EMERYVILLE, Calif. – On Oct. 18, this city became the third in the nation to pass a Fair Workweek policy. The City Council passed the ordinance unanimously at its first reading, following testimony at a pre-meeting press conference and during the meeting itself, by those most affected.
Under the new policy, employers will have to give workers their schedules two weeks in advance, compensating them for last-minute changes. When more hours become available, current workers will have priority so they can get closer to fulltime work.
The council must confirm its action with a second vote, scheduled for Nov. 1. The new law, which will affect some 4,000 fast food and retail workers, is to become effective in July 2017.

New York City may be next: Mayor Bill de Blasio and City Council members are pressing legislation to require employers to give some 65,000 hourly fast food workers a two week notice of changes in their shift assignments. However, the bill doesn’t extend such requirements to retail stores or full-service restaurants.
Emeryville, a small city across the Bay from San Francisco with a large concentration of retail stores, already has the country’s highest minimum wage, with large employers required to pay their workers at least $14.82 per hour. Smaller businesses must pay at least $13 per hour.
At the state level, earlier this year California passed a new minimum wage law with a path to a $15 hourly minimum.
At the press conference, low wage workers, local residents, community and labor organizations, faith leaders and academic researchers told of the many challenges faced by retail workers who must deal with constantly shifting and unpredictable schedules and variable numbers of work hours.
Moriah Larkins, an Emeryville retail worker and activist with the Alliance of Californians for Community Empowerment (ACCE) who MC’d the press conference, told of her own experience working six days a week for a “bad apple” employer. “And on my days off they would call me in, and I have my son, who was two years old at the time.”
At first, Larkins said, she used to scramble and pay extra for last minute child care. But as she realized her extra hours, and less time for her son, were making him unhappy, she started refusing the extra shifts. After that, her hours, which had been 32 to 40 per week, were cut in half.
“Now,” she said, “I work for a ‘good apple.’ I work 28 hours per week, I can pay all my bills, I can spend time with my son and finish my nursing degree.”
In a conversation after the press conference, Larkins said she hoped the ordinance would pass “without exceptions.” She and others are warning that before the final vote Nov. 1, the California Retail Association is trying hard to weaken the measure.
Other retail and fast food workers described their experiences, including a past employer who paid subminimum wages and another who fired a worker after “forgetting” he had accepted her timely request for a day off.
The new ordinance has been in the making for a while. In May, Emeryville Mayor Dianne Martinez and Councilmember Ruth Atkin wrote an op-ed published by the San Francisco Chronicle, in which they said a regional fair workweek was needed to assure workers “stable schedules so they can pay the bills, live healthier lives, “and contribute more to our communities.
A recent study, Wages and Hours: Why workers in Emeryville’s service sector need a fair workweek, conducted by ACCE, the East Bay Alliance for a Sustainable Economy (EBASE), and the Center for Popular Democracy found that in a sample of more than 100 frontline Emeryville retail workers, some 68 percent had part-time schedules, 82 percent were people of color, eight out of 10 had variable schedules and nearly two-thirds only got their schedules a week or less in advance. Over two-thirds said they wanted to work more hours, while over half said they were scheduled for “clopening” shifts, or back-to-back closings and openings with less than 11 hours off.
The study concluded that employers need to commit to predictable, flexible and responsive schedules that allow for adequate rest.
At the Oct. 18 press conference, EBASE Deputy Director Jennifer Lin said, “Providing a fair work week is not only good for workers, it’s good for business, too.” With many retailers already scheduling in advance, she said, the new ordinance will help level the playing field, and stable schedules and more adequate hours also reduce turnover and absenteeism.
In an article earlier this month in The Nation magazine, author Michelle Chen noted that the Fight for $15 and Fair Workweek struggles are “converging on sectors that used to be known as bastions of dead-end jobs.” The next step, she said, is “to organize, and unionize, to give workers real collective bargaining leverage over their wages and working conditions. Work-life balance comes by shifting the power balance on the job, so that workers have the final say over when they’re on call.”

The story of the economic recovery varies dramatically depending on where it is being told. On Wall Street, big banks look stronger, bigger, and healthier than ever. Large companies are making record profits. But, the labor market remains weak. Although the economy has added more jobs in recent months, job growth on Main Street is not nearly as robust as during previous recoveries.[i] Unemployment rates in nearly every state remain above pre-recession levels. Wages have been stagnant or falling for most workers and the quality of jobs has decreased significantly. Main Street still has no clear route to prosperity.

Many communities are disproportionately struggling in this economy. The Latino unemployment rate is more than 2 percent higher than the rate for whites, and Latino wages and wealth are considerably lower than whites. Women continue to earn substantially less than men. This paper focuses on the economic disparities facing the African-American community in particular because the economic crisis is most acute there: African-American unemployment rates continue to exceed the national unemployment rates at the height of the recession, Black workers’ wages have dropped $0.44 over the past 15 years, though Latino and white wages have risen by $0.48 and $0.45, respectively; unemployment rates among African Americans are higher than those of other racial or ethnic groups; and, though Latino and white wealth has stabilized since the Great Recession, Black wealth continues to shrink. So, while Main Street may be stabilizing (albeit at a lower standard), the recovery has yet to reach Martin Luther King Boulevard. Creating a strong American economy must include prioritizing a genuine recovery for the African American community.
This joint report of the Center for Popular Democracy and the Economic Policy Institute examines the current state of the American economy and labor market, with particular attention to racial inequality and its contours before, during, and in aftermath of the Great Recession. It describes the role that federal monetary policy has played in exacerbating economic disparities over recent decades -- the shrinking national income share for working America and the exploding income and wealth gaps between the top 1 percent and the rest of us. The paper further explores the consequences of the major policy decision currently facing the Federal Reserve (or the Fed): whether to prioritize genuine full employment or to avoid inflation at the cost of robust employment and wage gains. Only by pursuing genuine full employment will the Fed ensure that the recovery reaches Main Street and Martin Luther King Boulevard – and communities of working people throughout the country. As the Fed makes crucial monetary policy decisions in the months and years to come, it must ensure that all communities can share in the prosperity of a functional economy.
The report also studies the decision-making processes and bodies of the Federal Reserve. Although the Board members that govern the regional Federal Reserve banks are legally required to represent the broad interests of the public, they are, in fact, predominantly representatives of the financial sector or large corporations. Without governance that represents the full diversity of the public, Fed decisions risk remaining uninformed by the full economic reality they create, as experienced in communities throughout the country. The Federal Reserve’s focus over the past 35 years has been on price stability, or tamping down inflation. While this focus is good for Wall Street, it has resulted in wage stagnation for most workers on Main Street. The cost of this focus has been slow recoveries in labor markets after each downturn. America needs the Federal Reserve to concentrate on labor market stability and insure that wages are rising with productivity, so that workers reap the benefits from their efficiencies and hard work; that means prioritizing a wage growth target, rather than inflation. A Federal Reserve dominated by banks and major corporations will produce an economy that works for them, at the risk of leaving tens of millions of working families – particularly Black working families – with little hope of a better life.
The report recommends that the Fed:
Create a Strong & Fair Economy
Stimulate Good Jobs for All: The Federal Reserve should commit to building a full employment economy. It should keep interest rates low so that the numbers job openings and job seekers are balanced and everybody who wants to can find a good job.
Invest in the Real Economy: The Fed should use its existing legal authority to provide low- and zero-interest loans so that cities and states can invest in public works projects like renewable energy generation, public transit, and affordable housing that will create good new jobs.
Research for the Public Good: The Fed should study the harmful effects of inequality and examine how policies like raising the minimum wage and guaranteeing a fair workweek can strengthen the economy and expand the middle class.
Create a More Transparent & Democratic Federal Reserve
Ensure That Working Families’ Voices Are Heard: Fed officials should regularly meet with working families and community leaders, not just business executives, in order to get a more accurate picture of how the economy is working.
Represent the Public: In regional banks around the country, Fed leaders come overwhelmingly from financial institutions and major corporations. The Fed should appoint genuine representatives of the public interest to these governance positions.
Create a Legitimate Process for Selecting Fed Presidents: In late 2015 and early 2016, the regional Fed banks will select their next presidents, who will serve five year terms. Currently, the process for selecting those presidents is completely opaque and involves no public input. That needs to change, so that the public has a real role in the selection process.

COMMERCE CITY — On a recent Saturday morning, about a dozen teachers from the Adams 14 School District walked through a trailer park asking parents how they could do their jobs better.
Christina Zavala, a parent of three students, had a list. At the top: stop the rampant bullying and pay more attention to her son, who has a learning disability.
“In my experience,” she said, “it doesn’t really feel like the teachers care.”
The cadre of teachers hope what they heard — good or bad — can help reshape their schools to better meet the needs of the mostly poor and Latino families that call Commerce City home. The teachers are advocating for a “community school model,” which in part calls for more partnerships with nonprofit groups to help curb the effects of poverty on the classroom.
“The only way we can make a difference with the families in our district is if we get involved,” said Barb McDowell, the Adams 14 teachers union president. “There are a lot of disenfranchised people. We’re not talking to the community.”
Relations between the Commerce City community and the 7,000-student school district have long been strained. Voters consistently have rejected pleas to increase local taxes to repair or replace aging schools and support educational programs. And in 2014, the U.S. Department of Education found the district had discriminated against Hispanic students and teachers.
The district’s response included more culturally responsive training for teachers and the creation of a committee of students to regularly talk about race issues.
Facing state sanctions for chronic poor performance on state English and math tests, the Adams 14 school district, just north of Denver, is overhauling many of its schools. The teachers union believes this provides an opening to put into practice some of the elements of the community school model. Schools are still finalizing their innovation plans, which are expected to be made public later this fall.
Teachers across Colorado are engaged in similar work. It’s all part of a statewide campaign organized by the Colorado Education Association, the state’s largest teachers union, called “The Schools Our Kids Deserve.”
The community school model can be traced back to the 1880s. Modern-day community schools have popped up in Chicago, Baltimore and Lincoln, Neb. Perhaps the most famous community school model is the Harlem Children’s Zone in New York City.
In Colorado, the Edgewater Collective in Jefferson County and Blocks of Hope in neighboring Westminster Public Schools are two efforts to create something like a community school.
While supporters of the community schools model have long said that no two community schools should look the same because the needs of communities vary, there is a growing effort to identify common themes that apply everywhere, said Reuben Jacobson, deputy director for the Coalition of Community Schools.
The Colorado teachers union, working with the Alliance to Reclaim our Schools and the Center For Popular Democracy, has created its own list which includes strong and proven curriculum, community support services, and positive discipline practices.
Community engagement, like the work the teachers in Adams 14 are doing, is also a must.
Trish Ramsey, a teacher at Adams City Middle School, put it simply: “This is the first step to rebuild trust.”

PHOENIX (AP) - A group advocating for worker’s rights is gathering signatures for a ballot initiative in Arizona that would increase the minimum wage to $12 an hour by 2020, at the same time Republican lawmakers are proposing their own ballot measure that would give the Legislature sole authority to set the wage in the state.
The fight over Arizona’s minimum wage has grown amid widespread worker frustration over sluggish wage growth that has fueled presidential campaigns and led to legislative battles on both sides of the country - California and New York lawmakers are poised to pass bills lifting the minimum wage to $15 an hour over the next several years.
The Fair Wages and Healthy Families Initiative incrementally increases minimum wage in Arizona to $12 per hour by 2020 and requires employers to provide earned paid sick time.
The initiative campaign has less than four months to collect more than 150,000 valid signatures necessary to get on the November ballot. Arizona’s current minimum wage is set at $8.05 per hour and is increased annually based on inflation.
Campaign manager Tomas Robles said his group has worked with people on both sides of the issues to find a compromise that offers workers a livable wage without putting too much of a burden on employers.
“We feel that this wage increase is that happy medium that protects small business and helps workers who can’t pay their rent at the end of the month even though they work full time,” he said.
The campaign committee has received backing from the Latino rights organization Living United for Change and the Center for Popular Democracy, a social and economic justice advocacy organization, Robles said. The campaign aims to collect more than 250,000 signatures using a combination of paid and volunteer petitioners to ensure they can get on the ballot.
At the same time, Arizona Republicans have proposed to increase the minimum wage to $9.50 an hour by 2020 with annual adjustments based on inflation - in a bid to stymie an increase in wages they say small businesses could not handle.
“This offering is kind of a counter-balance to the insane socialism we hear in other quarters,” said Sen. Don Shooter, R-Yuma, during a committee hearing in March.
It would also prevent cities, towns and counties from setting their own minimum wage, which Arizona Gov. Doug Ducey has said would “drive our economy off a cliff.”
The Senate Appropriations Committee passed the measure on a 5-3 party-line vote. It will now undergo a standard review before going to a Senate vote. If passed, House Concurrent Resolution 2014 could go before voters this November.
If both measures end up on the ballot and both pass, the initiative with greatest number of “yes” votes would win.

“Today we suffer, in November we vote,” dozens of protesters chanted in front of City Hall this afternoon. Some 40 people gathered to express dismay over yesterday’s Supreme Court deadlock over President Obama’s immigration plan, which would have given undocumented immigrants protection from deportation and the possibility to work in the United States. The rally was organized by the Bushwick chapter of Make the Road New York, a non-profit dedicated to representing the city’s Latino and immigrant communities.
President Obama’s executive action would have shielded over 5 million from deportation by introducing The Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA), which would have allowed the undocumented parents of American-born children to apply for work permits, and expanding the Deferred Action for Childhood Arrivals (DACA), which would have protected those who arrived in the U.S. before the age of 16 and stayed at least five years. For many participating in today’s rally, these measures would have been key to achieving a more secure legal status in the country. Many of those protesting were beneficiaries of DACA, and had hoped for the passing of DAPA to reunite families or keep them together.
Catalina Benitez, an immigrant from Mexico and a member of Make the Road, has been in the United States for over 20 years. She was attending the rally with her two-year-old son, Daniel, and said the Supreme Court’s deadlock came as a “great disappointment” to many.
“We were hoping that we’d be given more options.” Benitez said in Spanish of Obama’s plan, and the limbo that’s left in the wake of the Supreme Court’s 4-4 tie. Benitez’s son, as well as her five-year-old daughter, have benefitted from DACA, but the aborted expansion of the plan has many families worried about their future.
Benitez, who lives in Williamsburg, isn’t eligible to vote in the upcoming presidential election, but she hopes that the rally will raise awareness and encourage people who can vote to support immigrant rights. “The citizens who can vote should vote for Hillary Clinton,” she said.
Petra Luna, a Bushwick volunteer who helps Make the Road with press statements, event organizations, and community outreach, expressed a similar disappointment in the SCOTUS deadlock. “Immigrants are a significant community in this country,” she said in Spanish. “We’ve helped raise the economy, and we have a life here.”
Luna said that Make the Road organized this rally to show U.S. politicians that they want their voice to be heard. “We want the deportations to stop, and we want to incentivize people to vote in November,” she emphasized. “We are all hoping for an opportunity, and we want to encourage those people who do have the vote to represent us.”
Other organizations present at the rally were the New York Civil Liberties Union, the Minkwon Center for Community Action, the New York Working Families Party, United We Dream, and the Center for Popular Democracy, to name a few. Individuals would periodically get in front of the crowd with a megaphone and speak of their frustrations with the gridlocked immigration reform.
“I’m angry, I’m fed up with the system,” Jung Rae Jang, a DACA beneficiary with the Minkwon Center, told the crowd. “We need to get the immigrant community to come together against this.”
Daniel Altschuler, the press representative for Make the Road, said that the majority of those in attendance at the rally today were from Bushwick, but immigrants living in Staten Island and Jackson Heights, Queens, were also well-represented. According to the organization’s website, over 35 percent of households in Bushwick are made up of foreign-born immigrants, three quarters of whom are from Latin America. A significant number of those immigrants are undocumented.
Luna expressed hope that, come November, people will decide to vote in favor of supporting immigrant communities. “We’re all going to the same heaven,” she reflected. But in the meantime, she said she’ll keep fighting to represent immigrant rights, and hopes people with electoral power in this country will do the same.
“I’m willing to give this everything I’ve got,” she said resolutely.

Across the country, the economy is supposed to be slowly picking up, but the unemployment rate for Blacks is still about twice the rate of whites. A report by Progress Illinois said the state’s Black unemployment rate is one of the worst in the nation.
According to analysis by the Economic Policy Institute (EPI,) only two other states, New Jersey and South Carolina have higher Black unemployment rates than Illinois. D.C. had the highest Black unemployment rate at 14.2 percent, while Tennessee had the lowest at 6.9 percent. Illinois’ Black unemployment rate declined to 11.5 percent in the second quarter of 2015, according to Progress Illinois.
The nationwide unemployment rate has fallen to about 9 percent. However, the Black jobless rate is twice the white unemployment rate of 4 percent, according to the Bureau of Labor Statistics.
“African Americans are still unemployed at a higher rate than their white counterparts in almost every state,” said EPI economist Valerie Wilson, who conducted the unemployment analysis. “We need policies that look beyond simply reducing unemployment to pre-recession levels as an end goal.”
In a press release, Connie Razza, director of strategic research for the Center for Popular Democracy (CPD), said, contrary to the improving economy, “Black America is still in the middle of a Great Recession.”
According to Progress Illinois, EPI and the Center for Popular Democracy both called on the Federal Reserve to support policies that would help Black America.
“When [Fed] Chair [Janet] Yellen and other Fed officials talk about raising interest rates in 2015, they are talking about intentionally slowing down the economy and job growth, which would make it harder for most Americans, and particularly Black workers, to find good-paying jobs,” Razza said. “The direct consequences of the Fed’s projected interest rate hikes would harm millions of workers.”
A tight labor market, which we have now, benefits employers since there are more people looking for fewer jobs. This allows employers to keep labor costs low and easily fire workers, because there are hundreds of people lined up to replace them. Razza said the Fed needs to support policies that would move towards a full employment economy.
“A full-employment economy, as we saw in the late 1990s, shrinks racial inequity and will bring particular benefits to Black workers, who are disproportionately unemployed, underemployed, underpaid, and endure more difficult scheduling circumstances in the workplace,” Razza said.
Black unemployment has been a long-standing problem. The Labor Department began tracking employment figures by race in 1972 and since then the Black jobless rate has stubbornly remained at twice the white rate. Employment experts say its not just a matter of training and education. Studies have shown Black men with college educations have higher unemployment rates than white men with just a high school education.
However, economists say the improving economy is making it easier for all Americans, including Black people, to find work.
“Now, you’re starting to see a broad recovery which is reaching groups with high unemployment rates like African-Americans and teens,” said Michael Madowitz, an economist at the American Center for Progress in a CNN article.
This issue was also brought up during the last Republican debate.
“Once you have economic growth, it’s important we reach out to people who live in the shadows… which includes people in our minority community and people who feel they don’t have the chance to move up,” said Ohio Gov. John Kasich, a Republican presidential candidate.
