixth city in the nation to force private businesses to provide paid sick time. The law affects employers with 10 or more workers, and was opposed by state- and countywide business groups.
Paid sick time laws have become a favored cause of liberals and labor unions. Both groups hailed Jersey City when Fulop first proposed the measure last year, and they extolled the city again today.
“This law respects the dignity of workers, protects the public health and will mean savings for businesses big and small. When workers can earn sick days, everybody wins,” said Phyllis Salowe-Kaye, executive director of the New Jersey Citizen Action and spokesperson for the New Jersey Time to Care Coalition.
Other cities that have implemented similar mandates include Washington, D.C., San Francisco and Seattle. New York City, which passed a similar law last year, is set to strengthen it under its new, more liberal mayor.
Business groups have opposed the mandate wherever it's been implemented, but in San Francisco, which in 2006 became the first in the nation to require paid sick leave, thanks to a voter referendum, some who opposed the requirement subsequently said it hadn't affected businesses much, if at all.
An audit in Washington, D.C., found the law had not led to fewer businesses opening, though local businesses owners said they had cut back on hours.
Michael Egenton, a senior vice president at the New Jersey Chamber of Commerce, fears that paid sick leave, together with new health-care regulations and the state’s new minimum-wage increase, could convince businesses to relocate.
Egenton also expressed concern about local governments implementing these types of regulations.
“Whatever happened to the freedom of enterprise?” he said today, adding that he believes business owners will reward employees with benefits like paid sick time even if the government doesn’t force them to.
“If you’re a good worker, your boss will give you sick time,” Egenton said.

Annapolis, MD – A voting rights coalition recognized the Maryland General Assembly for passing the Freedom to Vote Act, legislation that will ease the path to voting while cutting red tape for Maryland citizens. The coalition includes partners such as Demos, the Center for Popular Democracy, Maryland Working Families, Casa de Maryland and Maryland Communities United.
“Demos recognizes the Maryland General Assembly for continuing to push forward common‑sense practices of voter modernization that are being embraced around the country,” said Damon Daniels, Campaigns and Outreach Associate for Demos.
“Maryland has taken a step forward today. The legislation will modernize the voting process and work to make Maryland’s democratic system more accessible and inclusive,” said Emma Greenman, Director of Voting Rights and Democracy at the Center for Popular Democracy.
The coalition partners said that while this bill expands voter registration opportunities for Marylanders, they are disappointed that Automatic Voter Registration (AVR), proposed in this measure and in Senate Bill 350, was excluded from the final legislation. The AVR provision called for the Maryland State Board of Elections to use relevant information provided to government agencies to automatically add eligible individuals to the voter rolls, unless they declined to be registered.
“Automatic Voter Registration could potentially add tens of thousands of newly eligible voters into Maryland elections, emphasizing an enhanced and inclusive approach to increasing voter participation while also protecting the rights of those who choose to refrain from the process. Its strength lies in its potential to transfer the responsibility of voter registration to the government, saving time and money while also providing the strongest opportunity to address current race and income gaps in voter turnout,” said Charly Carter, Executive Director of Maryland Working Families.
“We are grateful for the work of Senator Roger Manno and Delegate Eric Luedtke for introducing Automatic Voter Registration, and look forward to working with Maryland leadership and the Board of Elections to assess ways that we can continue to improve voter access in Maryland, especially for those who remain underrepresented in our electorate,” said Yaheiry Mora, Advocacy and Elections Specialist of Casa de Maryland. “We hope that Maryland will lead the national effort to let all eligible voters participate in the political process, and urge Gov. New York Families Win $15 Minimum Wage
Today, the New York Wage Board recommended a $15 minimum wage for fast food workers. In response the Center for Popular Democracy released the following statement:
“Today’s announcement is a testament to the strength of workers and community organizations committed to fight for what’s right,” said Tony Perlstein, co-director of campaigns at the Center for Popular Democracy. “Our communities are tearing down barriers that keep us from sustaining our families, and today we see the fruit of their labor. The fight for $15 is stronger, and workers limited to part-time jobs scored an important victory.”

Bill Moyers & Company - April 9, 2015, by Katie Rose Quandt - Front-line workers at our nation’s big banks — tellers, loan interviewers and customer service representatives — are required by their employers to exploit customers, according to a revealing report out today from the Center for Popular Democracy (CPD). Big banks have internal systems of penalties and rewards that entice employees to push subprime loans and credit cards on customers who would be better off without them.
CPD’s report outlines several illegal predatory practices big banks have been caught employing, usually via their front-line workers:
Blatantly discriminatory lending: In 2011 and 2012, Bank of America and Wells Fargo paid out settlements for charging higher rates and fees to tens of thousands of African American and Hispanic borrowers than to similarly qualified white customers. Minority customers were also more likely to be steered into (more expensive, riskier) subprime mortgages.
Manipulating payment processing to maximize overdraft charges: When a savings account balance drops too low, the bank charges a hefty overdraft fee on each subsequent purchase. Both Bank of America and US Bank paid settlements for intentionally processing customers’ largest debit card payments first, regardless of chronological order, in order to hit $0 faster and maximize overdraft fees. US Bank was also accused of allowing debit card purchases on zero-balance accounts to go through (and incur overdraft fees), instead of denying the charges upfront.
Forcing sale of unneeded products: Wells Fargo, JP Morgan Chase and Citigroup were accused of forcing customers to purchase overpriced property insurance.
Manipulative sales quotas: Lawsuits show Wells Fargo and Bank of America created incentive programs for employees with the interests of the company — not the customer — in mind. Wells Fargo’s sales quotas encouraged bank workers to steer prime-eligible customers to subprime loans, while falsifying other clients’ income information without their knowledge. Bank of America’s “Hustle” program rewarded quantity over quality, encouraging workers to skip processes and checks intended to protect the borrower.
Instead of cutting back on the risky, unethical practices that led to the Great Recession, the CPD report asserts that big banks have not learned from their mistakes. Bank workers report higher levels of sales pressure in 2013 than in 2008, and most do not have the job security or seniority to simply refuse to hawk credit cards or steer customers into risky financial situations. While the financial sector is turning near-record profits, the average bank teller made just $12.25 an hour in 2013 (a real-dollar decrease from 2007), causing 31 percent of tellers’ families to rely on public assistance. What’s more, 85 percent of these underpaid front-line bank employees are women, and one-third are people of color. Most are in no position to risk losing their job or having their pay docked for stepping out of line.
Several anonymous big bank employees went into detail about how their employers incentivize sales:
An HSBC employee reported that when workers fell short of sales goals, the difference was taken out of their paychecks.
A teller at a major bank said she is expected to sell three new checking, savings, or debit card accounts every day. If she falls short, she gets written up.
Customer service representatives at one major bank’s call-center said everyone is expected to make at least 40 percent of the sales of the top seller. Credit card sales count for extra, encouraging callers to push credit cards on customers who would be better served with checking or savings accounts.
A call-center worker said she offers a credit card to every customer, regardless of whether it would be beneficial. She explained: “If you aren’t offering, you can get marked down — the managers and Quality Analysts listen to your call, and can tell if you aren’t offering.”
“We’re not servicing their needs,” said one front-line worker. “What they want, what they need, isn’t important to us. Selling them a product is … Some of our customers just have their savings, many are just retirees.”
As the report concludes, “Our nation’s big banks are committed to a model that jeopardizes our communities and prevents bank employees from having a voice in their workplace.”

Voter registration is the number one barrier to the vote. An estimated 51 million eligible citizens, more than 24 percent of the electorate, could not cast a ballot on Election Day in the 2012 presidential election solely because they had not been registered. Registration and voting rates are particularly low for families with annual incomes below $20,000, voters of color, naturalized citizens, and those with limited English proficiency. Civic engagement levels are even worse in New York State. Fewer New Yorkers registered to vote and cast a ballot in the November 2012 general election than the national average.

One proven method of increasing voter participation, particularly among underrepresented citizens, is voter registration at public agencies (“agency-based registration”). Well-administered voter registration programs established at public assistance agencies pursuant to federal law have helped register 15 to 20 percent of agency applicants. In 2000, New York City sought to expand voter registration opportunities at municipal agencies by enacting Local Law 29 (“the Pro-Voter Law”), which required 18 city agencies and, under certain circumstances, their associated subcontractors, to offer voter registration forms to all persons submitting applications, renewals, or recertification for agency services, or notifying the agency of a change of address. The law included each of the City’s 59 community boards as well. The last and only evaluation of the Pro-Voter Law, undertaken by the New York City Council over a decade ago, found that agencies were failing to offer voter registration.
In 2014, the Center for Popular Democracy, Brennan Center for Justice at NYU School of Law, Citizens Union of the City of New York, and the New York Public Interest Research Group formed the Pro-Voter Law Coalition and launched a new initiative to assess the agencies’ compliance with the law and opportunities to enhance the law’s impact. The Pro-Voter Law Coalition submitted Freedom of Information Law (FOIL) requests to each of the 18 city agencies; met with the Voter Assistance Advisory Committee at the New York City Campaign Finance Board; and, along with the Asian American Legal Defense and Education Fund and Make the Road New York, launched field investigations at 14 city offices subject to the Pro-Voter Law to measure their compliance with the law.
The FOIL responses and field investigations revealed widespread agency failure to implement the Pro-Voter Law. Specifically, they found:
Inconsistent adherence. Documents provided by the 12 agencies that responded to FOIL requests indicated scattered and inconsistent attention to the Pro-Voter Law; Noncompliance in a majority of interactions. In 84 percent of client interactions, agency officials failed to comply with the Pro-Voter Law’s requirement to offer voter registration application forms; Failure to provide language access. Agency failures extended to bilingual voter registration mandates. Specifically, only 40 percent, or 2 out of 5 agency clients whose primary language was not English were given translated voter registration applications; and No training of agency staff. All 11 of the agency employees who responded to training inquiries admitted that no agency staff receive regular training on voter registration procedures.These findings are particularly significant given that over 30 percent, or 18 of 59 citizen clients interviewed at the agencies required to comply with the Pro-Voter Law’s mandates reported they were not registered to vote.
Agency failure to comply with the Pro-Voter Law marks a lost opportunity to increase New York City voter registration rates and, by extension, voter participation in the city. Expanding opportunities for New Yorkers to register to vote at municipal agencies will require a concerted commitment by the Mayor, City Council, and municipal agency heads. The Pro-Voter Law Coalition is joined by the Asian American Legal Defense and Education Fund, the League of Women Voters of the City of New York, Common Cause New York, and Make the Road New York in issuing the following 12 recommendations to help ensure that every eligible city resident is registered to vote when interacting with city agencies subject to the Pro-Voter Law.

New York City Council Passes Bill Forcing Employers to Provide Paid Sick Leave

The New American - May 9th, 2013 - On Wednesday the New York City Council voted 45-3 to pass the New York City Earned Sick Time Act, a bill that will require employers with more than 20 employees to provide five paid sick days to each of them every year while mandating that those employees using their sick days can’t be fired. The law would become effective on January 1, 2014, and companies with more than 15 employees would be required to comply with the law starting in 2015.
Even if Mayor Bloomberg vetoes the bill, the council will likely override it, making the law effective anyway. This will impact the employers of more than one million employees who currently have no paid sick days provided for them. The costs to be borne by those employers weren't provided in any public announcements.
The AFL/CIO explained why such legislation was needed:
In addition to the potential loss of wages for working families, the lack of paid sick days forces many people to go to work when they are contagious and [make] co-workers and customers sick.
No paid sick time also decreases [the] productivity for workers who show up unable to perform to their normal level of ability.
The Center for Popular Democracy (CPD) was joyous over the vote, calling it “a historic agreement to give over one million New Yorkers the right to take paid days off from work to care for themselves or a sick family member. The new legislation represents a major step forward for workers’ rights.” The CPD was joined by Make the Road New York; 32 BJ SEIU, the largest property service workers union; NYC City Council’s Progressive Caucus; the Working Families Party; A Better Balance; and the NY Paid Sick Leave Coalition.
Bill Lipton of the Working Families Party was equally ecstatic: "This is a sweet victory. It provides economic security for New Yorkers, and a shot in the arm for the paid sick days movement across the country."
The bill was first introduced by council member Gale Brewer, a permanent politician and long-time progressive political activist, back in July 2009 but went nowhere for nearly four years, owing to resistance by City Council Speaker Christine Quinn. Quinn’s change to allow a vote coincided nicely with her announcement in March to run to succeed Mayor Bloomberg.
Brewer exulted in the victory:
After 4 years of non-stop advocacy and coalition building, I want to thank the Paid Sick Days Coalition members and my Council colleagues with all my heart for support [of my bill] and never giving up.
I also extend my thanks to Speaker Quinn and her staff for their contributions to this legislation….
The argument over [paid sick leave] was always about common sense and fairness. I believe this law enshrines the principle that American exceptionalism is not just about large profits and small elites, but a workplace that is safe, fair and respectful of the lives of workers.
Approximately one million New Yorkers will now have the fundamental right to a paid day off when they or a family member falls ill, and no worker will be fired if they must stay home. This is a tremendous accomplishment of which all fair-minded New Yorkers can be proud.
Four major cities have already passed paid sick leave laws — Portland (Oregon), San Francisco, Seattle, and Washington, D.C. — while similar measures are being considered in 20 others. On the national level, two other progressives, Sen. Tom Harken (D-Iowa) and Rep. Rose DeLauro (D-Conn.), are pushing the Healthy Families Act, which proposes essentially the same thing as Brewer’s bill: seven paid sick days each year required to be paid for by employers with more than 15 employees. The National Partnership for Women & Families outlined the benefits of such national legislation:
• Paid sick days provide families with economic security;
• Providing paid sick days is cost effective to employers;
• Paid sick days reduce community contagion;
• Paid sick days can decrease health care costs.
Each of these assumptions can be rebutted successfully, but none does it better than Ayn Rand, who always asked “At whose expense?” and Henry Hazlitt in his book Economics in One Lesson, which also asked about the unseen consequences of such meddling. The "broken window fallacy" is also helpful in understanding what progressives refuse to see: Someone must pay for such mandates, usually someone silent or impotent, without enough political influence to stop such “progress” — usually the taxpayers or employers unlucky enough to have a successful business large enough to be included in the mandate.
Some of the unseen consequences would naturally include higher employment costs to the business owners, as these are, in effect, pay raises to employees. The business owners' higher costs would be reflected in higher prices to consumers, which would likely reduce competitive advantage in a market niche. More likely, however, owners will discover that they can’t afford all the people working for them and will be forced to reduce their payrolls through terminations or attrition. That will increase social costs, as those no longer working will start receiving unemployment benefits provided by the state.
In the longer run, however, making employers less competitive will shrink rather than expand the general economy. Some will not hire new workers. Others may decide to retire, deciding that it’s no longer worth the effort, as government becomes more and more intrusive. Still others may choose to move out of the city, or the state, to more tax-friendly environments, further reducing the city’s economic output.
The biggest cost of all, however, is the continued and growing acceptance of government intervention as a way to solve perceived social “problems” and giving progressives more opportunities to expand the power and reach of government
Perhaps the best rebuttal is to review the bill of rights of another country, well-known to historians, which also had a progressive agenda very similar to that of Quinn, Brewer, and the AFL/CIO. It stated:
Citizens … have the right to work, that is, are guaranteed the right to employment and payment for their work in accordance with its quantity and quality….
Citizens … have the right to rest and leisure … the reduction of the working day to seven hours … [and] the institution of annual vacations with full pay….
Citizens … have the right to maintenance in old age and also in case of sickness or loss of capacity to work … ensured by the extensive development of social insurance for workers and employees. [Emphasis added.]
These are, of course, the rights enshrined in the 1936 Constitution of the USSR.
