Report: City Agencies Noncompliant with Voter Registration Law in 84 Percent of Client Interactions
Voting rights coalition working with Mayor, City Council, and agency heads to improve compliance
October 21, 2014, New York, NY – City agencies are not doing enough to help New Yorkers register to vote found a new report released today by the Pro-Voter Law Coalition. The coalition of groups is led by Center for Popular Democracy, the Brennan Center for Justice at NYU School of Law, Asian American Legal Defense and Education Fund (AALDEF), Citizens Union of the City of New York, and the New York Public Interest Research Group/NYPIRG.
Last summer, Mayor de Blasio issued his first Mayoral Directive aimed to improve city agency voter registration efforts. The City passed local Law 29, also known as the Pro-Voter Law, in 2000 to expand voter registration opportunities at municipal agencies. Information for the report, A Broken Promise: Agency-Based Voter Registration in New York City, was obtained through Freedom of Information Law (FOIL) requests and field investigations, and revealed a lack of compliance across city agencies with the Pro-Voter Law. Key findings included:
Widespread failure to comply with the Pro-Voter Law’s requirement to provide voter registration application forms. Specifically, city agencies failed to do so in 84 percent of client interactions;
Efforts ranged from the inconsistent administration of the Pro-Voter Law, to an almost complete lack of apparent attempts to fully administer the law at the city agencies that responded to FOIL requests;
Increased noncompliance for limited English proficient New Yorkers. Only 40 percent, or 2 out of 5, of agency clients whose primary language was not English were given translated voter registration applications as mandated by the law; and
Agency staff received no regular training on voter registration procedures mandated by the law.
“Under previous Mayoral administrations, New York City has broken its promise to city voters by failing to comply with the Pro-Voter Law, and failing to create an electorate that is truly representative of our city,” said Steven Carbó, Director of Voting Rights and Democracy Initiatives at the Center for Popular Democracy. “We are heartened by Mayor de Blasio’s recent Mayoral Directive and his strong commitment to voter registration—and we look forward to working closely with his administration to realize our shared objectives.”
“Fourteen years ago, the threat of a veto by Mayor Giuliani weakened key provisions of the Pro-Voter Law, and then Mayor Bloomberg failed to properly implement it for 12 long years,” said Neal Rosenstein, Government Reform Coordinator of NYPIRG. “It’s time for today’s Council to strengthen the law and for Mayor de Blasio to clearly break with his predecessors and make sure it’s effectively implemented. Potential city voters deserve to be able to register as easily as New Yorkers can at DMV offices across the state under the federal Motor Voter Law.”
“Voting is the cornerstone of our democracy and increasing civic engagement is essential in making sure all New Yorkers are fully represented in government,” said New York City Council Speaker Melissa Mark-Viverito. “That’s why it’s essential that the Pro-Voter Law is fully enforced and I thank the Center for Popular Democracy, Citizens Union, NYPIRG, The Brennan Center for Justice, and the Asian American Legal Defense and Education Fund for their recommendations to strengthen compliance and engage more citizens in elections.”
“Voter participation is essential to our democracy, and with plummeting voter turnout, we must ensure that New Yorkers have more convenient opportunities to register to vote,” said Dick Dadey, Executive Director of Citizens Union. “This report outlines a needed framework for a model agency voter registration program that will result in robust efforts to encourage more New Yorkers to register.”
“Nothing is more important to democracy than voter participation. These are smart strategies to break down barriers to registering to vote for those who may be least likely to do so,” said Council Member Brad Landers. “Our city is strongest when everyone’s voices are heard.”
“Long lines and Election Day chaos are potent symbols of our nation’s broken voter registration system, and our research show that the same is true here in New York City,” said DeNora Getachew, Campaign Manager and Legislative Counsel at the Brennan Center for Justice at NYU School of Law. “Our city needs to join the growing national movement to modernize elections by requiring agencies to electronically transmit voter registration information directly to the board of elections, instead of continuing to use outdated paper forms. This digital-age solution is win-win for voters and election officials. It will increase voter registration rates, save the city money, and make voter rolls more accurate.”
“We face a crisis of non-participation in New York City: Of the 8.5 million residents of New York City, only 4.3 million are registered to vote,” said Council Member Ben Kallos. “City law dictates that our government help register voters—but this report shows that, in the vast majority of cases, it simply isn't happening. City agencies must comply with the law to offer voter registration forms to New Yorkers. To paraphrase Ben Franklin, it is our democracy, if we can keep it. And the task of keeping it must involve immediate action to remedy the failures of implementation of our city’s Pro-Voter laws.”
“Asian Americans and Pacific Islanders are the nation’s fastest growing racial group and comprise almost 14 percent of New York City’s population. Along with other communities of color and immigrant communities, these are important members of our city’s electorate who deserve to participate fully in the political process,” said Margaret Fung, Executive Director of the Asian American Legal Defense and Education Fund. “Compliance with the law’s language access mandates, including translated voter registration forms and bilingual staff at city agencies, is a critical first step to ensure meaningful civic engagement from all of New York’s communities.”
“Voter registration is essential to ensuring a broad and inclusive electorate,” said Javier Valdes, Co-Executive Director of Make the Road New York. “The City should do absolutely everything it can to ensure that all eligible New Yorkers have the opportunity to participate in our democracy.”
The Pro-Voter Law requires 18 city agencies and, under certain circumstances, their associated subcontractors, to provide voter registration forms to all persons submitting applications, renewals, or recertification for agency services, or notifying the agency of a change of address. The law included each of the City’s 59 community boards as well.
In its report, the Pro-Voter Law Coalition made 12 recommendations including the following:
Establish comprehensive protocols by December 31, 2014 to ensure that all agencies provide voter registration applications to clients when they apply for services, renewal or recertification for services and change of address relating to such services and promptly transmit all completed voter registration applications to the NYC Board of Elections;
Require agencies to use coded voter registration forms specific to each agency. Solicit quarterly reports by the Board of Elections on the numbers of forms submitted by city agencies (a model protocol is proposed in City Council Intro 356 of 2014); and
Mandate that agency staff provide the same level of assistance in completing voter registration forms as is given to other agency transactions. This should include verbal assistance.

Fulfilling this wish is difficult, particularly in the Bay Area. When California, the eighth largest economy in the world, ranks 49th among the states in school spending, we know it's difficult for our schools to provide the best education possible.
That's why I enrolled my children in Gilroy Prep Charter School, a Navigator school that achieved the highest API score -- 978 -- in California for a first-year charter school in 2011-12. I also served on the Navigator Board for three years but recently resigned due to transparency and accountability concerns with the Charter Management Organization (CMO), a service some charters use to manage their finances.
Now I find that my concerns were not an aberration. A recent study by the Center for Popular Democracy (linked with this article at mercurynews.com/opinion) found mismanagement of funds, fraud and abuse to the tune of $80 billion, or $160,000 per child, across all California charter schools, and our state could lose another $100 million in 2015 to charter school fraud. That's enough money to pay full tuition and board for every student in California at a University of California school for four years.
The report found that charter schools in California undergo little monitoring of finances, and the districts that oversee charter schools do not have the resources to provide sufficient oversight. Over my three years on the Navigator board, the local districts only attended seven board meetings.
Charter schools were created to bridge the achievement gap by granting increased freedom to administrators, teachers and parents to innovate without being subject to most California education laws. I support charter schools and think many of them provide an excellent education: 60 percent of Santa Clara County charter schools outperform the districts in which they reside. As a former entrepreneur and venture investor, I am all for freedom, innovation, competition and choice.
But the charter school financial model is at risk of failing.
Charter Management Organizations use public money with little public accountability and transparency, and that's starting to cause material financial problems. Not all charter schools have a CMO and run very well on their own, and some CMO-run charter schools are clearly better than others.
In 2014, charter schools authorized by the Santa Clara County Board of Education received $42 million in public revenue, excluding the millions of dollars in philanthropic investments. Some CMOs charge the schools they manage up to 25 percent of school revenue, while our local district charges about 6 percent per school.
In Santa Clara County, 73 percent of charter schools spent $1,287 less per student than their district school peers in 2012-2013. That's worth a musical instrument, computer, books, iPad and field trip per child. Where does the money go? It's not clear, and that's a problem.
To avoid financial risks, charter schools should be held to the same types of regulations as other public schools and the boards that oversee them. All public schools should be given the same freedoms charter schools have to innovate.
My wish is that all public schools be excellent educational institutions and stewards of our tax money. However, we must improve transparency and accountability. I think this is a wish we can all agree on.

Donald Trump’s upset election, I’ve had a unique and odd experience, one peculiar to D.C. I’ve participated in a number of events — conferences, dinners, panels — that were planned before the election and predicated on a different outcome. To say the mood is somber at these events is an understatement.
What has been particularly discordant is to hear policy types, myself included, discuss what we need to do going forward. These include ideas to prolong the economic recovery and help ensure that it reaches more people. Also, there’s a recession out there somewhere, and we’re not ready for it, so good ideas abound regarding preparations that Congress should undertake now while the sun’s still shining. Other ideas include some of the best parts of Hillary Clinton’s agenda, including ways to help people balance work and family, pay for college, improve the Affordable Care Act, and to push back on economic discrimination by race and gender.
When I hear myself and my colleagues make these arguments, I feel as if we’re leading a parade but have neglected to turn around and see the thin crowd that’s following us.
That is, of course, an exaggeration. Clinton won the popular vote by more than 1 percent and counting. But those of us in the facts business must at least consider how little our work seemed to penetrate in the months leading up to the election.
Already, many of us progressives have dusted ourselves off and gone right back to work, promulgating more facts and policy arguments. That’s necessary and increasingly important, as the Trump team is generating policies that sound good but are wasteful and inefficient. We’re used to playing such defense, and we’re good at it.
But if that’s all we do, we’ll be failing the people whom we’re here to help. The problem isn’t that the facts aren’t out there; it’s that they don’t seem to be gaining much traction. Moreover, there is no way an $18.7 trillion economy can be successfully managed if facts are on the run. We either solve this problem or watch our country deteriorate.
So how do we find and successfully navigate the road back to Factville?
We can gain an important hint by looking at what hasn’t worked. Many in the real media (as opposed to the “alt-right”) responded, often admirably, with fact checking, even in real time, as during the presidential debates. But listen to what Major Garrett, from CBS news, said about this on the Diane Rehm radio show the other day, incisively summarizing his experiences on the campaign trail:
“Any fact-checking I did … was prima facie evidence that I was biased and that I was wrong. Fact checking Trump was proof not that he was wrong but that he was right and that anyone who would raise a question about the underlying relationship about what he said and the facts was biased and therefore legitimately disregarded … It wasn’t as if there was a conversation about this; it wasn’t as if facts were litigated back and forth. The very raising of a question about the factual basis of a Trump assertion was proof that you were wrong and biased and that was the atmosphere that I found myself existing in as a reporter and to call it challenging would be an understatement.”
The institution of the establishment media is, in other words, not trusted by partisans who can point and click to countless other places to find “facts” that meet their priors. It’s a brilliant opposition strategy: when the act of fact-checking itself signals to partisans that you’re biased, that’s checkmate against evidence.
Next, ask yourself who benefits from the absence of evidence-based analysis? Examples are useful here. I can show, using the work of the think-tankers I’ve mentioned thus far that the social insurance programs of Medicare and Social Security are highly efficient and effective in boosting the welfare of retirees, and that there are no such private systems that would be nearly as effective. I can show the same societal-wide net benefits for the Affordable Care Act and the anti-poverty safety net. Same for countercyclical policy to offset recessions. Same for public education, from quality preschool to affordable college.
Every one of these programs is a “public good” and thus adds to the role of the government and requires ample funding provided through tax revenue. So, if you’re someone who wants to keep more of your pretax income, you must discredit such programs and the government that provides them.
I see this play unfolding as we speak: One, discredit the facts so nobody knows what works and what doesn’t. Two, pass a massive tax cut that delivers the goods to the top few percent. Three, argue, based on #1 above, that the tax cuts will generate enough growth to pay for themselves. Four, when they fail to do so and the debt starts going through the roof, throw up your hands and say you’ve got to cut the “entitlements.”
I don’t profess to know how to break this chain, but I do know this: Bringing the best ideas to fruition, where “best” means those that promote the greatest social welfare, does not depend solely on logic, numbers and the best arguments.
First, both the media and allegedly centrist policy organizations need to retire the idea that pairing fact-based analysis with unfounded bias is balanced reporting. Why should there be a debate on whether trickle-down tax cuts can double the growth rate and pay for themselves? And, yet, I’m called upon to have that debate weekly. If they can get you arguing over the wrong questions, they’ve already won.
At the very least, the media should mitigate the damage by making debates more representative of the state of knowledge on an issue — meaning, as John Oliver has pointed out, that climate change debates should generally feature 97 scientists explaining that it’s real and a problem for every three people who deny that reality.
Second, we in the think tank world need to reach beyond the choir both in our policy and our communications. I can name many think tanks that work with great energy and notable successes on the problem of poverty. I cannot say the same for the problem of helping displaced manufacturing workers.
Third, we must call it like we see it with much more intensity. I wonder if one reason the progressive base wasn’t out in force was in part because we failed to explain the stakes in clear, powerful language, naming names and directly confronting falsehoods and racism.
Fourth, and relatedly, we need to be more proactive in working with and supporting advocates and social movements. The Fight For $15, the Fed Up Campaign and Black Lives Matter are examples in recent years of people coming together to pressure politicians to act. They’ve been successful because they haven’t stopped at the facts; instead, they take the facts and integrate them with people-power and a compelling moral message.
I’m sure there are more and better ideas to reestablish facts and evidence-based policy to their necessary perch. Like I said, I’m no expert in this space: When my colleagues and I were in graduate school, we studied facts, not how to reinject them into the debate. But unless we do so and couple them with progressive political movements, I fear we may make no progress.

Campaign Zero: A ‘Blueprint for Ending Police Violence’

On Friday, activists with the country’s growing racial justice movement unveiled a new campaign to end police violence, bridging protester demands with data and policy to create structural solutions to the crisis that has gripped national attention for more than a year.
Launched as an online manifesto with an interactive website, Campaign Zero proposes new federal, state, and local laws that would address police violence and reform the criminal justice system—including demilitarizing law enforcement, increasing community oversight, limiting use-of-force, and requiring independent investigation and prosecution of police violence cases.
“More than one thousand people are killed by police every year in America,” the group states on its website. “Nearly sixty percent of victims did not have a gun or were involved in activities that should not require police intervention such as harmless ‘quality of life’ behaviors or mental health crises.”
The action plan also incorporates recommendations by the President’s Task Force on 21st Century Policing as well as those of research organizations like the Center for Popular Democracy. The architects behind Campaign Zero characterized it as a project that will continue to develop over time as new solutions emerge and more supporters come on board.
The four creators of the new campaign and authors of the manifesto—Samuel Sinyangwe, Brittany Packnett, Johnetta Elzie, and DeRay McKesson—are co-founders of We The Protesters, which as the Guardian notes is “a prominent section of a wider protest movement that is frequently referred to, in general terms, as Black Lives Matter.”
“This is just the beginning,” they wrote in a statement accompanying the launch.
In the year that has passed since 18-year-old Michael Brown was shot to death by an officer in Ferguson, Missouri, police have killed at least 1,083 Americans—an average of nearly three people per day, according to figures compiled by VICE News. Even that figure, released August 9, quickly became outdated.
The policy recommendations also call for an end the controversial practice of “broken windows” policing—a tactic that involves cracking down on petty infractions as a means to prevent more serious crime. The chokehold death of Eric Garner, who was targeted by police for allegedly selling loose cigarettes, heightened criticism of the policy, which Columbia law professor Patricia J. Williams said “has intimidated, dispossessed and humiliated millions of innocent people” for two decades.
Campaign Zero launches just as new reports highlight the lack of training and culture of aggression that permeates law enforcement agencies throughout the country. Addressing that issue in another policy demand, Campaign Zero states, “An intensive training regime is needed to help police officers learn the behaviors and skills to interact appropriately with communities.”
The group points to the recent successful overhaul of policing tactics in Richmond, California, a city which reduced its crime rate by 33 percent through community policing.
“We must end police violence so we can live and feel safe in this country,” Campaign Zero states.
Campaign Zero also introduces strategies for charting presidential candidates’ policy positions on such issues. Racial justice activists have recently engaged with the campaigns of candidates including Hillary Clinton, Bernie Sanders, Martin O’Malley, and Jeb Bush to demand action plans on addressing police brutality and criminal justice reform.
“Right now, the country is awake,” organizers stated. “We must continue to leverage this awakening for substantive change. We have an opportunity to change the way that issues in blackness are prioritized in political spaces and an opportunity to redefine how the political process interacts with our communities.”
“America is finally waking up to this very necessary and critical conversation about race, equity, and preserving the life and dignity of all citizens,” Packnett told the Guardian on Friday.
Added McKesson, “This is a blueprint for ending police violence.”

Capital NY - June 16, 2014, By Nidhi Prakash - With just four remaining days in the state legislative session, sponsors of a new bill to grant citizenship rights to undocumented immigrants said they hope to begin building momentum for next session.
“First of all, this is obviously not something that is going to pass by the end of this week," said State Senator Gustavo Rivera, at a press conference in Battery Park City. "This was never about this particular legislative session. We’ve been working on it for almost two years, it’s a bold idea and we wanted to make sure it was thought out."
The bill, titled the New York is Home Act, would make it legal for undocumented immigrants in New York State to vote in local and state elections, get professional and drivers' licenses, and make them eligible for state-funded Medicaid and financial aid for higher education.
“What we’re doing today is we’re starting a conversation not only in New York, but hopefully across the country,” said Rivera, who was joined at the press conference by representatives from the Center for Popular Democracy and Make the Road New York.
Senator Rivera said he was choosing this moment to introduce the bill, despite nearing the end of the legislative session, partly because of a lack of movement in Washington on immigration reform. He pointed to the defeat last week of Republican House majority leader Eric Cantor by a Tea Party candidate who criticized Cantor's support for limited immigration reform.
But some progressives have also balked at provisions in the proposed bill. Mayor Bill de Blasio has called for municipal ID cards for undocumented immigrants, but said last year he's "not comfortable" with the idea of noncitizen voting.
“We are certainly asking for everyone in the Senate and the Assembly as well as in other sectors—the mayor and the governor—to support it, and we will have conversations with them going forward," Rivera said. "We are just starting the conversation."
Assembly Member Karim Camara, the bill’s sponsor in the Assembly, said the broad scope of the bill could help other stalled measures, like the Dream Act and a bill to allow undocumented immigrants access to drivers' licenses.
“We’re hoping that by looking at this big picture, and this is probably one of the most ambitious efforts over at least the last decade or two, maybe those smaller pieces now seem like they’re not that big of a deal,” said Camara.
Camara said he hoped the bill would create momentum for other immigration reform initiatives by the start of the next legislative session.
“We didn’t break it into priorities in this bill, but we’re hoping that by looking at this overarching bill it’ll perhaps make those other smaller bills easier—drivers' license, Dream Act, et cetera,” he said.
Camara blamed the balance of power in the Senate for those bills being unsuccessful in the past, and said if that was to change there may be more hope for immigration reform on a state level.
“The Republican-led Senate has been a main challenge," he said. "We would have passed it this year if it was not for that. So of course there is that elephant in the room, that political dynamic that we can’t avoid, and if that’s not the case then we’ll appeal to individuals’ reason."

As Texas Circuit Court Judge Rules Against Immigrant Families, The Center for Popular Democracy Calls on US Fifth Court of Appeals To Reject Politically-Motivated Lawsuit by Anti-Immigrant Politicians Undeterred by the political attacks, immigrant communities continue to prepare for new immigration programs and will fight on for a path to citizenship
Late on Monday night, U.S. District Court Judge Andrew Hanen of Brownsville Texas, who has previously expressed anti-immigrant views, issued a preliminary injunction that temporarily blocks the implementation process of the new immigrant deferred action programs. Immigrant communities and their allies have been eagerly preparing to take advantage of the President’s expanded administrative relief program, which is scheduled to go into effect on February 18, 2015. The ruling may delay the program’s start date, forcing the millions of immigrant workers who are ready to come forward, register, and apply for work permits, to wait indefinitely.
“Immigrants across the country are moving forward regardless of today’s ruling,” said Ana Maria Archila, Co-Executive Director at the Center for Popular Democracy. “We partner with dozens of grassroots pro-immigrant organizations across the country who refuse to be scared off by this. They are committed to fighting not only for DACA and DAPA, but for a path to citizenship for all 11 million.”
“The ruling is a temporary setback and it does not change the fact that the President's executive order is a victory for immigrant families,” said Joaquín Guerra of the Texas Organizing Project. “What is disappointing is that Governor Greg Abbott has put Texas on the same footing with Arizona's notorious Sheriff Joe Arpaio and his cheap political stunts. No longer can Texas Republicans distance themselves from Arizona or Alabama when it comes to attacking Latinos and immigrants. We call on the Department if Justice to immediately file for a stay at the 5th Circuit Court of Appeals so they can reject this meritless lawsuit that is an attack on immigrant families and a waste of taxpayer dollars.”
