Report slams Louisiana charter school oversight

The Times-Picayune - 05-08-2015 - Louisiana understaffs its charter schools oversight offices and, instead of proactively investigating these schools, relies on charters' own reports and whistleblowers to uncover problems, according to a report released Tuesday (May 12) by the Center for Popular Democracy and the Coalition for Community Schools. That allows theft, cheating and mismanagement to happen, such as the $26,000 stolen from Lake Area New Tech High and the years of special education violations alleged at Lagniappe Academies.
The report also casts a skeptical eye on the veracity of the data that Louisiana uses to calculate the performance scores that keep charters open and determine their renewal terms. And it faults the state for closing struggling charters instead of intervening to improve them.
The Center for Popular Democracy's partners include the American Federation of Teachers, which has an uneasy relationship with charters, and the Annenberg Institute for School Reform, which studies charter school oversight. Kyle Serrette, the center's director of educational justice campaigns, said its parent members had children in charter and conventional public schools.
That said, one of the report's recommendations is to "impose a moratorium on new charter schools until the state oversight system is adequately reformed."
The Louisiana-based Coalition for Community Schools opposes charter schools outright and filed a civil rights complaint against the state Education Department in 2014. That complaint also included a demand to freeze chartering in New Orleans.
The two groups' report said Louisiana charters could suffer from "tens of millions of fraud in the 2013-14 school year alone," based on the methodology of the Association of Certified Fraud Examiners. In that time, employees of three New Orleans charter schools stole about $110,000, and two charter operators were accused of meddling with retirement payments.

"The state has invested heavily in increasing the number of charter schools while failing to create a solid regulatory framework that truly protects students, families and taxpayers," the authors write. Furthermore, "oversight agencies play almost no role in helping charter schools improve academic outcomes. ... The state has no system in place to provide a path to high-quality academics for all struggling charter schools."
Charter schools are publicly funded but run by independent non-profit boards. They control their own curriculum and hiring but must meet academic and operational standards to stay open. The state Education Department oversees most of Louisiana's 130-plus charters; local school systems oversee the rest.

However, as of December, the Education Department's charter audit team consisted of only three people, according to a critical December report from the Louisiana legislative auditor's office. Education Superintendent John White defended his team at the time, saying they reviewed charter schools' audits, among other activities.
Tuesday's paper says that isn't enough. Not only do charters hire their own accountants to conduct annual audits, but the audits are not designed to prevent or detect fraud. Indeed, reports typically contain a disclaimer saying they are not expressing an opinion on fraud controls. The legislative auditor's office might dig deeper but rarely does so, the report states.
"The only audits Louisiana charter schools routinely undergo are the ones they pay for themselves," the authors write.
The report faults the Education Department for not spending enough time on-site at charters. Charters receive regular visits and reviews from state inspectors, and Louisiana Recovery School District officials said their own findings of wrongdoing at Lagniappe Academies in New Orleans showed that their oversight procedures worked.
The authors of Tuesday's report disagreed. The state's 2013-14 review of Lagniappe Academies gave full points for special education, the two organizations said, and it was only later that state inspectors uncovered extensive reports of violations during that time period.
"The situation at Lagniappe shows exactly the problems with the state's oversight structure for charter schools," the report says. "The state relies on a largely self-reporting oversight structure that is easily manipulated by the schools themselves."
The authors doubt the accuracy of the test scores that are used to measure charters' academic performance, writing that the data "is vulnerable to manipulation."
Finally, the authors disagree with the state's readiness to close charters, including Lagniappe.
"Clearly there are times when problems are significant enough that a school must be closed. Yet, the current intervention (process) is designed to make school closure a normal and common part of the state's accountability system," the authors write. "The system needs to be updated to produce more stability for Louisiana children." In six years, more than 1,700 New Orleans students have seen their charter schools close, according to the report.
Louisiana's laws are "designed to set a high standard but not to help," Serrette said.
The state does at times intervene instead of closing schools, although this is not mentioned in the report. The Recovery School District has chosen successful charter operators to take over failing schools, for example, and White directed Lycée Français to find a new chief executive and assigned it a consultant team. Lycée has gone on to make a B grade, and its charter contract has been extended.
The report's recommendations include:
Require fraud audits every three years, to be conducted by the state legislative auditor's office
Train charter staff and boards on preventing fraud
Hire more staff for the legislative auditor's office and charter school oversight teams
Require "mandatory, hands-on, long-term, strategic support" for charters in trouble
Go beyond test scores when calculating school letter grades
Create local committees, including neighbors and parents, to design schools that serve the needs of a community
Coordinate social services at and around schools
Release raw testing data to the public.
Some of these issues are not unique to charters. Louisiana's conventional public schools also face pressure to keep test scores high: If they don't, they may be taken over by the state. There have been numerous examples of corruption and fraud in school boards and systems. Serrette said it was likely Louisiana's regular school systems needed stronger oversight as well.

The report "It's About Time: The Transit Time Penalty and Its Racial Implications" cited infrequent service, indirect routes, delays, overcrowded vehicles, and insufficient shelter at bus stops as factors that contribute to a transit time penalty that adds time and stress to each commute. For Blacks and Asians who used public transit, that totaled an extra 3.5 weeks a year and for Latinos it was 4 hours a year of additional time required to travel between two points by public transportation, compared with going by car.
"That means that for a month a year more than white drivers, transit commuters of color are unavailable for working, helping children with homework, helping parents get to the doctor, running errands, volunteering in their communities or participating in their churches," said the report compiled by Neighborhoods Organizing for Change, TakeAction Minnesota, ISAIAH and the Center for Popular Democracy.
The groups released their findings during a news conference at the State Office Building in St. Paul.
As the legislative session come down to the wire and a transportation budget still up in the air, the advocacy groups are urging law makers to approve a bill that would not cut service but allow Metro Transit to move forward with its Service Improvement Plan. That plan calls for an expansion of service that would institute Arterial Bus Rapid Transit, which would speed up service on local urban routes by as much as 30 percent among other things, the report said.
A proposal passed by the Minnesota House would force Metro Transit to reduce regular bus service by at least 17 percent. The fate of that proposal will be decided in the overall transportation spending bill hashed out by the House, Senate and Gov. Mark Dayton
"These improvements can only happen with enough funding. If transit funding is cut, the time penalty is certain to worsen," the report said. "Funding cuts proposed by House Republicans will result in lost service—longer waits, more delays, longer travel times, and more crowded buses and trains."
About 5 percent of whites and Minnesotans of Asian descent commute by public transit, 8 percent of Latinos, 10 percent of Blacks, and 29 percent of American Indians commute to work on public transit.

In an unusual listing that has been posted to several job boards, including Idealist, Lander is looking for a staffer to see beyond New York City, and to keep an eye on the actions of President-elect Donald Trump.
The ideal candidate should be able to implement Lander's communications and media program while also defending against what the councilman calls the threat "to American democratic values and vulnerable constituencies." The goal, according to the ad, is to help "build a more just, inclusive, and sustainable NYC.”
A minimum of three to four years of communications experience — ideally in New York City — is required for the job, as is a sense of humor, according to the listing. The job includes a “competitive salary,” which was not specified but reported to be in the range of $61,000 to $67,000 a year, according to the New York Daily News.
Lander, an outspoken councilmember who was once arrested for blocking traffic to support striking car washers in Park Slope, is co-founder of the Council’s progressive caucus. He is also incoming board chairman of Local Progress, a nationwide network of self-described progressive local officials.

EASTON, Pa.—The orders came in fast during a recent Friday lunchtime rush at a Sheetz Inc. convenience store here. Behind the counter, Alexis Cooper layered tomatoes on two sandwiches, refilled a container of onions and swirled a peanut-butter milkshake.
Six weeks into her job at Sheetz, Ms. Cooper easily distinguishes the beep of the deep fryer from the boop of the convenience store’s order-taking system and knows to have a pepperoni roll ready for a regular who shows up around noon.
Ms. Cooper, 20 years old, is something of a rarity in the realm of fast-food and retail work: a full-time employee.
At a time when many chains are shifting workers to part-time, the Altoona, Pa.-based Sheetz is making a big bet on full-time hires, who now comprise 53% of the company’s 17,000-person workforce. Leaders at the convenience store-and-gas-station chain say having full-time workers behind the register results in better customer service, lower turnover and a more engaged workforce—all of which, executives say, will lead to higher sales and profits.
Nearly 5.7 million workers said they were working part-time last year because they couldn’t get more hours or find full-time work, according to Bureau of Labor Statistics survey data. About 65% of store employees in the retail sector work part-time, according to an analysis by search and consulting firm Korn Ferry Hay Group. Companies reason that keeping staff to 30 hours or fewer a week curbs labor costs and allows firms to act nimbly, adjusting staffing to match customer demand.
Sheetz, and others like beauty retailer Bluemercury Inc., acknowledge that full-timers might cost more at first, but say they are more reliable—27% of full-time hourly workers leave their jobs per year, versus 68.7% of part-timers, according to the Korn Ferry report. Lower employee turnover saves on training and hiring costs, those employers say, and some report their customers spend more when full-timers take orders and ring up purchases.
“This is a moment where some employers at least are taking stock of whether they’ve gone down the labor flexibility path a little too far,” says Susan Lambert, a University of Chicago professor who studies hourly work.
Full-time workers are the “glue” that holds businesses together, Ms. Lambert’s research has found. They help coordinate tasks and anticipate business needs, and are often more committed. These employees are more likely to go the extra mile on the job, such as tracking down an item online for a customer.
For customers, a full-time employee “gives them the same face every day. It builds a different feeling than the robot behind the counter,” says Sheetz Chief Executive Joe Sheetz.
On employee surveys, Sheetz’s full-time workers tend to report more commitment and willingness to put in extra effort than part-timers do. That engagement correlates with higher customer-service marks, says Stephanie Doliveira, Sheetz’s human-resources vice president.
Less than a quarter of Sheetz’s full-time staff leaves each year; for part-timers, 83% leave. Overall voluntary turnover at the company is down two percentage points from last year, saving $925,000 in recruiting and training, Ms. Doliveira says. Starting sales associates make $9 to $11 per hour and are eligible for paid time off; those working more than 30 hours per week get access to health insurance.
At Buffalo Wings & Rings, a restaurant with 50 locations in the U.S., full-timers ring up 6% higher sales per hour on average and have far lower rates of absenteeism than part-timers do, according to CEO Nader Masadeh. The eatery has doubled its share of full-time workers since 2013, with about 37% of employees working full-time. The company’s training costs have fallen 25% as a result, according to Mr. Masadeh.
Churn among part-time workers prompted &pizza, a 14-store chain in the Washington, D.C., area, to halt new restaurant openings for a while, says CEO Michael Lastoria. Managers noticed that customers gave low ratings to new stores where inexperienced, often part-time, workers comprised 95% of staff. Some 31% of &pizza staff now workfull-time, up from 15% in 2014, and the chain is set to open seven additional stores this year, Mr. Lastoria says.
Having more full-time workers requires managers to adjust. Sheetz’s store managers initially resisted adding more full-timers when the company launched the initiative in the summer of 2014, Ms. Doliveira says. Used to having a big bench of part-time workers to call upon, they worried about being caught short when employees called in sick. Managers are also figuring out how to plan shifts now that more workers have vacation time.
Moving to full-time has come with health insurance and an extra $50 or so each week for Tammy Shepard, a salesperson at a Sheetz in Statesville, N.C. “It gives you a sense of security, which is a huge thing,” she says.
Full-time private industry workers make $25.44 an hour in wages and salaries, as compared with $13.29 for part-time workers, according to the Bureau of Labor Statistics.
“There’s a real penalty that workers pay for working part-time,” says Carrie Gleason, director of the Fair Workweek Initiative at left-leaning advocacy group Center for Popular Democracy.
The promise of a 40-hour work week was what spurred Ms. Cooper to apply to Sheetz, though she holds down another part-time job managing a nearby pub. Logging just 14 hours a week there has made it tricky to stay on top of everything, such as the new beers on the menu.
“It stinks when you don’t know certain things,” she says.

After writer Dave Eggers attended a Donald Trump rally this past June, he realized now would be a good time for the “resurrection of the political protest song.” So he called up some artists, including Jim James and Aimee Mann, who wrote tracks for a project that would later become a playlist titled 30 Days, 30 Songs. That playlist, touted as being “written and recorded by musicians for a Trump-free America” launched Monday with Death Cab for Cutie’s “Million Dollar Loan.”
“From Woody Guthrie to Public Enemy, we know that songs can change minds, and particularly now, we need to motivate voters to stand against bigotry, sexism, hatred and ignorance,” Eggers said in a statement.
Eggers launched the playlist — available on Spotify and Apple Music — Oct. 10, 30 days before election day. Thao Nguyen, clipping., and Bhi Bhiman, among others, also contributed tracks, along with R.E.M., who offered up a never-before-released live song for the compilation.
