If you’re a huge fan of shopping at Zara, the Spanish fast-fashion franchise, you may want to start spending your money elsewhere.
The fashion brand has been outed for its deeply engrained racist hiring and customer service practices in arecent survey conducted by the Center for Popular Democracy, a racial, economic and labor justice group. A random sample of two hundred-fifty one out of Zara’s 1,500 Manhattan employees participated in the survey and confided that Black customers are profiled as potential thieves seven times more frequently than white shoppers.
The study, entitled “Stitched with Prejudice: Zara USA’s Corporate Culture of Favoritism” and written by Chaya Crowder, also revealed that Black customers were also more frequently denied exchanges and returns than Whites. Customers weren’t the only people that were racially discriminated in Zara’s stores. Black employees claimed that they were given dissatisfactory hour assignments and stricter surveillance from managers.
“It’s kind of weird to me how they can make millions of dollars but are not able to pay people properly for their time, let alone give people the amount of time that they need in order to support their family, in order to keep a roof over their head, in order to, you know, just feed themselves.” One employee said:
The study had also found that darker-skinned employees were also less likely to promoted to managing roles and were often given less-prestigious roles. Sixty-eight percent of employees that were assigned roles in the back of the store and away from the public had darker complexions. Managers were generally White, and generally gave preferential treatment or were less lenient to subordinates of the same races and ethnic groups. The extent to which Black employees were profiled in their own work environment were sometimes highly disturbing, as portrayed in this incident:
“[O]ne Black employee even detailed an instance in which he had come in a hooded jacket to pick up his check. A sales associate not only identified him as a special order, but he was physically stopped as he was walking into the back office, where checks are kept.”
The study’s findings are not particularly surprising, given Zara’s history of being infamous for racial bias in the brand’s various operations. Just earlier this month, the franchised was served with a $40 million lawsuit from a former worker citing discrimination, unlawful discharge, retaliation and a hostile work environment. The brand also received bad press last year for racist images on its merchandise: pajamas featuring swastikas, a necklace with blackface designs, shirts with gold stars resembling those worn by the Jewish people once held in concentration camps in the Holocaust and a shirt with the words printed saying, “White is the New Black.”
According to Forbes, Zara featured the following statement:
“Zara USA vehemently refutes the findings of the Center for Popular Democracy report which was published without any attempt to contact the company. The baseless report was prepared with ulterior motives and not because of any actual discrimination or mistreatment. It makes assertions that cannot be supported and do not reflect Zara’s diverse workforce.
“Zara USA believes that the report is completely inconsistent with the company’s true culture and the experiences of the over 1,500 Zara employees in New York City. We are an equal opportunity employer, and if there are individuals who are not satisfied with any aspect of their employment, we have multiple avenues for them to raise issues that we would immediately investigate and address.
“Approximately half of all Zara USA employees are Hispanic or African American. In the most recent round of internal promotions at Zara USA, approximately half were Hispanic or African American employees. In addition, approximately half of all hours are regularly allocated to Hispanic or African American employees. These facts clearly demonstrate that diversity and equal opportunity are two of the company’s core values. We are a global multicultural company serving valued customers across 88 countries, and do not tolerate discrimination of any form.”
Welp. I know Zara won’t be seeing my money again anytime soon. It’s a shame, their pencil skirts fit me in all the right places…

Advocates Keep Fighting for Workweek Fairness
But six months later, the Times ...
But six months later, the Times reported that Starbucks had not entirely stamped out clopening. And baristas frothing lattes aren’t the only ones who struggle with a very different meaning of the phrase “work-life balance.” Millions of people across the U.S. have to deal with erratic work schedules and/or on-call shifts — at least 17 percent of the workforce, according to an estimate from liberal think tank Economic Policy Institute. Further, EPI found that these scheduling practices are most likely to be felt by low-income workers.
On the heels of several minimum wage increase victories, advocates are also pushing the issue of unstable workweeks as the next big legislative fight in reducing worker inequality. Over the last year, legislation about employee scheduling has been introduced all over the country, in cities — including Minneapolis, Washington, D.C. and San Francisco — and 10 different states, which would restrict or banish policies subjecting workers to uncompensated on-call scheduling, shift changes with less than a week’s notice and limitations on swapping work hours.
The fight for such change has been recently flared in Albuquerque, New Mexico, where a bill introduced in June, the Fair Workweek Act, would have done all of that — plus added additional regulations like allowing part-time employees to accrue 56 hours of paid sick leave a year. Throughout the summer, debate surrounding the bill grew so heated that detractors leaked emails showing city councilors discussing the bill’s language with pro-worker organizers, as if the correspondence had been evidence of a Benghazi-level cover-up and collusion.
Albuquerque ranks 99th out of the top 100 largest metropolitan areas in terms of recovery from the recession. Its 6.8 percent unemployment rate is a point and a half worse than the national average, and there were some 30,000 fewer jobs in the area than in 2008, according to a Brookings analysis that said that Albuquerque was perhaps the only metro enduring a double-dip recession as of last year.
Business interests in the city have argued that the tenets of the Fair Workweek Act would be especially damaging in this fragile economic climate. “The real misunderstanding is not the plight of low-wage workers, but the economics of job creation,” says Carlo Lucero, a vice chair of the Greater Albuquerque Chamber of Commerce. “Things like paying … if a shift is eliminated, those are costs that are not affordable.”
To hear it from local business owners, they’re the ones trying to create jobs, and yet, simultaneously being dinged with regulation on top of regulation — from minimum wage increases (passed by ballot initiative in 2012) to requirements of the Affordable Care Act to changes to the state-run employment insurance program. “We no longer control the wage we pay and we no longer control the healthcare benefits we pay, so one of the last areas of control is our work schedules,” says Lucero. Further, he adds, “This is the worst bill in the history of our Chamber.”
But employees in the service, restaurant and retail industries say irregular scheduling practices are one reason why there are 6.5 million “involuntary part-time” workers nationwide who are unable to accumulate the amount of hours they want. Take the experience of Kris Buchmann, for example. When she worked at American Eagle in Albuquerque a few years ago, she was assigned to only one regular shift — along with up to four on-call shifts per week from 6 to 10 o’clock at night. Each day, she’d be expected to call in an hour beforehand to find out if she was working or not.
“Whether on-call workers would be necessary was directly tied to the sales of the day,” says Buchmann, who now works in the beauty industry and is an organizer for OLÉ, one of the main groups campaigning for the Fair Workweek Act in Albuquerque. Only if the store looked like it would exceed sales goals for the day would the on-call workers be brought in. Otherwise, they’d get no compensation. And without the semblance of workweek normalcy, planning for childcare or school became nearly impossible.
Later, when Buchmann served as manager of a New York & Company store, she had to institute on-call scheduling. From the management’s perspective, the staffing tactic was built on the “assumption that some of these people were going to quit.” But Buchmann found irony in the scenario: By hiring twice the number of workers as shifts available, it simply encouraged more people to quit. “It becomes this weird catch-22 where nobody ever becomes invested in the job, so you don’t have to worry about giving people raises or benefits.”
Advocates for fair workweeks point to employers like Costco and Trader Joe’s as examples of worker-friendly scheduling that can be enacted by chains. It appears that the public in Albuquerque agrees this should be the norm, at least according to one pollconducted in May that found a majority of citizens in favor of the main tenets of the Fair Workweek Act.
“It’s all well and good to have a stable, hourly wage, but if you can’t get enough hours to live on, that’s not helpful,” says Rachel Deutsch, a senior staff attorney for worker justice at the Center for Popular Democracy, which has been advocating in Albuquerque and nationwide on the topic.
In San Francisco, the Retail Workers Bill of Rights took effect last month — the first major movement from a municipality. But national interest continues to grow, as evidenced by the Senator Elizabeth Warren-championed Schedules That Work Act.
In Albuquerque, the Fair Workweek Act was withdrawn this month, after Mayor Richard Berry publicly guaranteed he’d veto it. “We made it very clear from the get-go that we were going to sponsor amendments,” says City Councilor Klarissa Peña, a co-sponsor of the bill. She says that there were provisions of the act — like paying idle employees for their time — that never sat well with her, but without the opportunity to tweak its language now, the Mayor’s declaration muzzled the opportunity for a compromise. “It cut us off at the knees,” Peña says.
Now, both sides expect the fight to culminate in a ballot initiative in 2016 — a path that will not allow room for amendments. Both the Chamber of Commerce and pro-worker groups concur that this summer’s debate was the opening salvo in a prolonged fight. Don’t be surprised if you see that battle coming to a city near you.
“Let’s say you get a minimum wage in one place,” Deutsch says, “this is the next step to address growing income inequality.”

MACK'S BACK: Connie Mack, the former Florida congressman who recently left Levick, registered to lobby for DCI Group on behalf of Puerto Rico bondholders. Mack declined to specify which investors, but he previously worked for DCI on behalf of hedge fund BlueMountain Capital Management on its dispute with the island commonwealth. DCI Group is the grassroots/"AstroTurf" specialist that The New York Times said helped coordinate a lobbying campaign purportedly comprising retiree bondholders.
Mack criticized the current bill on Puerto Rico's debt, telling PI it features an unconstitutional stay and a "bailout in the form of a super Chapter 9."
NO DEAL: Pharma giants Pfizer and Allergan have called off their $160 billion merger after Treasury released new anti-inversion rules Monday, Pro Tax’s Bernie Becker reports. Pfizer was planning to move its legal address to Ireland, and the deal would have been the largest in a series of mergers allowing companies to take foreign addresses, reducing their tax bills. The story of the economic recovery varies dramatically depending on where it is being told. On Wall Street, big banks look stronger, bigger, and healthier than ever. Large companies are making record profits. But, the labor market remains weak. Although the economy has added more jobs in recent months, job growth on Main Street is not nearly as robust as during previous recoveries.[i] Unemployment rates in nearly every state remain above pre-recession levels. Wages have been stagnant or falling for most workers and the quality of jobs has decreased significantly. Main Street still has no clear route to prosperity.

Many communities are disproportionately struggling in this economy. The Latino unemployment rate is more than 2 percent higher than the rate for whites, and Latino wages and wealth are considerably lower than whites. Women continue to earn substantially less than men. This paper focuses on the economic disparities facing the African-American community in particular because the economic crisis is most acute there: African-American unemployment rates continue to exceed the national unemployment rates at the height of the recession, Black workers’ wages have dropped $0.44 over the past 15 years, though Latino and white wages have risen by $0.48 and $0.45, respectively; unemployment rates among African Americans are higher than those of other racial or ethnic groups; and, though Latino and white wealth has stabilized since the Great Recession, Black wealth continues to shrink. So, while Main Street may be stabilizing (albeit at a lower standard), the recovery has yet to reach Martin Luther King Boulevard. Creating a strong American economy must include prioritizing a genuine recovery for the African American community.
This joint report of the Center for Popular Democracy and the Economic Policy Institute examines the current state of the American economy and labor market, with particular attention to racial inequality and its contours before, during, and in aftermath of the Great Recession. It describes the role that federal monetary policy has played in exacerbating economic disparities over recent decades -- the shrinking national income share for working America and the exploding income and wealth gaps between the top 1 percent and the rest of us. The paper further explores the consequences of the major policy decision currently facing the Federal Reserve (or the Fed): whether to prioritize genuine full employment or to avoid inflation at the cost of robust employment and wage gains. Only by pursuing genuine full employment will the Fed ensure that the recovery reaches Main Street and Martin Luther King Boulevard – and communities of working people throughout the country. As the Fed makes crucial monetary policy decisions in the months and years to come, it must ensure that all communities can share in the prosperity of a functional economy.
The report also studies the decision-making processes and bodies of the Federal Reserve. Although the Board members that govern the regional Federal Reserve banks are legally required to represent the broad interests of the public, they are, in fact, predominantly representatives of the financial sector or large corporations. Without governance that represents the full diversity of the public, Fed decisions risk remaining uninformed by the full economic reality they create, as experienced in communities throughout the country. The Federal Reserve’s focus over the past 35 years has been on price stability, or tamping down inflation. While this focus is good for Wall Street, it has resulted in wage stagnation for most workers on Main Street. The cost of this focus has been slow recoveries in labor markets after each downturn. America needs the Federal Reserve to concentrate on labor market stability and insure that wages are rising with productivity, so that workers reap the benefits from their efficiencies and hard work; that means prioritizing a wage growth target, rather than inflation. A Federal Reserve dominated by banks and major corporations will produce an economy that works for them, at the risk of leaving tens of millions of working families – particularly Black working families – with little hope of a better life.
The report recommends that the Fed:
Create a Strong & Fair Economy
Stimulate Good Jobs for All: The Federal Reserve should commit to building a full employment economy. It should keep interest rates low so that the numbers job openings and job seekers are balanced and everybody who wants to can find a good job.
Invest in the Real Economy: The Fed should use its existing legal authority to provide low- and zero-interest loans so that cities and states can invest in public works projects like renewable energy generation, public transit, and affordable housing that will create good new jobs.
Research for the Public Good: The Fed should study the harmful effects of inequality and examine how policies like raising the minimum wage and guaranteeing a fair workweek can strengthen the economy and expand the middle class.
Create a More Transparent & Democratic Federal Reserve
Ensure That Working Families’ Voices Are Heard: Fed officials should regularly meet with working families and community leaders, not just business executives, in order to get a more accurate picture of how the economy is working.
Represent the Public: In regional banks around the country, Fed leaders come overwhelmingly from financial institutions and major corporations. The Fed should appoint genuine representatives of the public interest to these governance positions.
Create a Legitimate Process for Selecting Fed Presidents: In late 2015 and early 2016, the regional Fed banks will select their next presidents, who will serve five year terms. Currently, the process for selecting those presidents is completely opaque and involves no public input. That needs to change, so that the public has a real role in the selection process.

Hard on the heels of the Fight for $15 minimum wage campaign, a group that has won legislation or regulation changes involving work schedules in three states and seven cities is launching a drive in Philadelphia. The Fair Workweek Initiative will kick off its campaign in Philadelphia on Tuesday, with a rally at 12th and Chestnut streets, followed by a march to City Hall, where organizers will demand that City Council pass legislation requiring fair and consistent schedules for hourly workers. Fair Workweek is an effort of the Brooklyn-based Center for Popular Democracy, which describes itself as an alliance of organizations promoting “an innovative pro-worker, pro-immigrant, racial and economic justice agenda.

New York Daily News - October 21, 2014, by Erin Durkin - City agencies are failing to do their part to make voter registration easier — even though they’re required to by law.
Legislation passed in 2000 mandates that 18 agencies give voter registration forms to visitors. But the Center for Popular Democracy and other non-profits found that 84% of those visitors were never offered a chance to register, according to a report to be released Tuesday.
In fact, 60% of the agencies didn’t even have any forms in the office. And 95% of the clients were never asked if they wanted to register to vote.
“This is an urgent problem which is leading to the disenfranchisement of many thousands of low-income New Yorkers,” said Andrew Friedman, the group’s co-executive director. “The city is failing to live up to its obligation.”
The group found that 30% of people who visited the city offices weren’t registered to vote, higher than the national average.
Mayor de Blasio’s spokesman Phil Walzak said Hizzoner has ordered agencies to step up their compliance with the law. “Mayor de Blasio is deeply committed to reducing barriers to voter participation, and making it simple and easy to register to vote is the first step,” he said.
Only one of the agencies, the Administration for Children’s Services, used a combined form that offers the chance to apply for ACS services, as required by the law, the report found.
Advocates say having city agencies help out with voter registration is especially important because most people nationwide sign up to vote at motor vehicle departments, but many city residents don’t drive.
